How to Check Whether an Industrial Facility’s Air Permit Is Current

A passed expiration date does not always mean a Title V permit has lapsed. Find the latest final permit, check renewal records, and confirm status with the responsible authority.

To check an industrial facility’s air permit, identify the facility and its permitting authority, find the latest final Title V operating permit and amendments, then verify the renewal record. Do not assume a permit is invalid just because its printed expiration date has passed: a timely, complete renewal application can extend a Title V permit while the agency processes it. For a definitive status, ask the responsible permitting authority.

This U.S.-focused guide covers Title V operating permits. “Air permit” can also mean a separate preconstruction or other authorization, which must be checked independently. A site-specific answer requires the facility’s name and location.

What “current” means for an air permit

For a Title V permit, “current” means that the facility’s operating authorization remains in force under the latest applicable agency action. The operative record may be a final permit with a future expiration date, a renewed or amended permit, or a permit continuing during renewal review. A draft permit or application shows a proposed or pending action, not by itself the final status.

EPA describes a Title V permit as a legally enforceable document containing the operating terms, conditions, and limitations that apply to a facility under the Clean Air Act. Its conditions include applicable requirements and monitoring and reporting duties; the permit does not generally create new substantive pollution controls. Step 1: Identify the facility and the authority responsible for its permit

Gather the facility’s legal or commonly used name, physical address, county, state or territory, and any known permit number or EPA facility identifier. A company may operate multiple sites, and one site may have multiple units or permits, so search by both name and location where possible.

Most Title V permits are issued under state or local Clean Air Act Part 70 programs. A county or local air district may be the issuing authority even when a state agency has a broader environmental role. EPA issues Part 71 permits in specified settings, including Indian Country, the Outer Continental Shelf, some territories, and certain program gaps or unresolved EPA objections. Use EPA’s Part 71 page to identify the relevant EPA regional office and jurisdictional information.

Step 2: Search the agency’s records and EPA’s Permit Hub

Start with the permitting authority

Search the state environmental or air-quality agency’s permit database, facility page, or public docket. If a local air district has delegated permitting responsibility, search that authority’s records too. Use the facility name, address, and any known permit number. Agency databases and public-record access differ by jurisdiction.

Check EPA’s Permit Hub as a second source

EPA’s Permit Hub displays permit-action documents submitted through CAAPS. Depending on the action, records may include applications, draft permits, statements of basis, responses to comments, and final permits. Coverage depends on submissions by participating authorities; no result in the Hub does not prove that a facility has no permit.

Use petition deadlines only to track active actions

EPA’s Title V public petition deadline table can help track proposed permits submitted for EPA review, including the review and public petition periods. It is not a complete inventory of final permits or a general status checker. The table data was last updated September 17, 2026, when reviewed.

Step 3: Find the latest final permit and subsequent actions

Open the latest final permit, rather than relying on a draft or application. Match the document to the facility’s address, source identity, and permit number. Record the issuing authority, issue or effective date, printed expiration date, and any later final action.

Then check the docket for effective administrative amendments, significant revisions, renewals, transfers, revocations, or superseding permits. A permit PDF found online may be an older version; its presence alone does not establish that it remains operative. If facility names, addresses, or identifiers do not match, ask the agency to resolve the discrepancy.

Step 4: Check whether renewal extends authorization

EPA explains that Title V permits generally have a five-year term and must state an expiration date. Under the renewal rules it summarizes, a timely and complete renewal application can extend the permit beyond that printed date while the application is processed. EPA’s FAQ describes “timely” as filing at least six months but no more than 18 months before expiration. Locate the renewal application and any agency notice or determination about completeness. EPA’s 2026 renewal guidance says authorities may allow applicants to reuse prior application material when permit terms and applicable requirements have not changed, including by cross-reference or incorporation by reference when the materials are available for public review. A renewal application may therefore not repeat every item from the previous application; its format alone does not establish whether it was timely, complete, or accepted.

Step 5: Ask the authority to confirm unclear status

If the records do not clearly establish the current status—or if the answer matters for a decision or dispute—contact the state or local permitting authority. For a Part 71 permit, contact the responsible EPA regional office. Provide the facility name and address and permit number, and ask for:

  • The latest effective final permit and all effective amendments.
  • The stated expiration date.
  • Whether a renewal application was received, filed on time, and deemed complete.
  • Whether authorization continues under the existing permit or a later action has reissued, amended, revoked, or superseded it.

If key records are not posted, request the relevant public docket documents. EPA’s Title V program information and Part 71 page can help direct you to the appropriate authority, but the permitting agency’s current record is the best source for a facility-specific determination.

Keep the finding limited to the permit you checked

State any conclusion with the facility, permit type, permit number if available, and the date the status was checked. A current Title V operating permit does not establish that a facility also has every required preconstruction approval for construction or modifications, or any other environmental authorization. Nor does permit currency prove compliance: that is a separate question involving the facility’s emissions, monitoring, recordkeeping, reporting, and other permit conditions.

Members of the public may petition EPA to object to certain state, local, or tribal Title V permits under defined conditions. EPA generally requires petition issues to have been raised during the permitting authority’s public-comment period, subject to limited exceptions. The petition process is relevant when following an active permit action, but it is not needed for a routine check of whether a final permit remains operative.
