Will Tax Issues Stall Iceland’s Data Center Push?

Iceland’s proposed data-center tax framework creates uncertainty, but available evidence does not show a tax-driven stall. The former investment incentive expired in 2020, while access to additional energy capacity is a clearer constraint.

Probably not on the evidence available. Iceland faces tax uncertainty because a new data-center tax framework has been reported as a proposal rather than confirmed law. But there is no documented evidence that tax rules have already stopped or cancelled data-center projects. A more concrete near-term constraint is access to additional electricity capacity.

What “stall” means in Iceland’s case

A stalled data-center market would normally show project delays, cancellations, or a measurable fall in investment specifically linked to taxation. The available evidence does not establish any of those outcomes. It points instead to an unresolved policy question alongside a physical infrastructure limit.

The four issues that determine the outlook

Issue What is established What it means
Tax certainty Iceland’s 2026–2027 industrial-policy plan was reported as proposing a clear taxation framework for data centers. Enactment, detailed terms, and an effective date have not been confirmed here. Developers may have difficulty modeling long-term returns until the rules are settled.
Existing incentives Act No. 41/2015 on incentives for initial investments expired at the end of June 2020. Incentives granted before expiry remain valid for their agreed periods. New projects cannot be assumed to qualify for the former regime.
Power availability The U.S. International Trade Administration says Iceland’s growth could be temporarily constrained by limited access to additional energy capacity. Even a clear tax regime would not remove a grid or generation bottleneck.
Investment trajectory Statistics Iceland forecast investment to rise 5% in 2025, with much of the increase attributed to data-center investment, then forecast a 4.5% contraction in 2026 because of base effects. Those are forecasts, not proof of a tax-driven slowdown.

Tax policy is unsettled, not shown to be prohibitive

Iceland’s industrial-policy action plan for 2026–2027 was reported as including a proposal for a clear tax framework for data centers. That distinction matters: a proposal signals that policymakers recognize uncertainty, but it does not establish the final tax rate, the taxes covered, eligibility rules, or when any framework would take effect.

Until Iceland publishes operative legislation or official guidance, companies considering a site cannot treat the proposal as a guaranteed incentive or as a confirmed tax increase. Financial models should therefore show more than one tax scenario rather than assume that the proposed framework is already in force.

The former investment-incentive law expired in 2020

Act No. 41/2015, Iceland’s law on incentives for initial investments, expired at the end of June 2020. Projects that had already received incentives did not lose them automatically; their awards remained valid for the periods specified in their agreements.

  • Derogations from taxes and charges;
  • Authorization, in some cases, to fix the income-tax rate for ten years; and
  • Customs and excise exemptions for certain construction materials, machinery, and equipment.

These were features of the former regime, not evidence that the same benefits are available to a new data center today. Treating them as current eligibility would overstate Iceland’s tax support.

Innovation relief is different from a data-center subsidy

Eligible innovation enterprises may be able to deduct 35% of qualifying project expenses, or 25% for large companies, subject to the applicable conditions. This is an innovation measure, not an automatic data-center allowance. A data-center operator would need to establish that it meets the relevant definition and requirements.

PwC has also cited maximum qualifying expense amounts for 2023 and 2024. Those historical caps should not be presented as current limits without updated confirmation. They cannot substitute for a sector-specific tax framework.

Electricity may be the sharper immediate constraint

Iceland is attractive for data centers because it has renewable energy, naturally cool conditions, and a safe operating environment, according to the U.S. International Trade Administration’s country guide. The same guide cautions:

The guide was last published on April 1, 2026. Its warning identifies access to new power capacity as a direct expansion risk, separate from uncertainty over taxation. A project can have an acceptable tax case and still be unable to secure the electricity connection or supply needed for its planned load.

What the investment forecasts do—and do not—show

In July 2025, Statistics Iceland forecast investment growth of 5% — Statistics Iceland, 2025, with much of the increase attributed to data-center investment. It then forecast a 4.5% contraction — Statistics Iceland, 2025, in 2026 because of base effects.

These figures are projections, not realized results. The stated explanation for the 2026 contraction is the comparison with an unusually strong prior period, not taxation. They therefore cannot be used as evidence that tax issues have stalled Iceland’s data-center push.

How to judge a proposed project

For an operator, lender, or public-sector analyst, the practical question is whether a project remains viable under rules that are not yet fully defined. The key checks are:

  1. Confirm the legal regime. Identify whether Iceland has enacted the proposed data-center framework and obtain its effective date and detailed tax treatment.
  2. Separate legacy awards from new eligibility. Verify whether a project has a pre-June-2020 incentive agreement; do not carry the expired Act No. 41/2015 into a new-project model by default.
  3. Test innovation relief independently. Document why the entity qualifies as an eligible innovation enterprise before applying the 35% or 25% deduction.
  4. Secure power evidence. Check available connection capacity and the timing of additional energy supply, since the trade guide identifies this as a possible temporary growth constraint.
  5. Model the forecast correctly. Keep Statistics Iceland’s 2025 and 2026 figures labeled as forecasts and avoid treating the projected 2026 contraction as a tax effect.

Verdict: uncertainty, not a documented tax-driven stall

Iceland’s data-center expansion is not shown to have stopped because of taxes. The country has meaningful locational advantages, while its previous initial-investment incentive law is no longer open to new applications and a replacement or clarifying tax framework was only reported as a proposal. At the same time, limited access to additional energy capacity is an explicitly identified constraint. The best-supported conclusion is that tax uncertainty could complicate investment decisions, but power availability currently offers the clearer evidence of a potential near-term limit.
