A writ petition under Article 226 may still be available in exceptional circumstances—such as a serious natural-justice or jurisdictional defect—but an available appeal is an important consideration. The right route depends on what the order says, the evidence needed to challenge it, and the procedural position in your case.

The legal test for bypassing an alternative remedy comes from the Supreme Court’s decision in The Assistant Commissioner of State Tax & Ors. v. M/s Commercial Steel Limited, as reproduced by the Delhi High Court: exceptions include a breach of fundamental rights, violation of natural justice, excess of jurisdiction, or a challenge to the vires of a statute or delegated legislation. The 2025 Delhi High Court ruling is an illustration of how that test may be applied; it is not a nationwide rule that writ petitions are unavailable in ITC cases.
First identify what the reversal order actually alleges
“ITC reversal” is not one legal issue. The notice and adjudication order should identify the provision relied on, the tax period, the alleged shortcoming and how the amount was calculated. The dispute could concern eligibility conditions, blocked credits, supplier-side issues, a mismatch, alleged fraud, interest or penalty, limitation, or a procedural defect. Each argument needs to match the law applicable to the relevant tax period and the evidence in the record.
For example, CBIC’s Input Tax Credit Rules describe attribution and reversal mechanics for common inputs or input services used partly for exempt supplies or non-business purposes, including an annual adjustment. Those rules address one possible category; they do not establish that every reversal dispute concerns common credit.

When a section 107 appeal is usually the better fit
Consider the statutory appeal first when the core question is whether the credit was eligible or whether the officer correctly assessed the transactions and evidence. An appeal is designed for a merits challenge, including review of disputed facts and calculations. In a 31 October 2025 judgment, the Delhi High Court said it ordinarily would not exercise writ jurisdiction in an alleged fraudulent-ITC matter involving complex transactions and voluminous evidence. That decision is an example, not a categorical bar applicable in every court or case.
Under the CBIC appeal rules, the appeal is filed in Form GST APL-01 with the prescribed supporting material, including a certified copy of the order. The applicable version of the rules and the filing procedure should be checked for the particular case.

When a writ petition may warrant consideration
A writ petition may warrant focused legal review where the record supports a recognized exception to the alternative-remedy rule. For example, the concern might be that the authority acted outside its jurisdiction or that the taxpayer was denied a meaningful opportunity to be heard. A challenge to the validity of the relevant legislation may also raise a different issue from a disagreement over how the officer assessed the facts.
Simply disputing the officer’s conclusion about invoices, supplies or credit eligibility does not, by itself, establish one of those exceptions. Whether a procedural or jurisdictional complaint is strong enough depends on the order, the notice, what happened during adjudication and the documents showing it.

Build the record and protect the appeal position
- Record the communication date. Keep the order, proof of service and portal acknowledgements. The section 107 appeal period generally runs for three months from communication of the decision or order, so calendar the deadline using the facts of service and the applicable law.
- Read the notice and order together. Note the tax period, statutory provision, alleged reason for reversal, amounts demanded and any interest or penalty. Separate what the authority actually decided from allegations in the notice.
- Organize evidence by issue. Assemble the relevant invoices, ledgers, transaction records and correspondence, and connect each document to the specific finding you dispute. Preserve the material that was filed during adjudication as well as the department’s communications.
- Identify material not submitted earlier. The appeal rules limit additional evidence but recognize specified exceptions, including material that could not be produced despite sufficient cause or where there was not an adequate opportunity to present it. The appellant must provide written reasons; the other side must have an opportunity to respond. Do not assume that an appellate authority will automatically admit omitted documents.
- Calculate the statutory payment requirement. Separate admitted dues from disputed tax and verify the applicable version of section 107(6), amendments and calculation before filing. The CBIC section 107 extract reviewed for 2026 states a 10% pre-deposit against remaining disputed tax, capped at ₹20 crore; the figure and its application must be confirmed for the particular order.
Questions to resolve before choosing a route
- Is the challenged document an appealable adjudication order, and which statutory provision governs it?
- Is the main disagreement factual or evidentiary, or does it concern jurisdiction, a hearing defect or validity of legislation?
- What is the communication date, and what is the section 107 filing deadline in the circumstances?
- What admitted dues and disputed tax are involved, and how does the applicable pre-deposit provision calculate the amount?
- Was any important evidence left out of the adjudication record, and can the appeal rules’ conditions for additional evidence be met?
- Could pursuing more than one route create inconsistent positions or conflicting findings? The Delhi High Court’s discussion of complex alleged ITC fraud highlights that risk; obtain advice before starting parallel proceedings.
Do not assume a writ will restore a missed appeal
The cited authorities do not establish that filing a writ petition cures a missed section 107 deadline, nor do they promise a remedy for a late appeal. The consequences of delay and any available options depend on the order, governing law and applicable decisions. If the deadline is close or may have passed, get case-specific advice promptly rather than relying on the writ route as a substitute.
