The report did not establish that any of the companies had intentionally handed sensitive U.S. data to Beijing or committed other wrongdoing.
What Commerce was investigating
This was a national-security and access inquiry, not a routine review of mobile-phone service. Commerce investigators subpoenaed the three state-backed groups and examined whether their U.S. operations could provide pathways to data or communications flows through:
- Cloud and hosting services
- Internet transit, routing and network points of presence
- Data centers and enterprise connectivity
- Equipment maintenance or other infrastructure supplied through U.S. customers and intermediaries
Reuters reported that Commerce had completed risk-based analyses of China Mobile and China Telecom by June 2024; the China Unicom review was less advanced. The inquiry followed a 2020 Justice Department referral involving China Mobile, China Telecom and Alibaba’s U.S. cloud offerings, according to Reuters reporting published by WTAQ.
Commerce’s ICTS authority addresses transactions involving information and communications technology or services that could create an undue or unacceptable risk of sabotage, subversion, espionage, data theft or disruption. That authority can examine a service’s ownership, technical access and control even when the service is not a traditional regulated telephone carrier.

Which companies and U.S. affiliates were involved?
The 2024 Commerce review named three large Chinese telecommunications groups:

These parent companies are state-backed, but “state-backed,” “state-owned,” “Chinese” and “CCP-aligned” are not interchangeable legal findings. A U.S.-incorporated affiliate is also not automatically independent from its foreign parent. Ownership, governance, contractual control, remote administration and access to systems are separate questions.
Why cloud and routing access matters
A carrier can lose authorization to provide licensed international telecommunications service and still participate in adjacent markets. Cloud infrastructure, data-center space, private connectivity, internet transit and points of presence may give a provider privileged visibility into traffic, metadata, customer systems or administrative controls.
Data stored in the United States may remain remotely accessible from abroad. Conversely, a company’s presence in a data center or network does not by itself prove that information was transferred to the Chinese government. Investigators would need to assess the actual systems and privileges involved, the location and classification of data, technical separation from the parent company, and the customer or network affected.

What prompted U.S. concern
U.S. officials’ risk theory combines potential technical access with concerns about Chinese state influence and legal obligations. The relevant questions include:
- What systems, routes, facilities or customer data can the provider reach?
- Could Chinese authorities compel assistance under applicable intelligence or cybersecurity laws?
- Are U.S. operations technically and legally separated from the Chinese parent?
- Could access enable collection, remote entry, disruption or transfer of information?
- Would the consequences differ for ordinary commercial traffic, government data, critical infrastructure or sensitive personal information?
The theory of risk is not proof of a breach. Reuters’ June 2024 account, carried by the South China Morning Post, said it found no evidence that the companies had intentionally provided sensitive American data to the Chinese government or committed other wrongdoing.

What happened after the June 2024 report
December 2024: reported action involving China Telecom
Reuters reported that Commerce was moving toward additional restrictions on China Telecom’s U.S. unit over its cloud and internet businesses. The report, available through Investing.com, described a reported government move rather than a publicly documented final Commerce order.

March 21, 2025: FCC opens a broader investigation
The FCC announced an investigation of nine Covered List entities, including China Mobile International USA, China Telecom (Americas) and China Unicom (Americas), and sent letters of inquiry and at least one subpoena. It sought to determine whether the entities were still operating in the United States or treating FCC restrictions as inapplicable to “private” or otherwise unregulated activities. April 24, 2025: House subpoenas
The House Select Committee on the Chinese Communist Party subpoenaed China Mobile, China Telecom and China Unicom after the companies did not answer a bipartisan information request. The committee sought details about data centers, points of presence, cloud services, Chinese Communist Party and military links, and privacy implications. Its announcement is available here.
June 2025: FCC information dispute
An FCC enforcement document said China Mobile had not supplied complete information and documents in response to supplemental requests. The FCC characterized the failure as obstruction of its investigation and continued to question whether the company was operating in the United States despite earlier restrictions. See FCC DA 25-512.

What Commerce could do
Depending on its findings, Commerce could seek mitigation, impose conditions on U.S. operations, restrict particular ICTS transactions, or prohibit specific cloud, routing or data-center activities. It could also coordinate with the FCC, Justice Department, Department of Homeland Security and Congress, or refer matters for additional enforcement.

Those are statutory and policy possibilities, not confirmed outcomes. An ICTS investigation does not automatically mean criminal prosecution, a company-wide shutdown or a finding that espionage occurred. A targeted remedy—such as separating systems, limiting certain customers or data categories, or restricting a facility—could be less disruptive than a blanket prohibition, while a broad ban would be simpler to enforce but more disruptive to competition and connectivity.
What businesses and investors should watch
Customers and network operators
Companies using an affected provider should map where data is stored and routed, identify foreign-parent administrative access, review subcontractors and points of presence, and preserve migration options. Government contractors and critical-infrastructure operators generally face a higher consequence if privileged access or service disruption occurs.
Compliance and vendor-risk teams
- Separate licensed telecom services from cloud, hosting, transit and data-center services in contracts and risk assessments.
- Document encryption, logging, remote-support controls, identity administration and incident-notification duties.
- Check whether an FCC authorization, Covered List designation or Commerce action applies to the exact affiliate, service or transaction.
- Do not treat U.S. data residency alone as proof that foreign-parent access is impossible.
Market and policy implications
Restrictions could reduce perceived national-security exposure but also remove lower-cost connectivity or transit choices, force customer migrations and increase compliance costs. The central policy trade-off is whether precautionary limits are justified before a publicly demonstrated incident, and whether targeted controls can address the risk without unnecessarily eliminating competition.
Bottom line
The Commerce Department’s reported 2024 inquiry asked whether China Mobile, China Telecom and China Unicom could use U.S. cloud, routing and related infrastructure access to create an unacceptable national-security risk. It was not a public finding that the companies stole data. The 2025 FCC and congressional actions extended scrutiny through separate legal mechanisms, while a definitive public Commerce resolution remained unestablished as of August 16, 2026.
