Russia Sentences Meta Executive Andy Stone to Six Years in Absentia Over Wartime Speech Policy

A Russian court convicted Meta communications executive Andy Stone in absentia over a 2022 policy announcement. Here is what he said, what prosecutors alleged and what the sentence means.

On April 22, 2024, a Russian military court sentenced Andy Stone, a U.S. citizen and Meta communications executive, to six years in prison in absentia. The court also barred him from administering websites for four years. Russia’s military appeals court upheld the sentence on July 22, 2024. Stone was not reported to be in Russian custody; Russian reporting said the prison term would take effect if he were detained in or extradited to Russia.

What did Andy Stone say?

The case stemmed from a Meta policy announcement in March 2022, after Russia’s full-scale invasion of Ukraine began on February 24. Stone said Meta would temporarily allow some political expression that ordinarily would violate its rules, including statements such as “death to the Russian invaders.” The announcement also said credible calls for violence against Russian civilians would remain prohibited. Gizmodo’s account of the announcement describes the distinction.

That distinction matters: the policy was not described as unrestricted permission to advocate violence against Russians generally. It concerned certain wartime political speech referring to Russian troops or invaders, while preserving a prohibition on credible calls targeting civilians.

What did Russian authorities allege?

Russian investigators said Stone’s post justified hostile or violent actions against Russian service members taking part in what Moscow calls its “special military operation,” and alleged that it included public calls for terrorist acts intended to kill Russian servicemen. Those are the authorities’ characterizations of the post, not an independent finding that Stone planned or carried out an attack.

Interfax reported that prosecutors asked the court to remove the separate allegation of public calls to commit terrorist acts from the final charges. That means the initial allegations should not be treated as though every one was retained in the case that went to judgment. The court’s reported conviction was for justifying terrorism. What law and penalties were involved?

Russian authorities prosecuted Stone under Article 205.2, Part 2, of the Russian Criminal Code. English descriptions of the provision vary, using terms such as public justification, propaganda, or incitement of terrorism. TASS described the provision as carrying a possible penalty ranging from a fine to five-to-seven years in prison. These are translations and descriptions of Russian law, rather than an official English-language statutory title. TASS’s report on the charge gives the stated penalty range.

The court imposed six years’ imprisonment in absentia and a four-year ban on administering websites or internet resources. The prosecution had sought seven years; the defense sought acquittal, arguing that Stone’s conduct did not meet the offense’s formal elements, according to Interfax.

Was Stone jailed, and what happened on appeal?

No report in the cited coverage says Stone was physically detained in Russia. The proceedings took place in absentia. Russian reporting said the sentence would be served if he were detained in Russia or extradited there. Russian authorities had said he was placed on an international wanted list in February 2023; that claim is reported by TASS. A wanted-list entry does not by itself establish that other countries would arrest or extradite him.

The case reached the Second Western District Military Court after the Prosecutor General’s Office approved and submitted the indictment on March 28, 2024, according to Interfax. Interfax reported that the trial comprised two hearings. On July 22, 2024, a military appeals court rejected the defense appeal and upheld the verdict and sentence, as reported by TASS and Interfax.

How is Stone’s case connected to Meta’s status in Russia?

Stone’s criminal case was against him personally; it was distinct from Russia’s separate action against Meta Platforms. On March 21, 2022, a Moscow court designated Meta an extremist organization, with the ruling focused on Facebook and Instagram. WhatsApp was treated differently in that ruling, described as a communications service rather than a platform for public information distribution. The two legal actions are related background, but the extremist designation was not the sentence in Stone’s case. The later judgment concerned Russia’s interpretation of his communications about Meta’s wartime speech policy.

What the ruling establishes—and what it does not

The ruling establishes that a Russian court convicted Stone under Article 205.2, Part 2, and that the sentence survived appeal. The available accounts do not provide the full text of the judgment or independently establish the court’s interpretation of the exact Russian-language material it considered. Accordingly, “justification of terrorism” should be presented as the Russian court’s legal characterization, not as proof of a terrorist attack or a neutral, universally accepted description of Stone’s statement.

For Stone, the reported practical consequence is potential imprisonment if he comes within Russian jurisdiction or is extradited there. The cited coverage does not establish his present location or whether Russian authorities have taken later enforcement action.
