What investigators were reportedly examining
Switching away from Nvidia
One reported question was whether Nvidia made it difficult for customers to move to other AI-chip suppliers. Nvidia’s influence extends across accelerators, software, systems, networking and developer tools. That integrated ecosystem may raise switching costs, but ecosystem strength or customer preference alone is not proof of unlawful monopolization.
Purchasing non-Nvidia chips
Investigators were also reportedly examining whether Nvidia penalized, restricted or otherwise disadvantaged customers that bought competing chips instead of purchasing exclusively from Nvidia. Why Nvidia’s market position drew scrutiny
Nvidia supplies widely used AI accelerators and the software stack that helps developers and data-center operators deploy them. Hardware, programming tools, networking and complete systems can reinforce one another and make migration costly or technically difficult. Antitrust law does not prohibit a company from winning through better performance, investment, scale or integration. The legal question would be whether Nvidia possessed relevant market power and used exclusionary conduct rather than simply competing successfully.
What a DOJ case would generally need to show

- December 20, 2024: The Commission approved the acquisition unconditionally in its decision and related press release.
That decision addressed the notified concentration under EU merger rules. It was not a blanket clearance of Nvidia’s business practices and did not decide separate U.S. questions about customer switching or purchasing conditions.
How other regulators fit into the story
The DOJ inquiry appeared amid broader scrutiny of AI markets and technology partnerships. The Federal Trade Commission sought information from major technology companies about AI investments and partnerships. The U.K. Competition and Markets Authority examined Microsoft’s relationship with Inflection, while European authorities reviewed AI-related transactions and market behavior.
