Neither establishes that every Temu listing is dangerous or that every shopper’s data is misused. For shoppers, the practical answer is to assess the specific seller and item, check the reporting options available in the app, and read the privacy terms and permission prompts that apply in their region.
What the federal case says about marketplace safeguards
In September 2025, the Federal Trade Commission announced a $2 million resolution of allegations that Whaleco, Inc., which operates the Temu marketplace, violated the INFORM Consumers Act. The FTC said the complaint alleged that Temu did not provide consumers required information about certain high-volume third-party sellers and did not provide required tools to report suspected stolen, counterfeit, or unsafe goods. The amount is part of the case resolution; it does not measure the prevalence of unsafe products or the number of shoppers harmed. FTC announcement
The FTC described gaps in reporting mechanisms for listings in gamified shopping experiences and for some listings outside those experiences. The Department of Justice reported that a federal court entered a stipulated order resolving the case on September 8, 2025. The complaint’s allegations and the resolution are distinct from a finding that all products on Temu are unsafe. DOJ announcement
The federal case makes seller traceability and accessible reporting reasonable things for shoppers to check. It does not establish a percentage of unsafe Temu listings, a rate of data misuse, or the number of affected shoppers. The cited federal sources do not provide those prevalence figures.

What Temu’s privacy policy says about data
The retrieved Temu privacy policy is localized to the Philippines, so it should not be assumed to match the terms governing U.S. shoppers or users elsewhere. It lists order and transaction information, payment information needed to complete transactions, shipping addresses and recipient contact details, and information supplied for product sizing among the data processed. A policy describing categories of information the service processes is not, by itself, evidence that the information has been misused. The available policy is useful for identifying what data may be involved in shopping, but it does not establish the terms or practices applicable to every region.

What the Arizona lawsuit does—and does not—establish
In December 2025, the Arizona Attorney General announced a lawsuit alleging unlawful data collection and privacy violations, along with deceptive or unfair trade practices involving products and complaint resolution. Those are allegations in a state lawsuit, not findings that a court has determined to be true. The status of the case after the announcement is not established here. How to assess a Temu purchase
- Review the seller details. Before ordering, look for the seller’s identity and the information Temu provides about that seller. The federal enforcement case concerned required seller information, so do not treat a product’s presence on the marketplace as proof that its seller is readily traceable.
- Inspect the listing and its reporting option. Read the specific product description and safety information, and check whether the listing interface gives you a way to report suspicious content. The FTC case covered particular reporting gaps; the interface available to you may differ, so assess the listing you are viewing.
- Read the applicable privacy terms. Use the policy for your country and review the permissions requested by the app on your operating system and version. The Philippines-localized policy is not a substitute for the terms presented to users elsewhere.
- Keep legal claims in perspective. An enforcement action about marketplace processes and allegations in a separate state lawsuit are reasons to pay attention, not proof that a particular item is unsafe or that your data has been misused.
Is Temu safe to use?
The available evidence supports caution, not a blanket verdict. Federal enforcement addressed alleged failures involving seller information and reporting tools; Temu’s published regional policy describes categories of data processing; and Arizona’s claims remain allegations in the cited announcement. None of these sources establishes that every Temu purchase is unsafe or that every shopper’s information has been mishandled. Make the decision at the level of the seller, listing, reporting options, and privacy terms you can actually review.
