AI washing is the practice of making a product, company, investment, or service appear more capable, autonomous, accurate, or extensively powered by artificial intelligence than the evidence supports. A résumé tool that calls fixed templates “proprietary AI,” an “autonomous” agent that needs constant human approval, or a company claiming AI drove revenue growth without showing its contribution can all fit the description.
The term is descriptive, not automatically a legal finding. The practical question is whether the wording gives consumers, investors, or business buyers a materially misleading picture of what the system does, how well it works, and who is responsible when it fails.
What “washing” means in AI marketing
“Washing” describes presenting an organization or product as more advanced, responsible, sustainable, or technically capable than it really is. AI washing is analogous to greenwashing, but it is not a separate, universally codified offense.
The clearest case is falsely claiming that a product uses AI. More often, the technology exists but the description creates a misleading impression about its scale, originality, autonomy, accuracy, or business impact. A narrow machine-learning feature may be advertised as the core of a product; a chatbot may be called an autonomous “AI employee”; or a pilot may be presented as a production system.

A third-party model, human review, or a small feature does not by itself make an AI claim false. The issue is whether the seller accurately describes its role, the system’s limits, and the evidence behind the claim.
Common forms of AI washing
False AI presence
A company says a product uses AI when it primarily relies on rules, templates, conventional software, analytics, or human labor. For example, a résumé service might advertise proprietary AI while outsourced editors and fixed templates produce the work.
Capability and autonomy inflation
A system may use AI but be marketed as doing more than it can. Claims such as “understands every customer conversation,” “eliminates hallucinations,” “replaces experts,” or “makes decisions without human intervention” require evidence. A tool that drafts or ranks options is not necessarily a decision-maker.
These descriptions are useful distinctions, not legal categories:
- Assistive AI: proposes, summarizes, drafts, or ranks.
- Automated AI: performs a defined task under programmed conditions.
- Decision-support AI: informs a human decision.
- Decision-making AI: determines an outcome with little or no human intervention.
- Agentic AI: plans or executes multiple actions with tools in a defined environment.
“Agent” is not a standardized legal term. A product’s permissions, approval steps, and supervision matter more than the label.

Accuracy inflation
An impressive percentage is weak evidence without the test population, task, baseline, false-positive and false-negative rates, representative data, independent verification, model version, and test date. In 2025, the FTC challenged Workado’s advertised 98% AI-detection accuracy after alleging independent testing showed approximately 53% accuracy on general-purpose content. The agency announced a proposed action in April and a final-order announcement in August: FTC April 2025 announcement and FTC August 2025 final-order announcement.
Scale and deployment inflation
“Our business runs on AI” may mean a small pilot, one department, or an internal experiment. Ask how many users interact with it, what percentage of transactions involve it, whether customers can access it, how long it has operated, and what measurable result it produced.
Proprietary-technology inflation
Integrating a commercial model or API can be legitimate AI use. It becomes misleading when a company implies that it trained the underlying model, owns it, or controls its behavior when it does not. A complete description should separate the vendor’s interface, prompts, retrieval system, workflow, human review, cloud provider, and foundation model.

“AI increased sales by 40%” may actually reflect pricing changes, a larger sales team, seasonality, or broader marketing. A credible outcome claim explains the baseline, measurement period, comparison group, and how AI’s contribution was isolated.
Risk and governance inflation
Calling a product “responsible,” “safe,” or “compliant” is not proof of any of those things. A meaningful claim identifies assessed risks, applicable standards or laws, controls, accountable owners, monitoring, and failure procedures. NIST describes its AI Risk Management Framework as a voluntary framework for incorporating trustworthiness into AI design, development, use, and evaluation; it is not a certification or blanket legal safe harbor: NIST AI RMF.

How to test an AI claim
Buyers do not need source code. They need a precise, testable account of the product.
- What is the system? Ask whether it is machine learning, generative AI, search, analytics, rules-based automation, or a hybrid; whether it is built in-house or supplied by another provider; and whether the “AI” is a model, application, interface, or workflow.
- Where is AI used? Look for the specific function: classification, prediction, recommendation, generation, recognition, retrieval, fraud detection, routing, or support.
- What does it do and not do? “Classifies support tickets into 12 categories and suggests a queue” is testable. “AI-powered” is not.
- What evidence supports the claim? Request methodology, representative data, a meaningful baseline, error rates, subgroup performance where relevant, production results, version, and date.
- What happens when it is wrong? Check for human review, overrides, escalation, logs, correction or refund procedures, customer notification, privacy controls, and monitoring for degradation.
AI washing versus ordinary marketing language
These facts alone do not establish deception:
- The product uses a third-party model.
- The AI is narrow or only one component of a larger service.
- Humans review or correct outputs.
- The company uses a broad term such as “intelligent automation” while accurately explaining the function.
- The company does not publish every technical detail.
Concern rises when there is no explanation of what AI does, an untestable claim, a precision figure without conditions, a pilot described as full deployment, testimonials substituted for performance data, or a disclaimer that quietly contradicts a prominent headline.

