Google Assistant Privacy Lawsuit: Who Qualifies for the Proposed $68 Million Settlement?

Google agreed to a proposed $68 million settlement over alleged false activations by Google Assistant. Here are the classes, estimated payments, deadlines and legal consequences.

Google agreed to a proposed $68 million class-action settlement over allegations that Google Assistant sometimes activated without a valid wake phrase and captured or handled private conversations. Google denies wrongdoing, and the agreement is not final as of August 18, 2026. To seek payment, an eligible person must submit a claim online or by mail by August 27, 2026. The final-approval hearing is scheduled for October 1, 2026, at 9:00 a.m. Pacific time.

This is a proposed settlement—not a fine, an admission that Google spied on users, or a court finding that Google illegally recorded everyone. The case concerns alleged “false accepts,” in which Assistant allegedly mistook background speech or another sound for “Hey Google” or “OK Google,” and the subsequent handling of audio.

What the lawsuit alleged

In In re Google Assistant Privacy Litigation, Case No. 4:19-cv-04286, in the U.S. District Court for the Northern District of California, plaintiffs alleged that Assistant occasionally activated without an intentional wake-word command. They claimed that audio from those unintended activations was recorded, obtained or processed by Google, and in some instances disclosed to third-party review vendors. Plaintiffs also alleged that information from conversations influenced targeted advertising.

Those are allegations, not established findings. The claims involve audio captured after an alleged false activation; they do not establish that Google continuously transmitted all ambient speech while Assistant was dormant. Google denied the allegations and agreed to settle to avoid the expense, risk and uncertainty of continued litigation. What the $68 million figure means

The $68 million is a gross settlement fund. It is not a $68 million payment to one person and does not guarantee a fixed amount for every claimant. Attorneys may request up to one-third of the fund, plus up to $1.6 million in expenses identified in settlement notice materials. Notice and administration costs, as well as service awards of up to $10,000 for each named plaintiff, may also affect the net amount available to class members.

Published estimates are:

Who may be included

Purchaser Settlement Class

You may fall within this class if you purchased a Google-made device using Google Assistant in the United States or its territories between May 18, 2016, and March 19, 2026. Examples discussed in coverage include Google-made phones and other Assistant-enabled devices, Google Home or Nest speakers and displays, Pixel Buds, Pixelbook devices, and Chromecast with Google TV.

Owning an Android phone or a device compatible with Assistant does not automatically qualify you. Eligibility depends on the settlement’s legal definition and the device being Google-made. Check the definitions in the official settlement FAQ.

Privacy Settlement Class

You may fall within this class if you were a Google Assistant user—or a member of a user’s household—during the same period and your communications were allegedly recorded or otherwise obtained because of a false accept, or disclosed to a third-party review vendor. The privacy class is not limited to the person who bought the device, so a household member may qualify even without owning it.

The settlement is geographically limited as stated in its legal definitions. Anyone who opted out of the earlier certified purchaser class by September 9, 2024 may need to take steps to rejoin this settlement by August 27, 2026. The administrator’s FAQ controls if your circumstances are unusual.

How to file a claim by August 27, 2026

  1. Go to the official settlement site at GoogleAssistantPrivacyLitigation.com/file or use the mailed claim form.
  2. Enter the Unique ID and PIN from your mailed or emailed notice, if you received one. The official FAQ says you may still submit a claim without those codes if you believe you are a settlement-class member.
  3. Provide the information or documentation the form requests, identify the applicable settlement class, and personally sign the form. A parent or legal guardian must complete and sign for a minor.
  4. Submit the online form or mail it so it is postmarked no later than August 27, 2026.

Bulk submissions by claims aggregators are not permitted. Filing is the only way to seek a payment. Use the official claim page and instructions; legitimate administrators do not require a fee to file.

Claim, object, opt out or do nothing?

The deadlines for claims, objections, exclusions and notices of intent to appear are all August 27, 2026. If preserving an individual lawsuit matters to you, review the exclusion instructions and consider legal advice rather than assuming that inaction protects your rights. When could payments arrive?

There is no guaranteed payment date. The court must first decide whether the agreement is fair, reasonable and adequate. The final-approval hearing is set for October 1, 2026, at 9:00 a.m. Pacific time. Even if the court approves the settlement, payments will wait until any appeals are resolved. The hearing date is therefore not a payment date.

Practical privacy lessons

  • A wake-word system can produce false accepts; an activation indicator or history entry does not by itself prove intentional recording.
  • Household privacy matters because people near a device may be affected even when they did not purchase or configure it.
  • Third-party review allegations show why users should examine current voice-history, recording-review and microphone controls for each device and software version.
  • Use product-specific settings and Google’s current privacy documentation rather than assuming one control applies to every Google Assistant device.

How to avoid settlement scams

Use only the official settlement websites: GoogleAssistantPrivacySettlement.com and GoogleAssistantPrivacyLitigation.com. The administrator is A.B. Data, Ltd. Its listed contact details are 1-877-411-4704 and [email protected]. Do not pay anyone to submit a claim, respond to unsolicited payment requests, or provide personal information through an unofficial “claim” site.
