Visa and Mastercard ATM Fee Settlement: Do You Qualify?

You may qualify if you paid an unreimbursed fee at an independent U.S. ATM for a qualifying deposit-account withdrawal between October 24, 2007, and August 14, 2026. Check the official settlement site for current claim instructions and the reported February 10, 2027 deadline.

You may qualify for a payment from the proposed $167.5 million Visa and Mastercard ATM-fee settlement if you paid a fee at an independent U.S. ATM for a qualifying withdrawal between October 24, 2007, and August 14, 2026, and your bank did not fully reimburse it. The reported deadline to file a claim is February 10, 2027. Eligibility and current filing instructions are controlled by the settlement materials and court process, so check the official settlement website before filing.

Who may qualify for the ATM-fee settlement?

The reported class covers people in the United States and its territories who meet all of these conditions:

  • The withdrawal occurred from October 24, 2007, through August 14, 2026.
  • The ATM was independent—not owned by a bank or other financial institution.
  • You made a domestic cash withdrawal from a deposit account using an ATM card or PIN-debit card.
  • The operator charged a surcharge or access fee, and your bank did not fully reimburse that fee.

Which transactions are excluded?

The reported exclusions include transactions made with credit cards, cash advances, and prepaid cards. A fee on one of those transactions does not meet the reported definition of a qualifying deposit-account withdrawal.

How to check your eligibility

  1. Check the date. Was the withdrawal between October 24, 2007, and August 14, 2026?
  2. Identify the ATM. Was it independent, rather than owned by a bank or financial institution?
  3. Identify the account and card. Was it a domestic cash withdrawal from a deposit account using an ATM or PIN-debit card—not a credit-card transaction, cash advance, or prepaid-card transaction?
  4. Check the fee and reimbursement. Did the ATM charge a surcharge or access fee, and did your bank leave some or all of it unreimbursed?
  5. Confirm location. Did the withdrawal take place in the United States or a U.S. territory?

If you cannot remember a transaction, review old bank statements, account records, or transaction histories where available. Do not assume that a fee qualifies just because it appeared on a statement: the ATM, transaction type, dates, location, and reimbursement all matter.

How to file a claim and when it is due

ClassAction.org reports a claim deadline of February 10, 2027, and says claims can be submitted online or by mailing a printable PDF form. The notice ID on a notice email may be used when filing. Because forms, documentation rules, administrator contacts, and mailing instructions can change, get the current form and directions directly from the official settlement website. Do not send sensitive financial information to an address or contact found only in an unrelated notice or article.

How much might an eligible claimant receive?

The settlement fund is $167.5 million, but that is the gross fund—not a guaranteed payment to each person. The settlement website says the fund covers attorneys’ fees, costs and expenses, notice and administration, taxes and tax expenses, service awards, and payments to eligible class members. ClassAction.org describes payments as an equal-share or pro-rata distribution whose final amount depends on the number of valid claims and other factors. The reviewed sources do not establish an individual payment amount, so no reliable per-person estimate can be given.

What the settlement does—and does not—establish

The case is Burke et al. v. Visa Inc. et al., No. 1:11-cv-01882. Plaintiffs alleged that Visa and Mastercard network rules prevented independent ATM operators from offering lower access fees when a transaction could be routed over a less expensive competing network. That is an allegation, not a finding that either company was liable.

ClassAction.org reported that the court granted preliminary approval on August 14, 2026, and that a final approval hearing was scheduled for February 17, 2027. It also reported that payments would follow final approval and resolution of appeals. Those are reported procedural dates and expectations, not a guarantee of approval or a payment date; check the official settlement site for updates.
