Treasury and IRS Propose Rules for the Education Freedom Tax Credit

The proposed section 25F credit could provide up to $1,700 for an individual or $3,400 for a joint return for qualifying cash gifts to eligible scholarship organizations.

Treasury and the IRS proposed rules on October 1, 2026, for a new federal tax credit tied to K–12 scholarships. Starting with qualified contributions made January 1, 2027, eligible taxpayers may claim a nonrefundable credit of up to $1,700, or up to $3,400 for married couples filing jointly. The proposal is not final, and the maximum is not an automatic benefit for every donor.

What is the Education Freedom Tax Credit?

Section 25F of the tax code creates the Federal Scholarship Tax Credit, which the IRS commonly calls the Education Freedom Tax Credit. It is a nonrefundable federal income tax credit for eligible taxpayers who make qualified cash contributions to eligible scholarship-granting organizations (SGOs). The IRS describes it as the first federal tax credit supporting private contributions for K–12 scholarships. The IRS announcement provides the agency’s overview.

Because the credit is nonrefundable, it reduces tax liability but does not, by itself, produce a refund beyond the tax otherwise owed. Whether a particular contribution and taxpayer qualify depends on the statutory and regulatory requirements; the announced maximum is not a promise that a donation will generate a credit dollar for dollar.

When does it start, and what is the status of the rules?

The IRS says taxpayers, states, and SGOs may rely on the proposed regulations for qualified contributions beginning January 1, 2027. Separately, the statute applies to taxable years ending after December 31, 2026. Those are distinct date formulations: one concerns the proposed-rule reliance date for contributions, the other the statutory applicability of the credit to tax years.

The IRS announcement of October 1, 2026, describes both proposed regulations and companion temporary regulations. The temporary rule, published in the Federal Register on October 2, 2026, takes effect December 1, 2026. It focuses on state elections and SGO certification, reporting, and recordkeeping procedures; it is not the full substantive proposed-rule text. The Federal Register temporary regulation says comments will be considered before final regulations are issued. The rules should therefore be treated as proposed where they are proposed, not as settled final requirements.

Who participates, and how do scholarships work?

Participating states identify eligible SGOs. A state tax-credit organization is not automatically an eligible federal SGO: the organization must separately meet federal requirements and appear on the relevant participating state SGO list. The temporary regulation cautions that a contribution to an organization qualifying for a state credit may not qualify for the federal credit if those federal conditions are not met.

The IRS says donors may contribute to eligible SGOs regardless of their state of residence, subject to the organization and contribution meeting applicable requirements. Scholarships may support eligible elementary and secondary students. The IRS lists possible expenses including tuition, tutoring, special-needs services, books, supplies, computers, and other equipment; the list does not mean every expense or student automatically qualifies.

How much is the credit?

These are maximum amounts stated by the IRS in its October 1, 2026 announcement, not guaranteed credit amounts for a given contribution. The proposed rules also include an ordering rule for some taxpayers eligible for both state and federal credits, and allow unused section 25F credit to be carried forward for up to five years. The exact result for an individual filer depends on applicable requirements and eventual IRS filing instructions.

What do Treasury and the IRS say about participation and impact?

As of the IRS’s October 1, 2026 announcement, 30 states had opted in; the count may change. Treasury and the IRS estimate that approximately 96% of children in participating states would be eligible under the proposed rules and safe harbors. That is an agency estimate, not a measured outcome.

The agencies also project that by 2030 the program could involve 600 to 700 SGOs, more than 11 million taxpayers contributing nearly $26 billion annually, and as many as 2.2 million scholarships per year. They estimate that a proposed operational safe harbor could enable about 450 additional organizations and increase qualified contributions by up to $3 billion annually. These are projections, not results already achieved.

What should a prospective donor check?

  • Confirm the organization is on the participating state’s relevant SGO list; state-credit eligibility alone is not enough.
  • Check that the contribution is cash and otherwise meets the federal qualified-contribution requirements.
  • Keep the organization’s acknowledgment and contribution records, and follow future IRS filing guidance.
  • Do not assume the maximum applies to your circumstances; confirm eligibility under final rules and the instructions for the applicable tax year.

The temporary regulation says taxpayers generally may rely on an organization’s inclusion on the IRS SGO list when contributing. Because detailed eligibility and filing rules remain subject to the regulatory process, the announcement alone cannot determine an individual’s tax result.
