A Kansas customer bought a discounted iPhone 16e from Straight Talk expecting Verizon’s then-applicable 60-day unlocking process to let him move the phone to US Mobile. Verizon later required 60 days of paid service, refused to unlock the device after his one-month purchase, and applied that change to a phone bought before the new rule. In October 2025, a Sedgwick County small-claims judge awarded Patrick Roach $410.40 for the phone, plus court and service costs, under the Kansas Consumer Protection Act.
The judgment was a fact-specific state-law remedy—not a nationwide order requiring Verizon to unlock every similarly situated phone. Verizon’s unlocking rules and the federal framework also changed after Roach’s purchase, so the historical 60-day rule is not a universal statement of the policy in force in August 2026.
The deal Roach thought he bought
Roach, a Kansas resident, purchased an Apple iPhone 16e from Straight Talk on February 28, 2025. Straight Talk is a Verizon-owned prepaid brand within the TracFone family. He bought the discounted phone as a birthday gift for his wife, planned to activate it briefly, and intended to move it to US Mobile after the expected unlock period.
That plan depended on the phone becoming usable with another carrier. An unlocked iPhone can accept a compatible carrier’s SIM or eSIM, but unlocking does not guarantee service: the replacement carrier must support the phone’s network bands and technology. A lock is also separate from an unpaid installment balance, account suspension, fraud hold, or blacklist.

Verizon changed the condition after the purchase
When Roach bought the phone, the relevant Verizon and TracFone framework generally contemplated automatic unlocking after 60 days from activation for qualifying devices. Verizon’s TracFone-related policy changed effective April 1, 2025. The new requirement was 60 days of paid active service, rather than simply 60 days passing after activation.
Roach had paid for one month. Verizon therefore said he did not qualify and declined to unlock the iPhone. The dispute was not merely whether a carrier could refuse an unlock; it was whether Verizon could impose a materially different condition on a device purchased before that condition took effect.
Why a 60-day obligation existed
The historical rule had a regulatory basis as well as a customer-policy component. Verizon’s obligations related to the 700 MHz C Block spectrum restricted handset locking. In 2019, the Federal Communications Commission granted Verizon a partial waiver allowing a 60-day lock on qualifying devices, primarily to address handset fraud.

When the FCC approved Verizon’s acquisition of TracFone, the 60-day arrangement was extended to qualifying TracFone devices. FCC materials explain that devices capable of automatic unlocking, including many Apple phones, were to unlock automatically after 60 days from activation. The conditions applied only to specified devices, frequencies, brands, and regulatory circumstances; they were not a blanket federal promise that every Verizon phone would always unlock after 60 days.

What the Kansas court decided
Roach sued Verizon and Straight Talk in the District Court of Sedgwick County, Kansas. Magistrate Judge Elizabeth Henry ruled in October 2025 that applying the post-purchase requirement effectively changed the nature of the product Roach had bought.

The reported reasoning focused on the Kansas Consumer Protection Act. Roach did not have to prove that Verizon intended to defraud him under the theory the court applied. The practical value of the discounted phone depended on the expected ability to use it with another carrier; imposing an additional paid-service condition after the sale undermined that bargain.
The court did not decide every question about federal communications law or declare Verizon’s broader policy unlawful nationwide. Roach said the judge indicated that the Kansas court would address the dispute through state-law jurisdiction rather than directly enforce FCC regulations.

Roach reportedly rejected a $600 settlement plus court fees because it included a restriction on discussing the case. The offer was reported as not an admission of wrongdoing. He later bought another unlocked phone, returned it, and paid for a second month of Straight Talk service; the original iPhone was then unlocked. The judgment itself was primarily a monetary remedy for the loss of the bargain, not a general order compelling Verizon to unlock other customers’ phones.

Why the case matters to prepaid-phone buyers
Carrier discounts often make sense only if the buyer can leave after the required lock period. A policy change can destroy that calculation by forcing extra service payments, a replacement phone, or both.
- Promotional pricing carries switching risk. The lower upfront price may depend on a lock and a service commitment that must be verified at checkout.
- Dates are legally important. Keep the purchase date, activation date, policy effective date, denial date, and the date the phone actually became eligible.
- Brand names can mislead. A phone may be sold by Straight Talk, TracFone, Total by Verizon, Visible, or another Verizon-network brand, each with potentially different terms.
- Old forum advice can be stale. A statement that “Verizon unlocks after 60 days” may describe an earlier policy, not the rule for a later purchase.
Ars Technica also reported accounts from other Straight Talk customers who said they encountered the paid-service condition, including some who had activated phones before April 1. Those accounts provide context, not independently adjudicated findings.

Verizon’s current support materials divide devices by purchase date. The Verizon Business support page says devices purchased before January 27, 2026 were locked for 60 days from purchase, while a newer policy applies to devices purchased on or after January 27, 2026. Later reporting describes the FCC allowing Verizon to end automatic 60-day unlocking under the older arrangement for newer activations.

That means Roach’s historical situation cannot be converted into a current universal rule. Eligibility now depends on the device’s purchase date, brand and category, activation and service history, account status, and any applicable regulatory exception. Check Verizon’s device-unlocking policy and its current unlock-support page for the instructions that apply to a particular device. What to do if your unlock is denied
Preserve the transaction record
- Save the receipt, order confirmation, device model, and IMEI.
- Record the activation date and every service payment.
- Save the unlocking terms displayed when you bought the phone, including screenshots or an archived copy.
- Keep chat transcripts, emails, denial notices, and the name or reference number for each support interaction.
- Document compatibility with the intended replacement carrier and any extra service, replacement-phone, or other measurable costs.
Request a written explanation
Ask the carrier to identify the exact reason for denial, the policy version and effective date being applied, the brand classification of the device, how it calculated activation and paid active service, and the precise date the phone will become eligible.
Escalate, without assuming a guaranteed remedy
An FCC complaint can prompt a carrier response, but it is not the same as a court judgment and does not automatically produce damages or an agency ruling. Roach said his complaint mainly resulted in an exchange with Verizon rather than substantive FCC intervention.
A state attorney general complaint or small-claims case may be relevant when a customer bought before a material undisclosed change and can show a measurable loss. The outcome will depend on the state’s law, the purchase and activation record, the device, the contract, and the remedy available in that court. Before filing, check the small-claims dollar limit, corporation-service rules, arbitration terms, venue, and whether the court can provide money, an unlock, or both. A Kansas judgment does not automatically bind courts in other states.
Choosing a phone when switching flexibility matters
Buying a factory-unlocked phone directly from Apple can avoid the central carrier-lock risk, although it commonly sacrifices the steep subsidy that attracts prepaid promotions. A discounted carrier phone can still be worthwhile, but verify the exact unlock period, whether continuous paid service is required, which policy version applies to the purchase date, and whether the device is compatible with the network you may use next. Do not rely on a generic 60-day statement.
Roach’s case illustrates a narrow but important principle: a carrier may face consumer-protection liability when it materially changes the terms that gave a discounted device its expected value and applies the new terms to an earlier purchase. It does not establish an automatic refund, a nationwide unlock right, or a guaranteed result for every customer with a similar complaint.
