Super PACs vs. PACs: How Their Funding and Spending Differ

Traditional PACs may give limited amounts directly to federal candidates; Super PACs may raise unlimited funds from permitted sources for independent activity but cannot contribute to candidates.

The key difference is what the committees can do with their money: a traditional political action committee (PAC) may contribute limited amounts directly to federal candidates, while a Super PAC may raise unlimited funds from permitted sources for independent political activity but cannot contribute to candidates. This guide covers federal elections in the 2025–2026 cycle; state and local rules can differ.

What is the difference between a PAC and a Super PAC?

“PAC” is often used as a broad label, but the Federal Election Commission (FEC) distinguishes contribution-making PACs from independent-expenditure-only committees, commonly called Super PACs. A traditional PAC can give directly to federal candidates within applicable limits and can also make independent expenditures. A Super PAC’s defining role is to finance independent expenditures and other independent political activity, not to contribute to candidates.

The FEC describes Super PACs as committees that may receive unlimited contributions from individuals, corporations, labor unions and other political committees to finance independent expenditures and other independent political activity. See the FEC’s explanation of nonconnected PAC types.

What does “independent expenditure” mean?

A contribution is money or other support given to a candidate’s committee. An independent expenditure is spending made independently to advocate the election or defeat of a candidate; it is not a direct contribution to the candidate. That distinction explains how a Super PAC can spend to support or oppose candidates without being allowed to donate to their campaigns.

“Unlimited” describes how much a Super PAC may raise from sources permitted to fund it. It does not remove source restrictions, convert independent spending into a candidate contribution, or authorize every kind of coordination or spending. The FEC’s guidance on Super PAC and Hybrid PAC receipts explains the permitted and prohibited sources.

How much can a traditional PAC give to a federal candidate?

For the 2025–2026 federal election cycle, the FEC lists a limit of $5,000 per election for a multicandidate PAC giving to a candidate committee and $3,500 per election for a non-multicandidate PAC. These are limits on PAC contributions to a candidate, not limits on a PAC’s independent expenditures. The FEC maintains the limits for contributions made by nonconnected PACs.

The FEC also lists a separate limit of $5,000 per year for an individual contributing to a PAC (SSF or nonconnected) in 2025–2026. That is a donor-to-PAC limit, not the amount a PAC may give to a candidate. The FEC’s limits on contributions received by nonconnected PACs cover that distinction.

Where do Super PACs get their money?

Under FEC guidance, Super PACs may accept unlimited contributions from individuals, corporations, labor organizations and other political committees. The unlimited amount rule does not mean every source may contribute: the FEC identifies foreign nationals, federal contractors, national banks and federally chartered corporations as prohibited sources. How Hybrid PACs fit into the comparison

A Hybrid PAC combines a contribution-making account with a separate account for independent activity. The contribution account is subject to amount limits and source prohibitions; the non-contribution account may accept unlimited contributions from permissible sources for independent expenditures and other independent activity. The accounts are segregated because the funds follow different rules.

The FEC describes the non-contribution account as available for independent expenditures, certain other ads referring to federal candidates and generic voter drives in federal elections, while the separate contribution account can make contributions to federal candidates subject to statutory limits and source prohibitions.
