Short answer: The UK Competition and Markets Authority (CMA) designated Google’s general search and search-advertising services as having Strategic Market Status (SMS) on 10 October 2025. Since then, it has imposed three conduct requirements covering publisher content, fair ranking and data portability. SMS is a regulatory gateway—not a finding that Google has broken competition law, an order to break up the company or an immediate change to every user’s search experience.
This article reflects the CMA case position available on 18 August 2026. The investigation remains open, so implementation details and further measures may change.
What the CMA actually designated
The designation applies to Google’s general search services, including related search advertising in the UK. It is not a blanket designation of every Alphabet or Google product.

What Strategic Market Status means
SMS is a status under the Digital Markets, Competition and Consumers Act 2024, which came into force on 1 January 2025. The CMA assesses SMS in relation to a defined digital activity, rather than automatically applying it to an entire company.
For designation, the CMA must find both:
- Substantial and entrenched market power in the activity.
- A position of strategic significance for the UK economy, businesses or consumers.
The assessment is forward-looking over at least five years. It is a different legal test from the older Competition Act concept of “dominance”. Most importantly, SMS itself is not an infringement decision. It gives the CMA a framework for imposing proportionate conduct requirements and considering separate pro-competitive interventions.
Why Google met the CMA’s test
The CMA’s final decision considered market structure, distribution, data, advertising and future competition—not just one market-share number. The full decision is available as a PDF.
Scale and durability
The CMA said more than 90% of UK general-search queries take place on Google. Its final decision also said more than 200,000 UK firms collectively spent over £10 billion on Google search advertising in the preceding year. That figure is attributed to the CMA’s decision and is not a measure of all UK advertising.

Weak substitutes
Bing is a traditional general-search rival but has a much smaller share of UK queries and search advertising. Services such as Amazon compete strongly for particular product searches but are not full substitutes for general search. Social platforms were not considered effective replacements for broad web search.

Distribution and network effects
Default-search and distribution agreements make it harder for rivals to reach users at scale. Google’s large user base generates search data; that data can improve results and commercial targeting, attracting more users and advertisers. Google’s wider ecosystem also controls important access points to search.
Emerging AI competition
The CMA considered ChatGPT and other AI assistants. It found that search-like use remained relatively low compared with Google Search and that the long-term competitive constraint was uncertain. AI products may become stronger alternatives, but the designation did not assume that they already provide equivalent competition.
Requirements now imposed on Google
As of 18 August 2026, the CMA case page records three significant search-related conduct requirements.
1. Publisher controls for AI search
Imposed on 3 June 2026, the publisher requirement requires Google to give publishers effective ways to:
- Prevent specified content from being used to power AI features in Search.
- Opt out of content being used for AI-model fine-tuning.
- Receive clearer attribution and links when content is used in AI-generated results.
- Obtain more information about how their content is used.
The measure is particularly relevant to news organisations and other publishers concerned that AI answers may use their material without equivalent referral traffic. It does not create an automatic payment scheme or a universal licensing fee. It gives publishers control and potentially stronger bargaining power; the commercial outcome depends on implementation, publisher choices and later CMA action.

The CMA gave Google nine months to implement the publisher requirement and required compliance reporting. A roughly March 2027 horizon follows from that nine-month window, but the formal compliance deadline and later reports should be checked on the CMA announcement.
2. Fair ranking and notice of changes
Imposed on 17 June 2026, the fair-ranking requirement says Google must:

- Use objective and non-discriminatory criteria for organic results.
- Apply that principle to search generative-AI features.
- Provide greater transparency about organic ranking.
- Give publishers sufficient notice and information about material changes that could affect them.
- Provide a route to raise concerns about manual actions and material ranking changes that could distort or adversely affect UK markets.
The requirement is about fairness, transparency, notice and complaints. It does not require Google to publish its complete ranking algorithm, guarantee a position, promise traffic or automatically restore a site after a ranking decline. The formal measure is described at gov.uk.
3. Data portability
Also imposed on 17 June 2026, the data-portability requirement puts Google’s search-data portability approach on a firmer legal footing. Potential users include search competitors, AI-search startups, consumer-data services and businesses analysing their own search activity. The policy discussion is set out by the CMA in its January 2026 blog.
Portability does not mean unrestricted access to every Google dataset, user profile or advertising signal. Scope, consent, privacy, security and technical safeguards determine what can actually be transferred or used.
Measures that are still uncertain
In January 2026 the CMA consulted on four areas: publisher content, fair ranking, user choice and data portability. The confirmed June measures cover the first, second and fourth areas. The case page does not list user choice as an imposed requirement.

Consumers
- Possible future choice screens or easier switching between search providers.
- Improved source attribution in AI-generated results.
- More control over whether publisher material is used in specified AI features.
- Potentially stronger competition from rival search and AI-search services.
SMS is not a consumer-facing product update. Visible changes depend on implementation, monitoring and future decisions.
Publishers and SEO teams
Publishers should separate traditional organic rankings from AI-search inclusion and from paid placements. The fair-ranking requirement may improve notice and complaint handling, while the publisher requirement creates controls over specified AI uses. Neither guarantees clicks, rankings, payment or recovery from a traffic loss.
Advertisers and agencies
The designation does not cap Google Ads prices, prohibit advertising or guarantee lower acquisition costs. Its longer-term theory is that rival services and better access to data could improve advertisers’ bargaining position. Paid search remains an auction-based product, distinct from organic ranking and from publisher-content use in AI answers.

Small businesses
Businesses dependent on Google should treat the measures as risk-management developments rather than an immediate replacement for Google. Diversifying discovery, measuring conversions independently and keeping records of major ranking or traffic changes can reduce exposure to a single gateway.
Search and AI startups
Data portability and fairer access conditions could lower some barriers to entry. However, rivals still face differences in scale, distribution, freshness, privacy, citations and advertising economics. Bing, DuckDuckGo, Brave Search, Ecosia and AI-search products are alternatives, not interchangeable copies of Google.
What the designation does not mean
- Not a finding of guilt: SMS is not an antitrust infringement ruling.
- Not a breakup order: The designation does not require Google to sell Chrome, Android or another business.
- Not an immediate default ban: Google defaults have not automatically been prohibited by the designation.
- Not guaranteed traffic: Fair-ranking rules do not promise any site a position, click volume or recovery.
- Not universal publisher payment: Opt-out and attribution rights are not a mandatory licence fee.
- Not global: These requirements concern Google’s UK activities and may not produce the same experience elsewhere.
- Not every Google product: Gemini was outside scope at designation, while AI Overviews and AI Mode were in scope.

Practical checklist for UK businesses and publishers
- Review Google’s publisher controls when they become available and record which options you select.
- Use Google Search Console to preserve baseline data on impressions, clicks, queries and indexing.
- Use Google Analytics or another analytics system to connect search changes to revenue and conversions.
- Document material ranking changes, manual actions, notices and traffic effects.
- Keep independent records rather than relying only on Google’s reporting interface.
- Test diversification through Bing Webmaster Tools and alternative discovery channels.
- Evaluate one paid SEO platform—such as Semrush, Ahrefs or Moz Pro—if recurring competitor and visibility analysis justifies the cost.
- Monitor CMA updates and Google compliance reports; do not treat an SEO tool’s correlation as proof of a legal breach.
What happens next
The CMA will monitor compliance with the three imposed requirements while the case remains open. It may publish implementation information, consult further or consider additional pro-competitive measures. The practical effects will therefore arrive in stages rather than on the designation date.
