What is Eric Swalwell accused of?
Reporting on Pulte’s referral said the allegation concerned whether Swalwell represented his Washington, D.C., home as his primary residence on mortgage paperwork. The claimed motive was to obtain more favorable loan terms. That is an allegation attributed to the referral, not a finding that Swalwell committed mortgage fraud. Early reports also mentioned possible tax-fraud allegations, but the detailed basis of the referral was unclear in contemporaneous coverage. Axios reported on the referral and ABC News covered the claims and lawsuit.
What did Swalwell say about the mortgage?
Swalwell denied wrongdoing. In his November 25, 2025, complaint, he said a sworn affidavit attached to the mortgage agreement expressly disclaimed his intent to occupy the D.C. home as his primary residence. According to his account, the home was intended to be his wife’s primary residence, while he remained a California resident. These statements are his position in a legal filing, not a court’s determination about the mortgage documents.
The complaint described the referral’s allegations as “patently false.” That quotation reflects Swalwell’s characterization in his filing; it does not establish that a court or agency accepted his account. The complaint is available through the public court record.

Why did Swalwell sue Pulte?
On November 25, 2025, Swalwell sued Pulte and related parties in federal court in Washington, D.C. His complaint alleged that Pulte improperly accessed or used private mortgage information and referred him to DOJ in retaliation for his criticism of President Trump. The suit asserted First Amendment and privacy-related claims. Those were allegations by the plaintiff, not rulings that Pulte acted unlawfully.
The public docket records a joint stipulation of voluntary dismissal without prejudice dated March 20, 2026. A dismissal without prejudice is a procedural disposition of the civil suit; it is not a decision on the truth of the mortgage allegation or a finding for either side on the merits.

What is known about DOJ’s response?
The public sources reviewed do not establish whether DOJ opened or completed an investigation, filed criminal charges based on the referral, or reached another outcome. A referral asks prosecutors to consider an allegation; it does not itself mean that prosecutors accepted it, began an investigation, or charged anyone. The civil suit’s dismissal also does not answer what, if anything, DOJ did.
