Asked whether ByteDance had spied on Americans, Chew first said “No.” After Dunn pressed him about reports that the company had monitored specific U.S. citizens, Chew added: “I don’t think that spying is the right way to describe it.” He described the matter as an internal investigation.
That wording became a damaging political sound bite. But the claim that one sentence legally or independently “sealed” TikTok’s fate goes further than the evidence supports. It amplified an existing credibility problem amid broader disputes over ByteDance’s ownership, access to U.S. data, Chinese national-security laws, content influence and prior surveillance allegations.
What exactly did Shou Zi Chew say?
The exchange is recorded in the official House transcript and PDF (hearing record; PDF transcript). Its sequence matters:
- Dunn asked whether ByteDance had spied on American citizens at the direction of the Chinese Communist Party.
- Chew answered “No.”
- Dunn referred to reporting about a ByteDance project allegedly intended to monitor the physical location of particular Americans.
- Dunn asked again whether ByteDance had spied on U.S. citizens.
- Chew replied, “I don’t think that spying is the right way to describe it,” and characterized the matter as an internal investigation.
It is therefore inaccurate to summarize the moment as Chew volunteering, “We don’t spy,” or as an admission that TikTok spied on Americans. He denied the allegation in the first answer and disputed the terminology in the second.

What allegation was Dunn referring to?
Dunn cited an October 2022 Forbes report describing an alleged Beijing-led effort to track individual Americans’ locations. The congressional transcript establishes what Dunn alleged and how Chew responded; it does not independently prove every factual detail in the cited report.
Several questions remain distinct:
- Whether the reported monitoring plan was carried out or merely discussed.
- Who authorized or participated in it, and which corporate entity was responsible.
- Whether the conduct fits the ordinary-language term “spying” or a specific legal definition of surveillance or espionage.
- Whether Chew’s “internal investigation” description was complete and accurate.
Those distinctions matter because data access, surveillance, spying and espionage are not interchangeable terms. Chew’s answer was a characterization, not a definitive legal finding.

Why the wording was so politically damaging
It sounded like a semantic dodge
Lawmakers were seeking a direct answer about whether people had been monitored. By challenging the word “spying,” Chew appeared to debate the label instead of explaining the underlying conduct. To critics, “internal investigation” sounded like a euphemism rather than accountability.
It created an awkward contrast
The initial “No” suggested a clear denial. The later qualification appeared to narrow that denial: perhaps something happened, but “spying” was supposedly the wrong description. That contrast was easy to replay without the surrounding discussion.

It collided with the hearing’s trust problem
Chew was also presenting TikTok as transparent and capable of protecting Americans. A response that seemed unwilling to use ordinary language about surveillance undercut that message, especially before lawmakers who already doubted the company.
It produced a durable sound bite
Short quotations often outlive long explanations. “I don’t think that spying is the right way to describe it” gave opponents a concise example of what they viewed as evasiveness. BGR’s January 15, 2025 article made that rhetorical effect the center of its argument, but its claim that the remark “probably sealed” TikTok’s fate is analysis, not a demonstrated causal finding (BGR article).

The hearing was about much more than one answer
The March 23, 2023 hearing was already combative. Members questioned Chew about:
- ByteDance’s ownership and relationship with TikTok.
- Whether employees in China could access U.S. user data.
- China’s national-intelligence and counterespionage laws.
- Project Texas, TikTok’s proposed structure for securing and governing U.S. data.
- An earlier internal investigation involving journalists.
- Content moderation, recommendation systems and possible government influence.
- Whether promised safeguards were operating in practice or remained commitments.
Chew emphasized firewalls for U.S. data, protections for teenagers, independent monitoring and resistance to government manipulation. Members often responded that proposed safeguards did not resolve the ownership and access questions. The full exchange and surrounding testimony are available in the official hearing record.

Did the remark actually determine TikTok’s fate?
No available evidence shows that Chew’s sentence independently changed a vote, caused a statute to pass or supplied the sole legal basis for action against TikTok. The stronger conclusion is that it was symbolically damaging while its direct causal effect remains unproven.
Congressional pressure reflected a much wider policy case. In a later Congressional Record statement, Dunn cited categories including browsing history, keystroke patterns, biometric identifiers, draft messages, metadata and geolocation data while arguing that TikTok and ByteDance posed a national-security threat (Congressional Record). That argument demonstrates how far the policy debate extended beyond the wording of a single hearing answer.

How to interpret “internal investigation”
Chew’s phrase appears to refer to the alleged effort involving journalists or specific individuals. The transcript records his characterization but does not establish whether the investigation was complete, who conducted it, what it found or whether the conduct violated a law.
That uncertainty does not make the answer politically harmless. In ordinary conversation, saying that alleged tracking was “an internal investigation” can sound like an attempt to replace a troubling description with a corporate one. The rhetorical problem was the gap between the public’s question—were people monitored?—and the executive’s chosen terminology.

What it gets right
- The remark was unusually easy for critics to quote.
- It reinforced an existing impression that TikTok was evasive about surveillance and data access.
- It arrived at a politically sensitive moment, after years of bipartisan suspicion.
What it gets wrong if read literally
- It implies a single-cause explanation for a complex legislative and regulatory campaign.
- It turns a January 15, 2025 forecast about an approaching U.S. deadline into a settled historical conclusion.
- It blurs the difference between a damaging public-relations moment and the legal steps that determine policy.
The fairest reading is that Chew’s answer became a symbol of TikTok’s credibility problem. It may have worsened the company’s public-relations position and helped crystallize distrust, but the available record does not show that it alone determined what happened next.
