U.S. trademark rights are tied to particular goods and services, and an infringement dispute would turn on whether the brands and markets are likely to confuse customers.
What Microsoft’s “X” ownership actually means
A trademark identifies the source of particular goods or services. The United States Patent and Trademark Office (USPTO) explains: “However, you don’t have rights to the word or phrase in general, only to how that word or phrase is used with your specific goods or services.” See the USPTO’s explanation of trademark rights at What is a trademark?
That means a federal registration is not a blanket monopoly over a short word or letter. A registration generally gives its owner nationwide rights for the goods and services listed in the registration. Another business may be able to use the same or a similar mark for unrelated offerings, especially where customers would not expect a common source.
How a potential conflict would be evaluated
The central U.S. question is usually likelihood of confusion: would consumers likely believe that the two businesses are affiliated, sponsored or otherwise connected? The USPTO describes the analysis at Likelihood of confusion.
The marks themselves
Decision-makers compare the wording, logos, sound, appearance and overall commercial impression. A plain letter, a stylized logo and a phrase containing the letter can create different impressions, even when they share an “X.”

The goods and services
Similarity of products, services, distribution channels and customers matters as much as the spelling. Microsoft’s X-related registrations cover specified technology products and services; X Corp.’s platform is a social-networking and advertising service. The relevant question is not whether both businesses use an X, but whether the particular offerings are related closely enough to create likely confusion.
Territory and strength of rights
These points are U.S.-focused. Common-law rights can be limited to the geographic area where a business actually provides its goods or services, while a federal registration can provide nationwide rights for the identified goods and services. Registration status and enforceability can differ in other countries.

What Microsoft’s USPTO record shows
Microsoft’s trademark portfolio includes multiple U.S. registrations for X and Series X marks. In opposition proceeding 91294464, Microsoft challenged an application by Thoth Holdings. The USPTO record lists Microsoft’s registrations, and the opposition was sustained before the proceeding was terminated on January 15, 2025. It does not establish that X Corp. infringes Microsoft’s marks, that a court has ordered X Corp. to change its name, or that Microsoft has sued Musk over the social platform. Why the X Corp. rebrand could still draw scrutiny
Twitter rebranded its service as X in 2023. In a pleading filed December 16, 2025, X Corp. described its continued use of the X name and asserted that it maintains rights in the TWITTER marks. Those statements are positions made in litigation, not an independent court finding. The filing is available at X Corp.’s December 16, 2025 pleading.
A rebrand can create practical trademark risk even when a company believes its legal position is strong. A famous platform using a very short mark may encounter earlier registrations, oppositions, takedown demands or negotiations with owners of related marks. The outcome depends on the exact registrations, the services identified in them, evidence of consumer perception and the parties’ actual branding.

Microsoft’s own brand guidance is not a ruling against X
Microsoft’s published Trademark and Brand Guidelines say that third parties may generally use Microsoft wordmarks truthfully when the use does not confuse the public about affiliation or endorsement. The guidance is Microsoft’s policy, not a judicial decision governing X Corp.’s branding.
Microsoft also tells app publishers, “You need to consult your own trademark counsel about the use of a trademarked name or logo of another company,” in its Microsoft Learn trademark and copyright guidance. That advice illustrates why a registration search and legal clearance are important before adopting a name; it does not predict what a court would decide in a dispute between Microsoft and X Corp.

What would matter if Microsoft challenged X Corp.?

Even identical marks can coexist when the businesses operate in sufficiently unrelated fields. Conversely, marks that are not identical can conflict when their overall impressions and commercial channels are close.
What is known—and what is not
- Microsoft owns multiple U.S. registrations for X-related marks.
- The USPTO record shows Microsoft prevailed in its opposition to Thoth Holdings’ application before that proceeding ended in January 2025.
- No reviewed record establishes a final merits decision that X Corp.’s social-networking brand infringes Microsoft’s marks.
- No reviewed record establishes that Microsoft has filed a trademark lawsuit against Elon Musk or X Corp. over the platform’s name.
- The legal position outside the United States cannot be determined from these U.S. records and guidance alone.
For now, “Microsoft owns the X trademark” is an incomplete description. Microsoft owns particular X-related trademark rights for particular goods and services. Whether those rights create a serious legal problem for X Corp. requires a registration-by-registration and market-by-market likelihood-of-confusion analysis.
