The Senate letter described the intended arrangement
The Senate Judiciary Committee’s May 14 letter characterized the aircraft as a gift to the U.S. government for temporary use as Air Force One. It also said the plane could later be permanently gifted to the Trump Presidential Library Foundation, potentially allowing Trump to continue using it after leaving office. Those are the committee’s descriptions of the proposed arrangement, not findings that the later transfer occurred.
The Pentagon announced acceptance, with more work required
According to Defense News, Pentagon spokesperson Sean Parnell said: “The Secretary of Defense has accepted a Boeing 747 from Qatar in accordance with all federal rules and regulations.” The same statement said the Department of Defense would work on appropriate security measures and functional mission requirements. The Air Force was preparing to award a modification contract, but the details were classified.
The legal paperwork was still incomplete a week later
The Washington Post’s May 28 report is the key qualification to the word “accepted.” It said the two countries’ legal teams had not finalized the transfer agreement and that Qatar wanted written clarification about who initiated the transfer and who would bear responsibility for any later ownership change. An announced acceptance and an executed transfer instrument were therefore separate events.

Could the Qatari 747 become presidential transport?
The administration’s stated plan contemplated using the aircraft for presidential transport only after a security and mission review. That review would have to address capabilities beyond an ordinary commercial or private 747, including protected communications and other presidential-mission systems.
Nothing in the cited material confirms that the aircraft completed that review, received the required modifications, or operated with the president aboard. The Air Force modification effort was described publicly, but its scope, schedule and contract value were not disclosed.

Why the gift raised constitutional and legal questions

What outside legal analysis said
FactCheck.org reported legal analysis distinguishing public and personal receipt: a gift directly to the president would be unlawful, while a gift to the United States government could be lawful; making the aircraft available to the president after his term as part of a library arrangement could create a separate legal problem. That analysis describes competing interpretations, not a court’s resolution of this specific aircraft.
What the Pentagon statement does—and does not—settle
The Pentagon’s assertion that the acceptance complied with federal rules states the administration’s position and the department’s reported action. It does not decide the constitutional question, determine whether a later library transfer would be permissible, or substitute for a completed agreement.

Security and conversion concerns
A presidential aircraft would require secure communications and other mission-specific systems. Senate Resolution 244 raised concerns about counterintelligence, secure networks, missile defense, and the time and expense of retrofitting the aircraft.
