AI art and human-made art differ less by a simple label than by who made the expressive choices in the finished work. That distinction can affect how a creator should describe a piece and, depending on jurisdiction and the human contribution, what copyright protection may apply. For a buyer, commissioner, or artist, the useful questions are: what did the person create, what did the model generate, and what rights does the agreement actually cover?
What separates AI art from human-made art?
“Human-made” does not mean analog-only: a person can create a work with digital illustration software or photography. AI use also ranges from a small edit or brainstorming aid to a model generating most of an image. The label alone does not explain the process. A more useful comparison looks at who determined the visible expressive elements and what human work remains in the final piece.

These are descriptive categories, not legal conclusions. In its January 2025 report, the U.S. Copyright Office frames the central distinction as AI enhancing human expression or standing in for it. Register of Copyrights Shira Perlmutter put it this way in a May 2025 Library of Congress Copyright Office interview: “The difference is whether AI is enhancing human expression or is the source of the expressive choices.”
How to compare two works or workflows
When deciding what a piece represents—or explaining it to a customer—look at the process rather than assuming that the label settles the matter.

- Control: Who determined the composition, forms, color, and details visible in the finished image?
- Human contribution: What did the person draw, photograph, select, arrange, or modify, and how much of that work remains perceptible?
- Disclosure: Does the description accurately identify the generated, selected, edited, and human-created portions?
- Rights context: Which jurisdiction matters, what material is being claimed, and which portions are human-authored rather than generated?
- Purpose: What does the creator, commissioner, buyer, or publisher need the work to do, and which process tradeoffs matter to them?
Time spent prompting is not the same thing as control over expressive elements. Conversely, a human-made process does not automatically create copyright in copied material; ordinary originality and other rights questions still apply.
Can you copyright AI art in the United States?
The U.S. Copyright Office’s Copyright and Artificial Intelligence, Part 2: Copyrightability, released January 29, 2025, says that AI assistance does not by itself prevent copyright protection. Copyright may protect original human expression in a work that also contains AI-generated material. Purely AI-generated material, or material for which human control over expressive elements is insufficient, is not protected under the report’s analysis.
The Office says human-authored expression perceptible in the output, creative selection or arrangement, and creative modifications may qualify for protection. Whether they do depends on the actual contributions in the particular work. The report also says that prompts alone do not provide sufficient control under generally available technology; a detailed prompt should not be treated as an automatic claim to copyright authorship.
The Office’s guidance describes copyright as protecting original works fixed in a tangible form, with originality requiring independent creation by a human author and a minimal degree of creativity. Paintings, photographs, and illustrations are among its examples of visual works. These are general U.S. principles, not a ruling on every image; the Copyright Office’s report calls for an analysis of the human contribution in the specific work.

What the U.S. guidance means for a mixed work
A creator may have a claim in human-created portions without owning every generated element as copyrightable expression. For example, a person’s original drawing or creative arrangement may be distinguishable from an AI-generated background. A description of the workflow can help make that distinction clear, but it does not decide the legal result.
How does the answer differ in the UK and EU?
Copyright rules vary by jurisdiction. The UK government’s 2026 Report on Copyright and Artificial Intelligence describes section 9(3) of the Copyright, Designs and Patents Act 1988. For certain computer-generated literary, dramatic, musical, or artistic works, it provides that “the author shall be taken to be the person by whom the arrangements necessary for the creation of the work are undertaken.”
The same report says there is legal uncertainty about how that provision interacts with the originality requirement. It describes the prevailing UK and EU originality test as the author’s own intellectual creation, reflecting free and creative choices and a personal touch; on that basis, it says AI-assisted authorial works are available for copyright. This is a jurisdictional summary, not advice on a particular work or transaction.
Do not carry a U.S. conclusion over to a UK or EU work, or assume that the UK provision resolves all questions about an AI-generated image. A rights claim should identify the applicable jurisdiction and the portions of the work at issue.

Who owns AI-generated art?
There is no safe one-size-fits-all answer. Start by asking what “the work” includes: human-authored expression, generated elements, or both. Then identify the jurisdiction and the actual contributions. Under the U.S. Copyright Office’s 2025 guidance, a person’s copyright claim may cover qualifying human-authored expression, creative selection or arrangement, or modifications—not necessarily purely generated material. The UK government’s 2026 report describes a different statutory provision and uncertainty about how it fits with originality.
For a sale or commission, separate the practical agreement from the copyrightability question. Specify what the client may use, whether the work includes AI-generated material, what human-authored portions are being delivered, and what any license or transfer covers. A contract or credit line cannot turn unprotected material into copyrightable expression, and this article cannot determine ownership of a specific work.
Copyright in outputs is not the same as permission to train a model
Whether copyrighted works may lawfully be used to train an AI model is a separate issue from whether a particular output qualifies for copyright or who owns its human-authored contribution. The U.S. Copyright Office’s January 2025 report addresses output copyrightability; it does not resolve the broader training-data litigation and licensing debate.
Should AI art be labeled?
A clear label helps viewers and clients understand how the work was made, but disclosure and attribution communicate process and credit; they do not determine copyright ownership. An omitted label, by itself, does not establish infringement or ownership either.

Describe only details you know. Useful formulations include:
- “Created with AI-generated background elements; the artist painted and composed the foreground.”
- “Image generated with [tool/model], then selected and digitally edited by [person].”
For a hybrid piece, say which portions were generated and which were drawn, composed, or modified by a person. Name a tool or model when known and relevant. Avoid wording that implies a person painted or drew the entire image if that is not what happened.
In a May 2025 interview, the Library of Congress Copyright Office said it had registered more than a thousand works for which applicants followed its guidance to disclose and disclaim AI-generated material. That is a count reported at the time of the interview, not a current total or a general measure of how often AI-assisted works qualify.

A 2024 convenience survey of 459 artists by Lovato, Zimmerman, Smith, Dodds, and Karson found mixed views. In that sample, 61.87% of participants viewed AI models as a threat to art workers; 44.88% agreed that AI art models were a positive development in art, while 27.02% were neutral on that question. These figures describe respondents’ views—not actual job losses or the opinions of all artists.

On a hypothetical question about a work that mimics an artist’s recognizable style, 39.22% of participants agreed that the user should own the work and derivatives, while 41.39% agreed that the artist whose style was recognizable should own them. The split records competing views in that convenience sample; it is not a statement of law or a consensus on ownership.
The UK government’s 2026 report says 3,465 respondents provided open-text views on consultation question 31, and that a common theme was that creators should share rights or remuneration when AI outputs draw on their creative inputs. This is a count and summary of consultation responses, not a representative public-opinion poll.
These attitude findings do not establish that AI art or human-made art is more creative, valuable, accurate, or emotionally effective. They also do not establish comparative market value or employment impact.
