There is no timeless yes-or-no answer. To decide whether residential construction attracted Indian service tax, first identify when the service was provided and consideration was received, then apply the Finance Act, 1994 and exemption wording in force for those dates. The analysis also depends on who supplied what to whom: a developer’s arrangement with a homebuyer is not automatically the same transaction as a contractor’s work for that developer. Service tax gave way to GST on 1 July 2017, so construction supplies after that boundary require a separate GST analysis.
Start with the dates and the transaction
Gather the dates and documents before trying to decide whether tax was due. The service-tax framework changed on 1 July 2010 and again on 1 July 2012; GST began on 1 July 2017. The relevant answer may turn on the applicable statutory version, when work was supplied, and when money or other consideration was received. Invoice dates alone may not settle those questions.
- Mark the relevant period. List construction or service dates, invoice dates, and the dates and amounts of each payment or other consideration. Identify any period that crosses 1 July 2010, 1 July 2012, or 1 July 2017.
- Map each transaction separately. Name the provider, recipient, promise, and consideration for the builder-to-buyer arrangement, contractor-to-builder work, and any landowner or development-rights arrangement.
- Describe the property and purpose. Establish whether the work concerns one dwelling, a residential complex, or a mixed-use project; whether it was intended for sale or built for the customer’s own use; and what the contract required.
- Collect completion and contract records. Locate the completion certificate, issue date and issuing authority, and the sale agreement, work order, construction contract, and any tripartite or development-rights documents.
These are separate checks: a project label such as “residential construction” does not, by itself, establish the service-tax result.
Which legal period applies?

The dates above mark changes in the framework, not a complete answer for a contract spanning more than one period. For a live assessment or dispute, confirm the Gazette text and amendments that applied to each relevant date.

For the 2012–2017 rules, test sale intent and completion timing
From 1 July 2012, the Finance Act’s declared-service framework included specified construction of a complex, building, civil structure, or part intended for sale, wholly or partly. The construction entry excluded the stated case in which the entire consideration was received after issuance of a completion certificate. The CAG’s 2015 historical account describes this framework.
This is a timing condition within that entry, not a general rule that every completed home is exempt. Nor does it establish that every advance automatically creates service-tax liability: the transaction, the other applicable provisions, and the exact dates still have to be examined. Check who issued the certificate and whether that authority was recognized by the law applicable at the time. Do not substitute the GST statute’s certificate definition for the historical service-tax wording.

- Sale intended and some consideration received before completion: the construction entry’s timing exception may not fit; assess the entry and all other applicable rules for the relevant dates.
- Entire consideration received after the relevant completion certificate: this is the circumstance described in the entry’s exclusion, subject to the actual statutory wording and facts.
- Own-use construction or a different contractual arrangement: do not assume the intended-for-sale entry applies; classify the actual service and test the other provisions that may govern it.
These are screening outcomes, not a determination of liability or tax payable for an individual project.
Separate the builder, contractor, and other parties
Builder or developer and prospective buyer
Identify what the developer undertook to provide to the buyer and whether the property was intended for sale before completion. For the 2012-onward construction entry, record when each part of the consideration was received relative to the relevant completion certificate. A contract’s wording, payment history, and project facts matter more than calling the transaction a “flat sale” or “construction service.”

Contractor and builder
A contractor engaged by a developer supplies a different service from the developer’s arrangement with a buyer. Review the work order, scope, recipient, consideration, and contract type independently. Under the post-1 July 2012 service-tax framework, the service portion in execution of a works contract was a declared service under section 66E(h), as recorded by the CAG. That does not mean the full contract value should automatically be treated as a service: the applicable service-portion valuation and tax mechanism must be established for the relevant contract and period.
Landowner or development-rights arrangements
If a landowner, developer, or another party contributed land, development rights, or non-cash consideration, identify the obligations and consideration for each leg. Do not assume that an arrangement involving several parties has a single provider, recipient, or payment date for all tax questions.

Check the property type, contract, and exemption wording
Classify the work before relying on a project description. Relevant distinctions include a single residential unit versus a residential complex, construction intended for sale versus own-use work, mixed-use components, and an ordinary construction contract versus a works contract. The legal category can depend on what the provider promised, not just the finished building’s appearance.
Then check the exact exemption notification and amendments in force on the relevant date. CBIC’s ACES FAQ records that Notification No. 25/2012-ST was dated 20 June 2012 and effective from 1 July 2012. That date alone does not establish that a particular dwelling, project, or contract qualified: eligibility depends on the applicable text and the facts. The available official material does not establish the full historical amendment chain or the exact conditions for every single-unit or affordable-housing exemption, so do not state a categorical exemption without verifying those instruments.

Likewise, CBIC’s GST notification treatment for pure-labour construction of a single residential unit is a GST rule. It does not prove that the same work was exempt from service tax.
What is needed before calculating tax or deciding liability?
A conclusion about tax due requires more than identifying a potentially taxable service. Verify the applicable rules for the period and contract, including valuation or abatement, point-of-taxation provisions, exemptions, and any rule allocating liability. The materials summarized here do not establish those details for a particular transaction, so they do not support a universal rate, calculation, or liability conclusion.
- Construction and service dates, invoices, and a dated record of each cash or non-cash payment.
- Agreements, work orders, development-rights documents, and evidence of each party’s role.
- Facts about unit count, residential or mixed use, intended sale, and the work actually undertaken.
- The completion certificate, date, and issuer; for post-transition GST questions, the relevant first-occupation facts may also matter.
- Service-tax registration and returns, invoices, valuation or abatement treatment, and the exemption claimed.
- The historical Finance Act and notification versions that applied to the dates in question.
For supplies from 1 July 2017, the CGST Act has a separate construction rule tied to receipt of the entire consideration after a completion certificate or first occupation, whichever is earlier. That is a GST test and should not be blended with the earlier service-tax construction entry.
Make a defensible determination
Work through the dates, transaction legs, property classification, completion and payment timing, and period-specific exemption and valuation rules in that order. If the answer depends on a disputed payment date, certificate, contract classification, or historical amendment, preserve the underlying documents and have an Indian indirect-tax professional verify the law for those exact dates. Without those facts and the applicable legal texts, the defensible answer is a framework rather than a yes or no.
