Short answer: The FCC investigation is real, but it began on February 11, 2025—not in 2026. FCC Chairman Brendan Carr directed the Enforcement Bureau to examine diversity, equity and inclusion (DEI) practices at Comcast and NBCUniversal. Comcast confirmed the inquiry and said it would cooperate. The public record available through August 18, 2026, does not establish a final FCC finding, penalty, license revocation or formal closure.
What happened and when?
Carr’s February 11, 2025 letter to Comcast CEO Brian Roberts directed the FCC Enforcement Bureau to investigate Comcast and NBCUniversal. The companies received a request for information about their DEI-related activities. Comcast publicly confirmed the inquiry on February 12 and said it would cooperate.
FCC Commissioner Geoffrey Starks issued a statement that same day questioning whether the agency’s action was within its jurisdiction and asking for a briefing on the legal authority and theory behind the inquiry. Comcast and NBCUniversal later submitted a written response dated March 7, 2025. A redacted copy was released through a FOIA-related production in 2026.

What did the FCC ask Comcast to provide?
Carr’s request sought an accounting of Comcast and NBCUniversal’s DEI “initiatives, preferences, mandates, policies, programs, and activities.” It also sought information about practices that might have been renamed or rebranded.

The scope described in the released materials covered activities involving employees, content, suppliers and corporate operations. Because the Comcast response contains substantial redactions, missing passages should not be reconstructed or treated as proof of particular programs or changes.
Why did Carr say the FCC was investigating?
Carr said he was concerned that Comcast and NBCUniversal could be promoting what he called “invidious forms” of DEI that might conflict with FCC regulations or civil-rights laws. He pointed to public statements presenting DEI as a corporate value and to policies promoted across businesses that include cable, broadband, broadcast television and wireless services. Those characterizations are Carr’s stated rationale, not an established finding that Comcast operated unlawful quotas or discriminatory employment programs. How Comcast responded
Comcast said it would cooperate and maintained that Comcast and NBCUniversal comply with applicable civil-rights laws and FCC regulations. The company described hiring and promotion as merit-based while seeking a workplace where employees are respected and have equal opportunities.

The March 7 response also said the companies collected employee-demographic information voluntarily to comply with certain state laws and federal requirements, including FCC equal-employment-opportunity rules. The released document is redacted, so the visible text does not support claims that Comcast ended, redesigned or admitted wrongdoing in specific DEI programs.

What legal authority could the FCC rely on?
Broadcast equal-employment rules
The FCC has longstanding equal-employment-opportunity requirements for broadcast licensees. They address nondiscriminatory employment practices and recruitment efforts. These rules do not automatically resolve whether the FCC can review every employment policy maintained by a diversified parent company.
Cable equal-employment provisions
Section 554 of Title 47 requires rules promoting equal employment opportunities for women and minorities in specified cable-operator job categories. The statutory text is available at 47 U.S.C. § 554.

General civil-rights law
Under employment-discrimination law, legality depends on what an employer actually does, not simply whether it uses the label “DEI.” Employment decisions based on race, sex or another protected characteristic can violate Title VII and other laws. Outreach, recruitment, mentoring and inclusion efforts are not automatically unlawful, although their design and implementation matter. The Equal Employment Opportunity Commission’s guidance explains when DEI-related practices may create discrimination risk.
Why jurisdiction became a dispute
Comcast’s corporate group includes regulated broadcast and cable operations as well as businesses subject to other rules. That creates a central legal question: is the FCC examining practices at FCC-regulated licensees and cable operations, or attempting to review corporate-wide employment policies across all Comcast businesses?

What “DEI” means in this investigation
“DEI” is an umbrella term, not a legal conclusion. Diversity initiatives, affirmative-action programs, equal-employment compliance, content diversity, recruitment outreach and employment preferences can involve different facts and legal standards. Calling a policy DEI does not establish that it uses a quota or violates civil-rights law. Conversely, a program’s label cannot shield an employment decision that unlawfully relies on a protected characteristic.

The safest current description is that the FCC opened the inquiry, Comcast and NBCUniversal responded, and no final public disposition has been established in the sources reviewed through August 18, 2026. Do not describe Comcast as having been found guilty, fined, forced to end DEI programs or stripped of broadcast licenses.
The absence of a documented final order is not proof that no internal agency work occurred. It means only that a final finding, penalty, license action or formal closure has not been demonstrated by the available public record. An FCC statement or commissioner release is also not necessarily a formal Commission action; Starks’ statement notes that release of the full text of a Commission order is the relevant marker for official action.

What could happen next?
Possible procedural paths include:
- No further public action after agency review.
- Additional information requests to Comcast, NBCUniversal or particular regulated entities.
- Negotiated assurances or changes without an adjudicated violation.
- A formal enforcement step, such as a notice of apparent liability or another Commission order.
- Litigation over whether the FCC’s authority reaches the practices at issue.
None of these possibilities should be presented as a prediction. An investigation seeks information; it does not itself prove that a law was broken.
Bottom line for readers
The headline “FCC to investigate Comcast for having DEI programs” is outdated and overly broad. The precise account is that, on February 11, 2025, Carr opened an Enforcement Bureau investigation into Comcast and NBCUniversal’s DEI-related practices. The request covered a wide range of policies and activities, Comcast said it would cooperate and denied noncompliance, and Starks questioned the FCC’s jurisdiction. As of August 18, 2026, the public record reviewed here does not establish a final violation, penalty, license revocation or closure.
