A song appearing in Instagram’s music picker does not automatically clear it for every use. GEMA, a German collecting society, describes Instagram’s library permission as limited to Instagram and non-commercial content; commercial video use may require permission for pairing music with moving images. Your rights, purpose, platform, territory and the relevant licences all matter.
Can I use Instagram’s music library for a Reel?
GEMA says private individuals can generally use music from Instagram’s library in Stories, Reels and videos when the content is non-commercial and stays on Instagram. That is GEMA’s guidance, not a universal ruling for every country, track, account or use. Meta’s available catalogue and eligibility can vary; the detailed current rules for every region and format are not established here.
Library access is not a blanket licence to download a track, put it in a video elsewhere or repost the same edit on another platform. GEMA says the permission it describes is limited to Instagram. For reuse, check the rights and terms that apply to each platform and use.

Do not assume an account label settles the question. GEMA notes that an activity on a nominally private account can still be commercial depending on its purpose and context—for example, if it promotes a product or is part of influencer activity. It also cautions that Meta cannot conclusively decide every question of commercial character; rightsholders may take a view too.

Can I use a trending song in a business or sponsored post?
Do not treat a song’s presence in the picker as proof that it is cleared for a business, sponsored or other promotional video. GEMA says commercial users need to consider the synchronization right: permission to pair music with moving images. Its guidance advises obtaining authorization or a licence from a rightsholder, such as a creator or publisher. The exact process depends on the rights, contracts and applicable law.
GEMA’s page quotes Meta’s Music Guidelines as saying: “Use of music for commercial or non-personal purposes in particular is prohibited unless you have obtained appropriate licences.” This quotation is reproduced on GEMA’s guidance page; it should not be read as a verified statement of every current Meta rule for every post or placement.
For a commercial video, identify the rights holders and confirm that the permission covers the actual use. GEMA suggests searching its repertoire and contacting the publisher to identify rights holders. That is a Germany-oriented route, not a universal licensing procedure. A paid placement, boosted post or other advertising use may have additional terms; the available guidance does not establish a complete current Meta matrix for those formats.

Does crediting the artist make it okay?
No. Credit is not, by itself, permission. Meta’s copyright guidance also warns that buying or downloading a recording, adding a disclaimer, not intending to profit, modifying a work, finding it online, seeing other users post it or recording it yourself at a public event does not automatically establish permission. Nor does using only a short excerpt automatically make a post permissible.

Meta’s copyright guidance says the best way to help ensure an Instagram or Threads post does not violate copyright law is to post content you created yourself. The Help Center page can change, so check its current wording when planning a use.
Can I use the same Reel on another platform?
Not on the strength of Instagram’s music-library access alone. GEMA describes that permission as exclusive to Instagram. A video that is cleared for one platform is not necessarily cleared for another: check the relevant rights and licence terms before cross-posting, including for a version that retains music added in Instagram.

What if it’s my own song?
Check what you actually control before assuming “my song” means every relevant right is yours. The underlying composition and the sound recording can have different controllers. Co-writing, label or publishing agreements, samples and distribution arrangements may affect who can authorize a particular use. The answer depends on your agreements and rights chain; being the performer or songwriter alone does not settle it.

- Check whether the permission or distribution settings cover Instagram, commercial use and any planned cross-posting.
What can musicians do if someone uses their music?
Keep records that help establish your ownership or authority to act, such as relevant agreements and documentation identifying the composition and recording. Meta’s January 24, 2023 announcement described a rights-management program that included a global intellectual-property notice-and-takedown team, specialized reporting tools and a repeat-infringer policy. It also described Rights Manager as a set of tools for copyright holders to manage when, how and where their content is shared.

In that 2023 announcement, Meta said people with a Facebook Page could apply for Rights Manager access. That is a dated eligibility statement, not a guarantee of current availability. Check Meta’s Rights Manager announcement and current Meta instructions before relying on a particular tool or reporting route.

Music-library access serves particular uses under the applicable platform and rights terms; it does not mean every track is available for every purpose. For example, Meta’s June 22, 2022 announcement described #1MinMusic as an initiative for Reels and Stories on Instagram, featuring music from 200 artists across India. That is a description of that initiative at launch, not a current catalogue count or evidence that commercial use was cleared.
Meta’s announcement presented the initiative as a way for people to use tracks and for artists to share music and videos on Reels. That corporate description does not establish present availability, blanket licensing or the reach or commercial results of the program. A quick check before you post
- Define the purpose. Is the post personal, or does it promote a product, service, business or paid partnership?
- Confirm the platform scope. Will it stay on Instagram, or will you reuse it elsewhere?
- Identify the rights. Determine who controls the composition and the sound recording, and whether you have permission for the intended use.
- Check the placement and territory. Confirm that the terms cover the format, promotional context and location where the post will be used.
- Keep evidence. Save the relevant permissions or licence terms and check current Meta guidance for the track and use.
GEMA’s Instagram music-library guidance provides its explanation of personal and commercial use, synchronization rights and rights-holder checks. It is useful specialist guidance, not a substitute for advice on a specific legal situation or a guarantee that every jurisdiction follows the same approach.
