Google’s Chrome Antitrust Fight: What the Closing Arguments Argued—and Why the Sale Was Rejected

The DOJ—not Google—asked the court to force a Chrome sale. Judge Mehta rejected divestiture and imposed behavioral remedies; appellate proceedings continue.

The Justice Department and state plaintiffs—not Google—asked a federal judge to require Google to sell Chrome as a remedy for its unlawful search monopoly. Closing arguments on that proposal took place on May 30, 2025. Judge Amit Mehta later rejected the Chrome divestiture, choosing other remedies instead. The district-court decision is complete; the government is challenging parts of the remedy on appeal, but no verified appellate ruling has ordered Google to sell Chrome.

Which antitrust case was this?

This was United States and Plaintiff States v. Google LLC, a federal case filed in 2020 in the U.S. District Court for the District of Columbia and decided by Judge Amit P. Mehta. It concerned Google’s alleged monopolization of general search services and search advertising—not Google’s advertising-technology business, which is the subject of a separate case filed in 2023.

In August 2024, the court ruled that Google unlawfully maintained monopolies in relevant online-search markets. The later arguments were about the remedy for that violation, not whether Google had violated antitrust law in the first place.   • Liability: whether Google’s conduct violated antitrust law.
  • Remedies: what measures could address the violation, restore competition, and prevent recurrence.
  • Closing arguments: the parties’ final arguments about which remedies the judge should impose.

What did the plaintiffs want the judge to order?

The Justice Department and state plaintiffs proposed a broad package. Its most prominent structural remedy was a forced sale of Chrome. The plaintiffs’ theory was that Chrome was not merely a browser: it was a major route to search, a source of user activity and data, and a distribution channel that could reinforce Google Search’s default position. They argued that separating Chrome from Google could give rival search providers a more independent way to reach users. Those were the plaintiffs’ arguments for a remedy, not a finding that owning Chrome was itself unlawful. Their proposal is set out in the proposed final judgment.

The proposals also addressed distribution contracts, access to search-related data and infrastructure, and the ability of rivals to obtain search results or advertising services through syndication. Plaintiffs proposed contingent relief involving Android as well. Chrome and Android are different assets: Chrome is a browser, while Android is a mobile operating system and device ecosystem. The court rejected the proposed Chrome sale and Android divestiture.

Why was Chrome central to the dispute?

The government’s case was about how people reach search, not simply about the browser market. In its view, control of a widely used browser could help Google channel searches to its own service, benefit from user activity and data, and reinforce the effects of distribution agreements. The plaintiffs also argued that control of these routes to users could matter as conventional search and generative AI products increasingly overlap.

That theory made Chrome a potentially powerful target for a structural remedy, but it did not make a sale automatic. A court must connect a remedy to the violation established in the case and assess whether the requested measure is justified and workable.

What did Google argue in closing?

Google opposed the proposed sale. It argued that Chrome was built through product development, not acquired to obtain monopoly power, and that forcing a divestiture would be an unusually severe response to the conduct at issue. Google also disputed that the plaintiffs had shown behavioral remedies would be inadequate.

The company raised practical objections to separating Chrome from Google’s technology and operations, including the complexity of accounts, security, development systems and integration. It also argued that mandated data access and syndication could intrude deeply into the search business. Finally, Google pointed to changes in search and the growth of generative AI as reasons not to assume that market conditions would remain as they had been historically. These were Google’s defenses; they did not erase the court’s prior liability ruling.

What did the judge decide?

Closing arguments in the remedies phase occurred on May 30, 2025. On September 2, 2025, the court imposed significant remedies but rejected the Chrome sale. The final judgment entered on December 5, 2025, likewise did not require Google to divest Chrome. The court chose restrictions and access obligations rather than the most sweeping structural remedies sought by the plaintiffs.

Why did the court reject a Chrome sale?

The decision was about the fit and justification for a remedy, not a simple conclusion that Chrome was unimportant or that AI alone had changed the outcome. The court took a cautious approach to structural relief and concluded that the plaintiffs had not adequately shown behavioral remedies would be insufficient. It found the proposed divestiture a poor fit for the proven violations and the relief requested on the evidentiary record.

The court also considered the changing competitive environment, including generative AI, when assessing future market conditions. That consideration formed part of the analysis; it should not be reduced to the claim that “AI saved Chrome.” The Congressional Research Service’s overview discusses the court’s approach to structural and behavioral remedies.

The broader remedial question is not simply whether a company is large. Courts assess whether a remedy addresses the established violation, prevents recurrence, restores competition, and can be justified and enforced. A court can find unlawful monopolization while rejecting a particular breakup proposal.

How do structural and behavioral remedies differ?

A structural remedy changes ownership or control of an asset; a behavioral remedy places rules on how a company can act. The Chrome proposal and the remedies ordered illustrate the trade-offs.

Chrome divestiture Could create an independent browser and search-distribution gateway and separate Chrome from Google Search. Would require a workable separation of technology and operations; a buyer would need the ability to maintain the product, and the court would need a basis to find the sale necessary.
Behavioral requirements Can target contracts, data access and syndication without transferring a widely used product to a new owner. Requires monitoring and enforcement; compliance can be technically complex, and rivals may not be able to turn access into a competitive product.

The court’s choice of behavioral rules leaves a continuing role for compliance monitoring. Its effectiveness depends on implementation and enforcement, not solely on the language of the judgment.

What happens next?

As of August 18, 2026, the district-court remedies were in force unless stayed or changed. Compliance reporting and technical oversight were continuing, and the plaintiffs were pursuing appellate review. The DOJ case page lists a response brief and opening brief on cross-appeal filed July 28, 2026. The available filings do not establish that an appellate court has revived or ordered a Chrome sale. The government is continuing to challenge parts of the remedies on appeal; that is different from a pending district-court decision on whether Google must sell Chrome.

What does the outcome mean for users and competitors?

Chrome users

Because the court rejected divestiture, Chrome users were not transferred to a new owner under this judgment. The immediate legal consequences instead concern distribution agreements, access obligations and oversight.

Rival search engines and browser developers

Contract restrictions and access to specified search resources may affect how rivals compete for distribution and build search services. The judgment does not guarantee that competitors will gain users; that depends on how the requirements operate and how rivals use the access available to them.

Google’s partners and the broader search market

Partners covered by the judgment face restrictions on certain exclusive arrangements, while syndication and data-access obligations create additional rules for Google’s dealings with competitors. The appeal and compliance process will shape how those provisions work in practice.

This search case should not be confused with the separate 2023 Google ad-tech litigation, which concerns advertising technology assets and has its own proceedings and proposed remedies. See the DOJ page for the 2023 case.
