How to Challenge a Mobile Home Park Lot Rent Increase

A lot rent increase may be challengeable, but procedures and deadlines depend on the park’s location. Preserve the notice, verify local rules and use the correct formal process.

You may be able to challenge a mobile home park lot rent increase, but the grounds, notice rules and filing deadlines depend on where the park is and on your rental agreement. There is no single nationwide deadline or process established by the state examples below. Start by identifying the rules for your state, county and city, then preserve the notice and act promptly.

Start with the notice, your agreement and the dates

Save the rent-increase notice and its envelope or delivery record, your current rental agreement and any prospectus, earlier notices, your rent ledger, and communications with the owner or manager. Record when the notice arrived and the proposed effective date.

Write down the current and proposed base lot rent, the percentage change, and every separate fee, utility charge or pass-through. Check the agreement for renewal terms and any explanation of the proposed charges. These records help you identify what changed and calculate how much time you have to respond.

Find the rules that apply to your park

Look up current official state statutes and local rent-control or tenant-protection rules, and identify the housing or manufactured-home agency responsible for the park. Confirm whether the rules cover a homeowner who rents only a homesite, what notice is required, whether increases are limited by amount or frequency, and how and when to challenge one. Apartment-rental rules may not apply to a homeowner renting a lot.

Legal terminology varies: a law may refer to a manufactured home, mobile home, homesite or lot rental amount. Use the rules for the park’s actual location and tenancy rather than assuming another state’s process applies.

Ask the owner to explain the increase in writing

Request an itemized explanation of the proposed amount and the material facts used to set it. If the owner points to operating costs or taxes, ask which costs changed, by how much, and whether any decreased. If the owner relies on comparable parks, request their names and locations, rents, lot sizes, services, amenities and management details.

Compare the base rent separately from fees and utilities. Note changes to services, facilities or rules alongside the increase. To judge whether another park is a useful comparison, consider geography, lot size, included services, amenities, park condition and management. The legal relevance of these factors depends on local law.

Use the formal route—and deadline—for your location

Some jurisdictions provide a meeting, mediation, agency complaint or court process. Follow the applicable steps exactly, retain copies and proof of delivery, and seek local tenant legal aid or a housing attorney if a deadline is close, a court filing may be required, or the owner threatens eviction.

Florida — 2026 Florida Statutes, section 723.037 For specified increases and changes, the statute requires at least 90 days’ written notice. It provides for an affected-resident committee and a good-faith meeting no later than 60 days before the effective date. If statutory conditions are met, a majority of affected homeowners may petition for mediation within 30 days after the last scheduled meeting. Committee designation, signatures and other statutory requirements matter. These timelines are Florida-specific; check the current full statute before relying on them.
Florida — 2026 Florida Statutes, section 723.033 A court may decline to enforce an unreasonable increase and may award a refund or reduce future rent. The statute says rent above market rent is unreasonable. Relevant evidence may include comparable parks with similar facilities, services, amenities and management, as well as CPI, costs, taxes and prior disclosures. An increase exceeding CPI or nearby rents is not automatically unlawful. The court’s analysis is governed by Florida law.
Colorado — Department of Local Affairs bulletin, April 17, 2026 The agency says lot-space homeowners generally must receive at least 60 days’ written notice and that there may be only one increase per tenant within any 12-month period of consecutive occupancy. It also describes an agency oversight complaint process. Check current statutes, registration and other statutory conditions, and whether your tenancy is covered. The bulletin is an agency update, not a complete legal analysis.
New York — State Attorney General manufactured-home tenant guidance In most cases, increases that include lot rent, fees or utilities are limited to 3%; up to 6% may be allowed if justifiable. A tenant may challenge a proposed increase above 3% in court within 90 days, and the guide says the judge decides whether it is justifiable. Confirm current coverage, exceptions and court procedure. This summary describes New York guidance, not a rule for other states.

The Colorado figures above come from the Department of Local Affairs update dated April 17, 2026. The New York Attorney General guidance was accessed October 3, 2026. Verify the current official rules before acting.

Coordinate with neighbors if it helps

Other affected homeowners may help gather comparable-rent information, document service changes or request a meeting. Before anyone speaks or files on behalf of residents, confirm who is authorized to represent them. Florida’s statute has particular written-designation and majority requirements for association standing and a mediation petition; do not assume those requirements apply elsewhere.

Keep rent and legal notices on a separate track

A dispute does not automatically suspend your rent obligation or prevent a nonpayment case. Before withholding rent or paying a disputed amount into an account, get advice specific to your agreement and local law. Respond promptly to court papers; do not ignore them while pursuing a rent challenge.
