Opera Files Competition Complaint Against Microsoft in Brazil Over Windows Browser Choice

Opera’s Brazilian competition complaint targets Edge’s Windows advantages, but a preliminary inquiry is not a finding of wrongdoing or an order to change Windows.

Opera filed a competition complaint against Microsoft with Brazil’s Administrative Council for Economic Defense (CADE) on July 29, 2025, alleging that Windows gives Microsoft Edge an unfair advantage over rival browsers. Opera says Microsoft uses preinstallation, prompts, default-setting behavior and restrictions in Windows S mode to make switching harder. Opera later reported that CADE opened a preliminary inquiry, but the available sources do not establish a finding that Microsoft broke the law or an order requiring it to change Windows.

What Opera filed, and what the complaint is about

Opera publicly announced the filing on July 30, 2025. It is an administrative competition complaint to Brazil’s competition authority, not a conventional lawsuit seeking damages. Opera says the challenged practices are used globally but argues that CADE can examine their effects in Brazil. Opera’s announcement

CADE is the Brazilian authority responsible for investigating possible violations of the country’s economic order. A complaint gives the authority allegations to assess; it does not by itself establish jurisdiction over every claim, prove misconduct, or determine the outcome. CADE’s official site and public consultation portal are starting points for authority information and case records.

What Opera alleges Microsoft does

The allegations below are Opera’s account in its announcement and follow-up, not findings independently established by CADE. Opera is a browser developer competing with Edge, so its claims are consequential but should be weighed as allegations by an interested party.

Edge’s preinstallation and default position

Opera says Edge is the exclusive preinstalled browser and default across Windows devices, and that Microsoft strongly incentivizes major PC manufacturers to preload Edge rather than competing browsers. That is Opera’s characterization; the cited public materials do not establish that every Windows device, edition or manufacturer arrangement is the same. Preinstallation can affect which browser users encounter first, but the complaint’s competitive significance would depend on evidence about distribution arrangements, user behavior and alternatives.

Prompts that discourage switching

Opera describes Windows and Edge messages, banners and other interface prompts as “dark patterns” that discourage people from downloading another browser or make switching more confusing. Examples Opera cites include messages displayed when users search in Edge for a competing browser and notices suggesting there is no need to download one. Whether these are ordinary product guidance or manipulative steering is a question for evidence and assessment, not a settled legal conclusion.

Different meanings of “default”

Opera alleges that certain links continue to open in Edge even after a user selects another default browser. Its examples include PDFs, email links, Windows Search results and links opened from Microsoft applications. A Windows default-browser selection is not necessarily identical to every file-type or protocol association, or to behavior controlled by an individual app or system surface. The technical details matter: a browser may be the default for ordinary web links while a particular application or component opens a link another way.

Windows S mode is a separate case

Opera says S mode devices impose tighter limits: Edge and Bing are preinstalled as defaults, software downloads are restricted to the Microsoft Store, and users cannot change browsers as freely as on standard Windows. S mode is a restricted configuration, not a description of every Windows PC. Its rules and effects should therefore be evaluated separately from the ordinary Windows experience. What Opera wants CADE to do

Opera asked CADE to consider measures intended to make rival browsers easier to distribute and select. These are requested remedies, not changes CADE has ordered.

If adopted, those measures could affect what appears on a new PC and how users choose a browser. The precise scope would depend on any eventual CADE decision; a Brazilian proceeding does not automatically change Windows worldwide.

What CADE has done—and what remains undecided

Opera later said CADE opened a preliminary investigation or administrative inquiry after receiving the complaint. Opera described CADE as considering the allegations within Brazil’s competition-defense system and saying the evidence should be investigated. A preliminary inquiry is a procedural step, not a decision on the merits. The materials cited here do not establish a final liability finding, fine, settlement, or remedy. Nor do they identify a direct Microsoft response to the Brazilian complaint. That leaves the competing account and any supporting evidence from Microsoft unclear; Opera’s allegations should not be reported as adjudicated facts.

For an account beyond Opera’s statement, the key records to look for in CADE’s case search are the docket, procedural orders, submissions from the parties and any later decision. The complaint’s practical significance will depend on what evidence the authority reviews and what procedural step, if any, follows.

Why Brazil matters, and why this is not the EU case

Opera presents Brazil as an important market where users should have meaningful browser choice. The competition question is whether the alleged conduct affects competition in Brazil under Brazilian law. A national proceeding may create pressure independently of other regulatory disputes, but any Brazilian remedy would need its own legal basis and would not automatically apply elsewhere.

Opera’s Brazil complaint is distinct from its European Union action concerning the European Commission’s decision not to designate Edge as a gatekeeper service under the Digital Markets Act (DMA). Commission documents identify the challenge as General Court Case T-357/24, Opera Norway v Commission. The Commission’s 2024 DMA annual report; a 2026 Commission document identifying the case.

The DMA framework includes obligations for designated gatekeepers concerning default settings and browser choice. The Commission’s material on those obligations is available here. The EU dispute concerns gatekeeper designation under that framework; the Brazil complaint asks CADE to assess competition issues under Brazilian law. Neither proceeding decides the other.

What would determine whether the allegations amount to an antitrust problem?

Bundling a browser with an operating system is not, on its own, proof of anticompetitive conduct. A regulator would need to assess the overall conduct, the relevant market and its effects, rather than treat the presence of Edge as a violation by itself.

  • Market power: How much power does Microsoft have in Brazilian desktop operating systems, browser distribution or another relevant market?
  • Competitive effects: Do preinstallation arrangements or prompts materially disadvantage rivals, or do users remain able to find, install and choose alternatives on workable terms?
  • Technical behavior: Which links follow Windows’ default, and which are opened by a separate Microsoft app, file association, protocol or system component?
  • User impact: Is there evidence of reduced choice, higher switching costs, weaker innovation or other consumer harm, rather than simply user frustration?
  • Justification and alternatives: How would Microsoft explain the integration in terms of security, compatibility or user experience, and could those aims be achieved with less effect on rivals?

Evidence about OEM incentives, the frequency and presentation of prompts, the operation of default settings, and effects on Brazilian users would help distinguish competitive foreclosure from product design that users can readily bypass. The public accounts cited here do not resolve those questions or quantify the alleged effects.
