The North Mara lawsuit puts a narrow but important question before the English High Court: can an industry association be legally responsible for how it certifies gold as responsibly sourced? The LBMA denies liability. As of 3 October 2026, the case had not produced a court finding that the association’s certification was wrongful or that the dispute threatened the bullion market.
What is the lawsuit about?
Families of two Tanzanian artisanal miners who died in separate incidents in 2019 brought a claim against the London Bullion Market Association (LBMA). They allege that the association wrongly certified gold from Tanzania’s North Mara mine as meeting responsible-sourcing standards despite serious human-rights allegations linked to the mine. Their case is that the LBMA failed to apply its standards properly. Those are allegations, not findings by a court.
The LBMA is an industry association that sets standards for the London precious-metals market. It is not the operator of the North Mara mine. The association denies the claim in full, including that it owed or breached the alleged duty of care or caused the miners’ deaths. Its account of its role is that it promotes standards and responsible-sourcing practices rather than controlling mines, refiners, auditors or police. How do the claimants’ case and the LBMA’s defence differ?

These are competing legal arguments, not conclusions about what the court will decide. The broader issue has been described by claimants’ lawyer Daniel Leader as “whether a certification body can be held legally responsible for a flawed certification process,” as reported by The Independent. That is an advocate’s framing of the dispute, not a statement of settled law.

What is the case’s status?
The claim was filed in December 2022. The LBMA first challenged whether the case could be heard in England, then withdrew that jurisdictional challenge in June 2024, allowing the claim to proceed in London, according to The Independent’s procedural report.
In its July 2026 update, the LBMA said the original trial was scheduled to begin on 12 October 2026. That is the scheduled date as of 3 October 2026, not confirmation that the trial has since begun or that a judgment exists.

Leigh Day, the claimants’ lawyers, said on 9 July 2026 that 30 additional people alleging that they or family members were killed, injured or tortured in incidents between December 2022 and March 2024 had joined related claims. Does the case expose a threat to the bullion market?
Not on the facts established so far. The case raises a question about whether a private industry association can owe a duty of care over a certification process where alleged harm occurs in a supply chain covered by its standards. A ruling on that question could be relevant to other voluntary standards programs, which is why the LBMA has argued that the implications could extend beyond gold.

That possibility is not the same as evidence that the LBMA is insolvent, that bullion trading will be disrupted, or that the market faces an established existential threat. The cited accounts provide no independent estimate of potential damages, insolvency risk or market disruption. Any effect on the wider market would depend on what the court decides and on how market participants and other standards programs respond.

For personal-finance readers, the immediate takeaway is about the limits of what a responsible-sourcing label establishes. The dispute concerns the LBMA’s alleged failure to apply its standards in a particular supply-chain context; it does not establish that all LBMA-linked gold is improperly sourced, nor does it amount to a court ruling against the association. A certification label is not, by itself, proof that every allegation connected with a mine has been resolved.

The next meaningful development is the court’s handling of the original claim and, eventually, any findings it makes. Until then, the allegations, the LBMA’s denial and the possible consequences for certification programs should be kept distinct.