Vague praise such as “the smartest platform” is usually puffery. “Detects AI-generated text with 98% accuracy” is a specific performance claim that ordinarily needs substantiation. Whether wording is unlawful depends on its context, audience, materiality, jurisdiction, and evidence.
Is AI washing illegal?
AI washing can be unlawful when an applicable rule prohibits deceptive, unsupported, unfair, fraudulent, or materially misleading conduct. The label itself does not determine liability.

SEC Chair Gary Gensler described securities-related AI washing as saying a firm uses a model when it does not, or claiming to use one in a particular way when it does not. He said companies need a reasonable basis for AI claims and should disclose material, company-specific risks. Those statements are guidance from an official, not a new standalone AI-washing statute.

What consumers should check before paying
- What exact task does the AI perform?
- Is output reviewed, approved, or corrected by a person?
- Are tests independent, representative, and tied to the current version?
- What known limitations and error rates are disclosed?
- What data is collected, retained, or used for training?
- Which outside model or cloud provider is involved?
- Is the performance claim dated and geographically limited?
- What happens after an incorrect result: correction, appeal, refund, or human review?
- Are sensitive prompts or files sent to external providers?
- Are you paying for AI capability, human labor, ordinary software, or a bundle?
For health, finance, employment, education, legal, insurance, or safety tools, ask who is accountable, whether the system is validated for your population, whether results are reviewable, and whether real-world deployment supports the claim rather than a laboratory benchmark alone.

What investors should look for
Compare AI language with operating evidence:
- Capital expenditure, technical staffing, and model or cloud costs.
- Revenue, customer adoption, retention, and usage attributed to AI products.
- Production deployment rather than pilots and announced future plans.
- Reliance on one model or cloud supplier and related concentration risk.
- AI-related operational, legal, competitive, cybersecurity, privacy, and reputational risks in filings and earnings calls.
- Whether claimed outcomes distinguish AI’s contribution from other business changes.
A credible disclosure explains where AI is used, whether it is internally developed or externally supplied, and the company-specific consequences if it fails. Generic “AI will transform our business” language without measurable operating implications deserves skepticism.

Build a claim inventory
Record every external AI statement in product pages, investor presentations, earnings calls, releases, sales material, app listings, contracts, case studies, and social media. For each claim, keep its exact wording, owner, product version, evidence, verification date, geographic and customer limits, and required qualification.
Use precise language
Prefer “uses a large language model to draft first-pass responses,” “classifies support tickets and suggests routing,” or “generates a summary for human review.” Avoid unsupported promises such as “hallucination-free,” “fully autonomous,” “100% accurate,” “replaces experts,” “guaranteed results,” or “compliant with every AI law.”
Match evidence to scope
Evidence must cover the claim’s breadth. A benchmark on English product reviews does not prove performance across all customer messages. A pilot does not prove enterprise-wide impact, and an average accuracy figure can hide poor performance on difficult or minority cases.

Separate three kinds of claim
- Capability: what the system can do.
- Outcome: what business result it produced.
- Compliance: whether legal or regulatory obligations are met.
A genuine capability does not guarantee a business outcome, and governance controls do not automatically establish legal compliance.
Review after launch
Claims can become inaccurate when a model, supplier, terms of service, data distribution, user behavior, product scope, or law changes. Recheck them periodically and when a feature moves from pilot to production.
AI governance software is not a cure
Governance platforms can inventory models and agents, assign owners, manage assessments and approvals, preserve evidence, and support monitoring. They cannot make an unsupported marketing claim true or replace technical testing, legal judgment, product documentation, or executive accountability.
Enterprise options include OneTrust AI Governance, which describes inventories, assessments, approvals, documentation, monitoring, and controls; Credo AI, which focuses on inventories, policy enforcement, risk management, and regulatory frameworks; and Trustible, which offers responsible-AI inventories and risk mitigation. Their pricing is generally custom or sales-led rather than a published universal rate. The free NIST AI RMF can provide a starting structure using internal processes and existing tools, but it does not supply automated discovery, runtime enforcement, or continuous monitoring.
The practical test
The question is not whether a product contains any AI somewhere in its stack. Ask whether its description gives a reasonable buyer or investor an accurate picture of the system’s function, scope, performance, dependencies, limitations, and accountability. A narrow, human-supervised system can be genuine AI. A sophisticated-sounding claim without evidence can be AI washing.
Frequently Asked Questions
Is using a third-party AI model AI washing?
No. A product can legitimately use a third-party model. The misleading act is implying that the vendor trained, owns, or fully controls that model when it does not, or overstating what the integrated service can do.
Does human review mean a product is not really AI?
No. Human review can be a legitimate safety control. The concern is describing a heavily supervised workflow as fully autonomous or as replacing human judgment.
Are all exaggerated AI claims illegal?
No. Vague puffery is different from a specific unsupported performance or investment claim. Liability depends on the wording, evidence, audience, materiality, jurisdiction, and applicable law.
