The TikTok ban appeal described as happening “in September” was argued on September 16, 2024, before the U.S. Court of Appeals for the D.C. Circuit. It was not an upcoming September 2026 hearing. The D.C. Circuit upheld the federal law in December 2024, and the Supreme Court upheld it in January 2025. The current legal question is whether a later U.S. divestiture meets the law’s requirements—not whether the original appeal is still pending.
Which TikTok appeal was scheduled for September?
The phrase referred to consolidated challenges by TikTok, ByteDance, creators and users to the Protecting Americans from Foreign Adversary Controlled Applications Act. The D.C. Circuit heard oral arguments on September 16, 2024. The court date was a hearing in an appeal, not a date when TikTok would automatically be shut down. The docket material records the argument schedule: D.C. Circuit docket material.
Legal coverage can use “appeal” to mean different events: filing a challenge to a lower-court or government action, presenting oral argument, receiving a ruling, asking a higher court to review that ruling, or seeking emergency relief such as a stay. In this case, the September event was oral argument in the D.C. Circuit. TikTok later sought Supreme Court review and emergency relief; those were subsequent proceedings, not another name for the September hearing.
What did the federal law require?
The Act created a ban-or-divestiture regime for certain applications controlled by a foreign adversary. It barred entities from distributing, maintaining or updating covered applications in the United States unless the application underwent a statutory “qualified divestiture.” TikTok and ByteDance were specifically covered. In practical terms, the restrictions could remove TikTok from U.S. distribution and support channels if the statutory conditions were not met. The original effective date was January 19, 2025, 270 days after enactment. The statute allowed the President to grant one 90-day extension if specified conditions were satisfied. A qualifying divestiture had to end foreign-adversary control and prevent a continuing operational relationship with the former foreign-adversary-controlled entity, including cooperation on the recommendation algorithm or data sharing. Why did TikTok challenge the law?
TikTok and ByteDance argued that the statute violated the First Amendment by restricting speech and access to a platform used by millions of Americans. They also contended that the law singled out TikTok and set a divestiture condition that was extraordinarily difficult to satisfy because the recommendation system and software infrastructure were tied to ByteDance. TikTok described the law as an unprecedented censorship measure and sought emergency relief while pursuing Supreme Court review. What did the government argue?
The government defended the statute as a national-security measure aimed at foreign-adversary control, not at suppressing a viewpoint. It cited concerns that ByteDance’s Chinese ownership could expose U.S. user data or enable influence through the recommendation system, and pointed to Chinese law as a basis for concern that companies could be required to assist or cooperate with intelligence work. The government also emphasized that Congress provided a route for continued operation through qualified divestiture. Is TikTok currently banned in the United States?
The law was upheld, but that does not by itself mean a permanent nationwide shutdown took place. The statute permits continued operation through a qualifying divestiture, and the executive branch announced a framework intended to use that route. The White House’s September 2025 order described a proposed U.S. joint venture, with ByteDance retaining less than 20% ownership and U.S.-controlled governance: White House order on the TikTok framework.
Later reporting indicated that the divestiture was completed in January 2026, but the legal consequences remain contested. A March 2026 appellate filing alleged that ByteDance retained ownership or operational involvement in parts of the recommendation algorithm and U.S. business. Those are allegations in litigation, not a final judicial finding that the transaction violated the Act: March 2026 appellate filing. The Supreme Court’s decision resolved the constitutional challenge to the statute; it did not decide whether this later transaction qualified.

Could there be another September TikTok court event?
A separate case or appeal could concern the 2026 ownership arrangement, a state law, privacy or child-safety claims, or another dispute. Those cases should not be conflated with the 2024 federal ban-or-divestiture appeal. The information available here does not verify a September 2026 hearing in the original federal case. What should users, creators and businesses watch?
For practical planning, distinguish a court ruling on the statute from decisions about how the statute is enforced and whether the later transaction complies. Developments that could change the picture include:
- Court filings and rulings: whether a court makes findings about control, algorithm access, data sharing or operational ties under the 2026 arrangement.
- Official enforcement announcements: executive-branch decisions about deadlines, extensions or enforcement affect implementation, but do not repeal or invalidate the statute.
- Distribution and service changes: app-store availability, updates and ongoing operation are practical indicators, but availability alone does not resolve the legal status of the ownership arrangement.
- Business continuity: creators and businesses that rely on TikTok should consider how a restriction on distribution or updates could affect audience access and operations, without treating the 2024 appeal date as a current shutdown deadline.
How to read a headline about a “September appeal”
Check the year, the court and the case. If a story says only that the appeal “will occur in September,” it may be recycling a pre-hearing 2024 headline. The September 16, 2024 D.C. Circuit argument is over; the courts later upheld the statute. Any claim about a new September event should identify the specific proceeding rather than imply that the original appeal remains pending.
