TRICARE Fraud Case: $26 Million Billed, Cybertruck and Casino Party

A federal jury convicted clinic owner Kevin D. Curry in a TRICARE scheme: DOJ says clinics billed more than $26 million, while TRICARE paid about $17 million.

A federal jury convicted Kevin D. Curry on September 24, 2026, in a scheme involving more than $26 million in claims to TRICARE. That is the amount billed—not the amount the program paid: the U.S. Department of Justice says TRICARE paid approximately $17 million. DOJ also says proceeds funded hotel stays, a lavish casino-themed party and a gold-plated Tesla Cybertruck worth more than $100,000. Sentencing was still pending in DOJ’s October 1, 2026 update.

What happened in the TRICARE fraud case?

A Fort Worth federal jury found Curry guilty on September 24, 2026. DOJ identifies him as a 64-year-old licensed professional counselor from Frisco, Texas, who owned and operated three purported mental health clinics:

  • Acuity TMS of Plano LLC in Texas
  • Acuity TMS of Fort Worth LLC in Texas
  • Emerald Coast TMS of Fort Walton Beach LLC in Florida

According to the DOJ’s account of court documents and trial evidence, the clinics submitted false, fraudulent and kickback-tainted claims for transcranial magnetic stimulation (TMS) therapy. DOJ says the scheme involved servicemembers, veterans and family members. The Justice Department’s announcement was issued September 25, 2026, and updated October 1.

How much did TRICARE pay?

DOJ says the clinics billed TRICARE more than $26 million and the program paid approximately $17 million. The figures describe different stages: claims submitted versus money received. The $26 million should not be described as the amount TRICARE paid.

DOJ says the kickbacks were directed at active-duty servicemembers, veterans and family members to induce them to consent to TMS they did not qualify for and often did not receive. The announcement does not give individual beneficiary counts or a claim-by-claim accounting.

What did the jury convict Curry of?

The jury convicted Curry on nine counts:

  • Three counts of health care fraud
  • Three counts of offering and paying illegal health care kickbacks
  • Three counts of engaging in monetary transactions in criminally derived property

DOJ says Curry used doctors’ credentials without their knowledge or consent, falsely presented himself as a medical doctor and directed staff to fabricate records. These are descriptions of the conduct DOJ attributed to the scheme; the convictions listed above are the specific counts the jury decided.

What happened to the alleged proceeds?

DOJ says some proceeds paid for hotels, a lavish casino-themed party and a gold-plated Tesla Cybertruck worth more than $100,000. Those details describe spending the department attributed to proceeds of the scheme; they do not change the distinction between the amount billed and the amount paid by TRICARE.

What happens next, and what is the possible penalty?

Sentencing had not taken place as of DOJ’s October 1, 2026 update. DOJ says each of the nine counts carries a maximum sentence of 10 years. That is a statutory maximum, not a prediction or an imposed sentence. The judge will determine any sentence after considering the sentencing guidelines and statutory factors.

How this case fits into federal health care fraud enforcement

Separately from Curry’s case, DOJ says its Health Care Fraud Strike Force Program had charged more than 6,200 defendants since 2007, in cases involving more than $45 billion in alleged billings to federal health programs and private insurers. DOJ reported that the program comprised nine strike forces in 2026. Those program-wide figures are not additional totals from the Curry case.

DOJ listed the Defense Criminal Investigative Service, FBI Dallas Field Office, Texas Attorney General’s Medicaid Fraud Control Unit and Department of Veterans Affairs Office of Inspector General as investigators. The prosecutors named were Assistant U.S. Attorney Ethan Womble and DOJ Fraud Division trial attorneys Adam Tisdall and Yael Mash.
