On May 29, 2025, the NAACP asked the Shelby County Health Department and Memphis Light, Gas and Water (MLGW) to stop operations at xAI’s Colossus artificial-intelligence facility in South Memphis—or, at minimum, cite the company and enforce clean-air requirements. The organization alleged that gas turbines supplying the site’s electricity were operating without required air permits. The request was an advocacy demand, not a shutdown order or a final finding that xAI violated the law.
What Colossus is
Colossus is xAI’s large-scale computing facility in South Memphis, Tennessee, used for the company’s AI systems, including Grok-related workloads. Computing equipment requires substantial electricity. During development and expansion, xAI used gas turbines to generate power on or near the project rather than relying solely on the regional grid.
The later legal dispute also involves a separate power plant in Southaven, Mississippi, across the state line. That plant was intended to serve Colossus 2 in the Memphis area. The Memphis data center and the Southaven power plant are therefore related but are not the same physical or regulatory facility.
What the NAACP asked officials to do
The NAACP’s May 29 letter sought an emergency order stopping xAI’s operations completely. Alternatively, it asked officials to issue citations and take enforcement action over alleged clean-air violations. The letter was addressed to the Shelby County Health Department, the local air-pollution regulator, and MLGW commissioners.

The original demand was reported by TechCrunch and is documented in the NAACP letter. It did not name the City of Memphis as the sole decision-maker. MLGW is a public utility, while Shelby County handled the relevant local air-permitting role.
The central turbine and permitting dispute
xAI applied for an air permit covering 15 turbines at the Memphis facility, according to the 2025 coverage. The NAACP alleged that at least 35 turbines had operated without permits. That figure was the organization’s allegation; the available record does not establish it as an adjudicated fact.
The disagreement involves more than counting equipment. Regulators and the company had characterized the turbines as not requiring permits during their initial period of use. The NAACP and allied environmental groups argued that the turbines operated together as a substantial stationary source and therefore required permits and pollution controls. In later federal litigation, plaintiffs also challenged any treatment of the units as temporary or mobile equipment.
Those are separate legal questions:
- Whether the turbines were operating.
- Whether their operation legally required air permits.
- Whether actual emissions exceeded applicable limits.
- What remedy—such as a citation, permit condition, penalty or shutdown—was available.
Evidence that turbines were operating does not, by itself, prove a Clean Air Act violation.

What pollution was alleged
The NAACP’s letter and contemporaneous reporting focused on nitrogen oxides, which contribute to smog, and formaldehyde and other hazardous air pollutants. The organization alleged that emissions could exceed applicable Environmental Protection Agency limits. The later federal complaint likewise alleges Clean Air Act violations and seeks pollution controls, penalties and an order stopping operation of unpermitted turbines. Those statements are claims by plaintiffs, not final findings by a court or agency.
The phrase “dirty data center” is the NAACP’s advocacy description, not a technical classification used by air regulators.
Why environmental justice is part of the dispute
Colossus is near South Memphis’s Boxtown neighborhood and other historically Black communities. The NAACP presented the project as an environmental-justice issue: a large industrial energy operation was being developed near communities that already face significant pollution and health burdens.
The NAACP’s broader data-center report argues that rapid AI construction can outpace public notice and environmental oversight. That context does not establish that xAI caused a particular illness or cancer case, and the available material does not prove that the company is the sole source of pollution in the area. It does show why residents and advocates regarded permitting, emissions and meaningful public participation as urgent issues.

Who had authority
Shelby County Health Department
The department was the local air-pollution regulator addressed by the 2025 letter. In a later permit appeal, the NAACP and Young, Gifted & Green argued that the department improperly treated the project as a new minor source rather than a modification of an existing major pollution source. That is an argument in the appeal, not a settled legal conclusion. See the NAACP appeal announcement.
MLGW
MLGW’s involvement made the controversy broader than a private-company permit fight. Advocates were also questioning how public utility infrastructure and public officials supported a large private AI facility. TechCrunch reported that an MLGW spokesperson said the utility had not yet received the NAACP letter when contacted.
Mississippi regulators and federal courts
Mississippi regulators oversee the later Southaven power plant, while Tennessee authorities oversee the Memphis-side facility. Federal Clean Air Act requirements can apply to both. The shared Memphis-area airshed means pollution does not stop at the state line, but the permitting agencies and legal records are different.

Was Colossus shut down?
The available sources establish that the NAACP demanded a shutdown, but they do not establish that Memphis-area officials granted the request. The subsequent permit appeal, litigation threat, federal complaint and emergency motion show that the dispute continued rather than ending with an immediate shutdown.
As of August 18, 2026, the supplied record does not establish a final judgment, a final ruling on emergency relief or a complete settlement. It also does not establish whether every turbine was later permitted or removed, whether civil penalties were imposed, or whether additional pollution controls were installed.
Why the case matters beyond xAI
The dispute tests whether fast-moving AI infrastructure can expand while meeting air-quality rules and giving nearby residents meaningful notice. It also highlights a policy trade-off: officials may value technology investment and construction activity, while communities demand enforceable pollution limits and a genuine role in decisions affecting their neighborhoods.
The case is especially significant because it combines private data-center development, public utility infrastructure, state-border regulation and federal environmental law. Whether regulators and courts ultimately accept the competing permitting theories will help define how similar AI facilities are powered and overseen.
