The Pentagon directed a supply-chain-risk designation for Anthropic on February 27, 2026, after talks over military use of Claude broke down. Anthropic said it received the formal Department of War designation letter on March 4 and announced the next day that it would challenge the action in court. The dispute centers on the company’s refusal to authorize mass domestic surveillance of Americans and fully autonomous weapons, not on a blanket shutdown of Claude for every customer.
What happened, and when
- February 26: Anthropic CEO Dario Amodei said the Department of War had threatened to remove Anthropic from its systems, designate it a supply-chain risk and potentially invoke the Defense Production Act if the company kept its safeguards. Anthropic’s statement described the threatened measures as contradictory: treating the company as a security risk while suggesting its technology was important enough to compel continued support.
- February 27: Secretary Pete Hegseth said he was directing the Department of War to designate Anthropic a supply-chain risk. TechCrunch also reported that President Trump directed federal agencies to stop using Anthropic technology, with a phase-out period. Anthropic said it supported lawful national-security work outside its two disputed exceptions and would contest any designation. - March 4–5: Anthropic said it received the formal designation letter on March 4 and disclosed that development on March 5. That letter is a separate milestone from the February instruction to begin the process. Anthropic’s March 5 account is the available public description of the formal notice.
The available public material does not include the Department of War letter itself or a definitive government legal interpretation of its scope.
The two red lines behind the confrontation
Fully autonomous weapons
Anthropic says current frontier models are not reliable enough to make lethal decisions without meaningful human control. It has therefore refused to authorize fully autonomous weapons use.
Mass domestic surveillance
The company also rejects mass surveillance of Americans, which it says would conflict with fundamental rights. Anthropic maintains that these limits have not prevented government missions from using Claude to date. Its February 27 statement says its models have supported U.S. warfighters since June 2024. The administration’s stated condition, as described in available reporting and Anthropic’s account, was acceptance of “any lawful use” of the models. The public record available here does not include a complete negotiation transcript or the final contract language.
What “supply-chain risk” can mean in defense procurement
In this setting, the phrase is more than a reputational label. A designation can affect whether software or services may appear in Department of War contract deliverables, how primes assess suppliers, what mitigation plans are required, and whether subcontractors can use a vendor for a particular program.
Anthropic argues that 10 U.S.C. § 3252 is narrower than the public rhetoric surrounding the announcement. On the company’s interpretation, restrictions can attach to Claude when it is used in Department of War contract performance, but the statute does not automatically prohibit every commercial relationship between Anthropic and every company that does business with the military. That is Anthropic’s legal position, not a court ruling or an acknowledged government interpretation.

Anthropic says access through its API, claude.ai and its products continues, and that individual and commercial customers are unaffected. Those statements are customer guidance, not a final adjudication. Contract clauses, implementation instructions and litigation could change the practical result.

Anthropic’s role in military systems before the dispute
Anthropic says it was the first frontier-AI company to deploy models in U.S. government classified networks and at national laboratories. It also says it supplied custom models for national-security customers and supported intelligence analysis, modeling and simulation, operational planning and cyber operations. These are company claims, not independently verified findings in the public material available for this article. Amodei’s February 26 statement sets out those claims.
That history explains why a forced transition could be operationally significant even if commercial Claude access continues. Classified deployments may involve separate authorizations, testing, logging and infrastructure that cannot be replicated immediately by a substitute model.

What defense contractors should check now
- Inventory use: Identify Claude in deliverables, software stacks, internal workflows, cloud marketplaces and subcontractor services.
- Map the contract: Determine whether the use supports Department of War contract performance, an unrelated commercial engagement or both.
- Review clauses: Check supply-chain, approved-vendor, cybersecurity, data-handling and flow-down provisions.
- Separate environments: Segregate government and commercial accounts, data and logs where shared infrastructure creates ambiguity.
- Assess authorization: Confirm that any replacement model is approved for the required classification and network.
- Plan migration: Test prompts, tool calls, context limits, agent behavior and evaluation results before switching a mission-critical workflow.
- Document continuity: Preserve model versions, system prompts, retrieval settings and performance baselines so a change can be validated.
A prime contractor may impose broader internal restrictions than the statute ultimately requires. Subcontractors should therefore obtain written direction rather than relying only on public statements.
The legal fight and unresolved questions
Anthropic says it will challenge the designation and calls the action legally unsound and unprecedented for an American company. The company says comparable supply-chain-risk actions have historically focused on U.S. adversaries, but that characterization has not been independently established here. Its February 27 statement and March 5 update contain the company’s position.
The eventual case could clarify:
- which court has jurisdiction and whether Anthropic seeks an injunction;
- the precise statutory authority cited for the designation;
- whether the action is a formal regulatory process or an internal contracting determination;
- how far restrictions flow to primes, subcontractors and cloud platforms;
- whether existing classified deployments must be replaced and on what timetable; and
- how a Defense Production Act demand for continued support would coexist with a finding that the supplier presents a supply-chain risk.
Competitive consequences for frontier-AI vendors
The episode gives government procurement leverage a central role in the AI-safety debate. Vendors may face pressure to accept “any lawful use” language, while still trying to preserve restrictions on surveillance, autonomous weapons or other high-risk applications.

TechCrunch reported that OpenAI moved toward a Pentagon agreement after the Anthropic dispute and that Sam Altman said core restrictions on domestic surveillance and autonomous weapons were preserved. Reporting also identified Google and other providers in the broader competition. A translated summary from Seoul Economic Daily described xAI as agreeing to “all lawful uses,” but its exact terms should not be treated as settled without primary documentation. For government buyers, alternatives must be compared on more than model quality:
- availability in classified or otherwise authorized environments;
- acceptable-use restrictions and safety controls;
- data handling and identity-management requirements;
- portability of prompts, tools, agents and evaluations;
- switching costs and validation time;
- vendor concentration and continuity planning; and
- the ability to support a transition without interrupting a mission.
OpenAI’s official site is openai.com. Multi-model platforms include Google Cloud Vertex AI and Amazon Bedrock. Marketplace availability does not itself establish authorization for Department of War work.
What commercial Claude customers should know
Anthropic’s consumer, API and enterprise channels remain available according to the company’s February 27 guidance. Commercial buyers should nevertheless ask whether their use is embedded in a government deliverable, handled by a defense-contractor affiliate or subject to a customer contract with flow-down restrictions. Anthropic’s product information is available at anthropic.com and its API page at anthropic.com/api.
A prudent enterprise plan keeps a second provider available, exports prompts and workflow definitions, and measures any substitute against the existing model before a legal or contractual deadline arrives. Anthropic said it would provide models and engineering support during a transition at nominal cost for as long as necessary and permitted; that is a company commitment, not a government guarantee.
