Florida’s Office of Insurance Regulation (OIR) suspended Atlantic Coast Life Insurance Company’s certificate of authority effective Oct. 1, 2026. The order bars the insurer from soliciting or accepting new or renewal Florida business, but OIR says it must continue servicing existing Florida policies and honor its liabilities for losses and unearned premiums.
What did Florida suspend, and why?
OIR’s Oct. 1, 2026, industry notice says it issued an Immediate Final Order suspending Atlantic Coast Life’s Florida certificate of authority (COA). The agency said it found the insurer impaired and cited South Carolina’s initiation of rehabilitation proceedings and petition to place Atlantic Coast and a subsidiary into receivership for rehabilitation. Atlantic Coast is domiciled in South Carolina, its domestic regulator’s state.
OIR cited Florida Statute 624.418, which provides for immediate suspension in specified circumstances, including an impairment or insolvency finding or delinquency proceedings initiated by another state’s insurance supervisor. Can Atlantic Coast Life still sell or renew policies in Florida?
No. Under OIR’s notice, Atlantic Coast must stop acting or holding itself out as an insurer in Florida and stop soliciting or accepting new or renewal Florida business. The suspension concerns its authority to conduct insurance business in Florida; it is distinct from the South Carolina rehabilitation proceeding.

Are existing Atlantic Coast Life policies canceled?
The OIR notice does not say existing Florida policies are automatically canceled. It says Atlantic Coast must continue servicing all Florida in-force policies and honor liabilities for losses and unearned premiums for as long as those liabilities exist. The notice also requires statutory filings to continue until the company certifies, and OIR confirms, that Florida claims, liabilities and obligations have been paid or settled.
That servicing requirement is not a guarantee about the timing or outcome of an individual claim, nor does it determine what a particular policy covers. Review your policy and follow current instructions from the company and regulators for questions about your contract.

What does impaired surplus mean for policyholders?
Surplus is an insurer’s financial cushion after accounting for liabilities. Reported surplus and impaired surplus are not interchangeable here: according to Insurance Journal’s Oct. 1 account of the Florida order, statutory limits on investments in subsidiaries and affiliates affected OIR’s impairment calculation.

How many Florida contracts are involved?
Insurance Journal reported that OIR counted 6,001 annuity policies, 986 life policies and 19 accident and health policies in Florida as of August 2026. It also reported nearly $13 million in total Florida premiums collected year to date at the time of the order. Contract counts are not necessarily counts of unique people, and these numbers do not establish a specific recovery through any guaranty association.
What has Atlantic Coast Life said?
As reproduced by Insurance Journal, the company said it disagreed with Florida OIR’s action and intended to work in good faith to resolve the matter. It also said it remained focused on policyholder obligations and on capital-raising and corporate-restructuring initiatives. Those are the company’s stated position and plans, not an independent assessment of its ability to meet obligations or complete restructuring.

What should Atlantic Coast Life policyholders do now?
- Keep your policy and recent statements available, and use the insurer’s current official contact channels or regulator instructions for account-specific questions.
- Check for updated notices from Florida OIR and the South Carolina Department of Insurance. The South Carolina rehabilitation process and Florida order may be subject to further action.
- Do not assume you should cancel, surrender, replace a policy or stop making a payment based solely on the Florida suspension. Get current, case-specific guidance before changing a contract or payment arrangement.
Florida OIR’s notice and Insurance Journal’s report are dated Oct. 1, 2026. The later status of the South Carolina court proceeding and any subsequent regulatory instructions are not established here, so consult the regulators’ latest notices before acting.
