1. Identify what the product owns and how it is structured
Start with the prospectus, not the product name. A crypto-linked exchange-traded product may hold bitcoin or ether directly, or it may gain exposure through futures contracts. Those approaches can behave differently and carry different structural risks.
The SEC’s September 9, 2024 Investor Bulletin on ETPs providing exposure to bitcoin and ether explains that spot bitcoin and ether ETPs are exchange-traded commodity trusts, not investment companies registered under the Investment Company Act of 1940—even when a product is called an ETF. The bulletin describes futures ETPs as holding futures contracts and being primarily structured as ETFs. This distinction describes the products covered by that SEC bulletin; do not assume it applies identically to every crypto-linked product or jurisdiction.
- Spot exposure: Find out whether the product holds the crypto asset itself and how the filing describes custody and other service providers.
- Futures exposure: Check which futures contracts the product uses and how its strategy seeks to provide exposure.
- Legal structure: Confirm the entity type and applicable disclosures in the filing; a ticker or marketing label is not enough.
2. Read the prospectus and periodic reports
Use the summary prospectus to understand the objective and strategy, then consult the full prospectus and latest periodic reports for detail. The SEC says spot bitcoin and ether ETP filings disclose material factors that make an investment speculative or risky. It also directs investors to search filings through EDGAR.

Look for the objective, investment strategy, material risks, custody arrangements, service providers, creation and redemption mechanics, and the complete fee disclosures. These details help show what could affect the investment and how the product is intended to operate; they do not remove the risk of loss.
3. Compare the full cost, not just the headline fee
Review the standardized fee table and distinguish sponsor or operating fees from costs you may incur when trading, including brokerage commissions and the bid-ask spread. The SEC’s fee guidance explains that fees reduce returns.

For spot crypto trusts, the sponsor fee is generally paid from trust assets because the trust does not generate income. That can reduce the amount of crypto represented by each share over time. Consider this effect alongside the costs of buying and selling shares rather than treating the stated annual fee as the only expense.
4. Check tracking, premiums and trading quality
Compare the market price with the fund’s net asset value (NAV) and with the crypto benchmark or reference price described in its disclosures. A share’s exchange price can be above or below NAV, so a buyer may pay more—or a seller receive less—than NAV. Crypto ETP prices may also diverge from the underlying asset as investor demand changes or because of issuer issues or broader crypto-market events.

Use the fund’s website and exchange information to review recent and historical premiums or discounts and the median bid-ask spread. These measures help you assess whether the price and trading conditions are acceptable for your intended trade. The SEC’s ETF guidance also recommends reviewing the objective, holdings, risks, costs, NAV, closing market price, historical premiums and discounts, and median bid-ask spread.
5. Compare products on equal terms
If you are choosing among several products, compare the same features for each rather than letting a familiar name or a low stated fee decide the choice.

The SEC warns that bitcoin and ether are highly speculative and that investors could face volatility, loss, tracking deviations, and fraud or manipulation risks in underlying crypto trading platforms. Its September 9, 2024 bulletin states: “Investors should understand that bitcoin and ether are highly speculative investments.”
