Did LegalEagle Sue PayPal Over Honey? What the “Sleeping Leech” Lawsuit Actually Decides

The Honey lawsuit is real, but LegalEagle did not win a final judgment. Learn who filed it, what plaintiffs allege, PayPal’s defenses and what the June 2026 ruling means.

Yes—but “LegalEagle sued PayPal” is shorthand. The proposed class action is In re PayPal Honey Browser Extension Litigation, case 5:24-cv-09470-BLF, filed by Wendover Productions, LLC, and other plaintiffs in federal court. Devin Stone, the lawyer and YouTuber behind LegalEagle, is involved through his law firm, Eagle Team LLP.

The latest major ruling came on June 22, 2026, when Judge Beth Labson Freeman denied PayPal’s motion to dismiss the second amended complaint. That lets the case continue; it does not establish that Honey stole commissions or that PayPal is liable.

What is the lawsuit about?

The complaint alleges that PayPal-owned Honey could replace a creator’s affiliate attribution after the creator had already sent a shopper to a merchant.

The alleged sequence is:

  1. A viewer clicks a creator’s affiliate link.
  2. The viewer reaches a merchant’s website.
  3. The viewer later activates Honey or encounters it during checkout.
  4. Honey allegedly inserts or overwrites tracking information.
  5. The merchant or affiliate network credits Honey instead of the creator.

Affiliate links use tracking parameters, cookies, browser storage and network identifiers to decide which publisher caused a sale. A creator generally earns only if the visit, qualifying purchase and attribution window satisfy the applicable network rules. A later interaction can change who receives credit, depending on the merchant and network.

The plaintiffs characterize the alleged practice as commission diversion and assert fraud or concealment, unfair competition, unjust enrichment and related claims. The operative complaint, rather than online descriptions, controls the precise causes of action and requested remedies.

What does “sleeping leech” mean?

“Sleeping leech” is a colorful description, not a technical term or judicial finding. It refers to software that remains installed or active in a browser and may later affect attribution when a purchase occurs. The phrase should not be read as proof that Honey took every commission or was designed to do so.

Who is suing whom?

Stone announced the case on January 2, 2025, in a LegalEagle video that included an attorney-advertising disclaimer and invited information from potentially affected people. The federal complaint had been filed on December 29, 2024, in the U.S. District Court for the Northern District of California.

Honey searches for coupon codes, applies discounts and offers rewards or cashback. PayPal acquired Honey for approximately $4 billion in 2020. PayPal’s rewards terms identify Honey as one surface through which the rewards program operates: PayPal Rewards terms.

What evidence is behind the allegations?

MegaLag published an investigation on December 21, 2024, describing alleged affiliate-attribution behavior. Reporting, browser observations and controlled tests can provide leads for litigation, but they are not the same as a court finding. Results may differ by merchant, affiliate network, browser, extension version and checkout flow.

The second amended complaint also discusses a “Secret Tab” and alleged responses to affiliate-network restrictions or “stand-down” requests. The plaintiffs contend consumers were not told that Honey could use such a mechanism to divert commissions. Those are allegations described in the pleading, not established facts.

What PayPal argues

PayPal disputes the plaintiffs’ legal theory. Its defenses may include these points:

  • Users knowingly install and activate Honey.
  • Installation, permissions or checkout interaction may authorize the extension’s technical operation.
  • Many affiliate programs use last-click or modified-last-click attribution, under which a later eligible interaction can receive the commission.
  • Plaintiffs must prove actual, transaction-specific commission losses, not merely that Honey could change attribution.
  • Affiliate-network contracts, arbitration provisions, standing, causation and damages may create individual issues that complicate a nationwide class.
  • The functionality may be an accepted or contractually permitted part of shopping and rewards software.

The central consent dispute is narrower than whether users agreed to install an extension. Consent to search for coupons or receive rewards is not automatically consent to replace another publisher’s compensation, while PayPal can argue that the extension’s disclosures and user actions supplied authorization.

What did the June 2026 ruling actually decide?

The ruling decided only that the second amended complaint plausibly alleged enough to proceed past the pleading stage. The court discussed allegations that consumers might authorize Honey’s operation without being informed that a “Secret Tab” could divert affiliate commissions.

It did not decide that:

  • Honey violated the law;
  • PayPal knowingly approved unlawful conduct;
  • every creator lost money;
  • Honey changed attribution in every transaction;
  • the plaintiffs can prove causation or damages; or
  • a class should be certified.

The earlier dismissal matters. Plaintiffs amended their pleading after the November 2025 order; the later denial means the revised allegations were sufficient to continue, not that the court reversed a factual finding or awarded a victory.

What happens next?

Likely next stages include discovery, technical and economic analysis of affiliate tracking, disputes over class certification, renewed dispositive motions, settlement discussions, or trial. None determines the outcome in advance. A proposed class action becomes a class case only if the court later certifies a class under Rule 23.

Why the case matters to creators and consumers

For creators and publishers

  • Preserve affiliate-network reports, click records and conversion data.
  • Review each network’s attribution and overwrite rules.
  • Compare unusual commission changes with merchant, browser and extension conditions.
  • Do not treat a revenue decline alone as proof that Honey caused a loss.

For consumers

Coupon and rewards extensions can interact with referral attribution. Review an extension’s permissions and disclosures, but do not assume that installation proves unlawful conduct or that every Honey user affected a creator’s commission.

For the wider affiliate industry

The litigation could influence how networks define last-click attribution, how checkout-intervening software discloses its behavior, what evidence creators need to prove lost commissions and how courts handle advertising-technology class actions. The underlying conflict is between consumer convenience and the publisher whose link allegedly generated the sale.
