Trump’s Big Tech and crypto picks: What Gail Slater and Paul Atkins could change

Trump paired a potentially aggressive Big Tech antitrust chief with a more crypto-receptive SEC chair. Here are the powers, limits, dates and trade-offs.

Donald Trump’s December 4, 2024 selections paired a potentially aggressive antitrust chief with a more crypto-receptive Securities and Exchange Commission (SEC) nominee. Gail Slater could shape litigation, merger challenges and remedies involving dominant technology platforms. Paul Atkins could redirect SEC enforcement, rulemaking and guidance for digital assets. Neither official could act alone: courts, statutes, commissioners, career staff, Congress and other regulators set hard limits.

Slater was confirmed by the Senate on March 11, 2025, and DOJ records list her confirmation on March 12. Atkins was nominated on January 20, 2025, confirmed April 9 and sworn in as SEC chair April 21. The appointments therefore signaled selective regulation—not blanket deregulation: tougher competition scrutiny for gatekeepers alongside a potentially lighter, clearer securities regime for crypto.

The two selections, and the timeline

Trump’s original pairing was reported by Techmeme on December 4, 2024. At that point both were nominees, not officeholders. Slater’s agency biography and service dates are documented by the Justice Department; the DOJ page now labels her a former assistant attorney general, so her present status should be checked against the department’s latest records.

What Slater could influence at DOJ

Cases against dominant platforms

The Antitrust Division can investigate monopolization and exclusionary conduct, bring civil cases, prosecute certain cartel offenses, challenge mergers and negotiate or litigate remedies. Under Slater, those tools could affect search and digital advertising, app stores, online marketplaces, social-media acquisitions, cloud services, software and artificial-intelligence infrastructure.

DOJ is not a general technology regulator. It does not decide content-moderation rules or supervise every product decision. Its mandate is competition law: whether conduct or a transaction harms competition under statutes and court precedent.

Inherited litigation and investigations

Slater inherited landmark technology matters rather than receiving a blank slate. The department later described its Antitrust Division leadership as taking over major cases under her tenure (DOJ release). A new assistant attorney general can set priorities, approve pleadings, decide whether to settle and influence remedy demands, but cannot guarantee victory in Google, Apple, Amazon, Meta, Microsoft or AI-related disputes.

Merger review and remedies

The practical questions for companies and investors were whether DOJ would challenge more acquisitions by dominant firms and whether it would seek structural relief, such as divestitures, or behavioral and access restrictions. A breakup is not automatic: the government must prove its case, and a court must approve any contested remedy. A court can find liability while rejecting the government’s preferred remedy.

What Slater’s public record suggested

Slater’s confirmation materials connected economic liberty with personal liberty and argued that concentrated private power can threaten both. She said antitrust law should be enforced “vigorously and fairly,” with attention to statutory text and precedent. In her first major address, she presented an “America First” rationale for vigorous enforcement; later remarks emphasized remedies that open opportunities for smaller technology companies while preserving incentives to innovate (Notre Dame speech; Georgetown Law address).

That is better understood as conservative or pro-market antitrust than as hostility to every large company. Her stated approach could support strong intervention against gatekeepers while claiming fidelity to traditional legal principles. Her confirmation answers on concentration and economic liberty are available in the Senate Judiciary Committee record.

Why crypto businesses watched Atkins

The SEC levers

The SEC chair can influence whether the agency emphasizes enforcement or formal rulemaking, how it classifies token offerings, and its approach to exchanges, brokers, custodians, lending products and disclosure. The chair also helps set positions on exchange-traded products, custody and broker-dealer requirements, exemptions, settlements and coordination with the Commodity Futures Trading Commission, Treasury, banking regulators and Congress.

Atkins’s prior SEC service and later digital-asset work supported the market’s expectation of a more predictable and accommodating posture than the Gary Gensler era. “Crypto-friendly” is shorthand, not a legal exemption: a friendlier SEC could mean clearer registration paths, narrower theories or more reliance on rules rather than case-by-case litigation while still pursuing fraud and unregistered offerings.

The SEC’s official biography records Atkins’s nomination, confirmation, swearing-in and commissioner service (SEC biography). Secondary reporting framed him as a crypto-friendly successor (Techmeme).

What Atkins cannot do alone

  • He cannot rewrite securities statutes or declare every token outside SEC jurisdiction.
  • Notice-and-comment procedures generally apply to binding rules.
  • Courts can reject SEC theories, penalties or remedies.
  • The commission has five presidentially appointed members, with no more than three from one party; the president designates one as chair (SEC structure).
  • Crypto firms may also face commodities, banking, money-transmission, tax, sanctions and consumer-protection requirements.

The policy contrast—and its internal tension

The combination was not simply pro- or anti-regulation. It could pressure companies that act as digital gatekeepers while reducing regulatory friction for digital-asset businesses. That creates a real conflict inside the coalition: aggressive antitrust may resist acquisitions by large platforms, while easier acquisition rules can provide founders and investors with valuable exits and may be defended as pro-innovation. The same administration could therefore challenge a platform’s market power and still permit some transactions that critics call “killer acquisitions.”

How to judge whether the appointments changed policy

  1. Case continuity: Did DOJ maintain, narrow, settle or abandon inherited technology cases?
  2. Remedy strategy: Did it seek divestitures, access obligations, licensing, conduct restrictions or another remedy?
  3. Merger policy: Did enforcement become more permissive toward acquisitions by dominant platforms?
  4. Crypto posture: Did the SEC change litigation positions, enforcement priorities or issue clearer rules?
  5. Interagency alignment: Did SEC policy fit with the CFTC, Treasury, banking regulators and Congress?
  6. Market results: Did entry and competition improve, or did changes mainly benefit incumbents and token issuers?
  7. Legal durability: Did courts uphold the agencies’ theories and remedies?

These tests matter because a nomination is an expectation, not an outcome. Enforcement discretion can move quickly but may be less predictable than a durable rule; formal rules can provide certainty but take longer and remain vulnerable to litigation.

What the appointments meant for different readers

Big Tech companies

Expect case-specific litigation and remedy risk, especially where a platform controls a bottleneck such as search distribution, app access, marketplace visibility, advertising demand or AI infrastructure. Scale alone is not unlawful, and no nominee could predetermine a court’s result.

Startups and founders

More enforcement could improve access to distribution and data, but a tougher merger climate could reduce the number of potential buyers. A startup may gain from an open platform while losing an easier exit.

Crypto businesses

A more receptive SEC could improve clarity and reduce reliance on enforcement-by-surprise, yet registration, custody, disclosure and anti-fraud obligations do not disappear. Other federal and state regulators may still apply.

Investors

Political signals can move prices and expectations, but they are not legal guarantees. Evaluate enacted rules, agency releases, court orders and statutory authority rather than labels such as “anti-Big Tech” or “crypto-friendly.”

Bottom line on the two picks

Trump’s selections pointed in two directions at once: Slater’s record supported vigorous competition enforcement against dominant technology firms, while Atkins’s background supported a less adversarial and potentially clearer SEC approach to digital assets. The durable significance depended on cases, rules, commission votes and court decisions—not on either person’s title alone.
