Pros and Cons of Using TOD Accounts to Avoid Probate

A TOD designation may transfer an eligible account directly to a beneficiary at death, but it does not settle the whole estate or eliminate state-law, tax, and planning concerns.

A transfer-on-death (TOD) designation can let a named beneficiary receive an eligible financial account directly when its owner dies, without ordinary probate administration of that account. The owner generally retains control during life. The tradeoffs: TOD covers only the assets it applies to, rules vary by state and custodian, and a beneficiary form can become misaligned with the rest of an estate plan. Avoiding probate for an account does not mean avoiding probate for the whole estate or avoiding estate taxes.

What a TOD account means

“TOD account” commonly means a financial account or security registration with a transfer-on-death beneficiary designation; it is not one uniform account type with identical rules everywhere. The account’s registration, the custodian’s terms, and applicable state law determine whether the designation is available and how it works. For example, Florida’s 2026 statutes address beneficiary-form registration for accounts and securities (Florida Statutes, Chapter 711), while North Carolina law provides a framework for securities registered in beneficiary form (North Carolina General Assembly, Chapter 41, Article 4).

This article concerns financial accounts and securities, not transfer-on-death deeds for real estate. Deed rules are a separate legal mechanism; Alaska’s court guidance, for instance, explains TOD deeds for real property (Alaska Court System, Transfer on Death Deed).

Pros of using a TOD designation

It may keep the designated account out of ordinary probate

If the registration is valid and the applicable rules recognize it, the covered asset can pass to the named beneficiary outside ordinary probate administration. State statutes and account terms control the result. Nevada law, for example, addresses TOD directions on account records (Nevada Revised Statutes, Chapter 111); South Dakota law describes transfers through beneficiary-form registration and governing law (South Dakota Codified Laws, Chapter 29A). These are jurisdiction-specific examples, not a nationwide rule.

The owner generally keeps control during life

A beneficiary designation typically names who is to receive the account at the owner’s death without giving that person present ownership solely because they are named. The owner may generally be able to change the designation, subject to the account agreement and applicable law. Wells Fargo Advisors describes these planning features in its overview of TOD designations (Wells Fargo Advisors, Transfer-on-death designations).

It can direct one account differently from other assets

A designation can identify recipients for a particular account independently of how other property is distributed. That can be useful when it reflects the owner’s actual intentions, but it makes coordination with the will, trust, family circumstances, and contingent beneficiaries important.

Cons and risks to weigh

It applies only to the property covered by the registration

A TOD designation does not automatically transfer the owner’s other assets. Property without an applicable nonprobate transfer mechanism may still require probate. Asset-specific transfers should not be mistaken for a plan covering the entire estate.

State law and custodian procedures can change the outcome

Eligibility, beneficiary rules, the legal effect of a designation, creditor exposure, and the steps a beneficiary must take are not uniform across the United States. Nevada’s statute addresses possible liability of nonprobate transferees for allowed estate claims in specified circumstances when the probate estate is insufficient, subject to the law’s conditions and exceptions (Nevada Revised Statutes, Chapter 111). Louisiana-specific commentary also cautions that the beneficiary’s result may differ from the simple expectation that the named person automatically becomes owner (Louisiana State Bar Journal, 2023). These examples illustrate why local rules matter; they are not a complete survey of state law.

The beneficiary form may not match the broader estate plan

Family relationships and intentions can change after a form is completed. Review the named and contingent beneficiaries against intended shares, any trust, the will, and current circumstances. If a designation and another estate document point in different directions, do not assume a universal priority rule: applicable law and account terms need to be checked.

Probate avoidance is not tax avoidance

A TOD transfer’s treatment outside probate does not itself establish that the asset is excluded from the owner’s taxable estate. A 2024 estate-planning primer says TOD/POD account values are generally included in the gross estate (AMG National Trust, Estate Planning Primer); that secondary overview is not a substitute for current tax guidance. Consult authoritative tax materials or a qualified tax professional about the rules that apply to your circumstances.

How to decide whether a TOD designation fits

  1. Confirm coverage. Ask the custodian whether the specific account or security can use a TOD or beneficiary-form registration, and request its written requirements.
  2. Check the governing rules. Identify which state law and account terms apply, including any limits on beneficiaries, transfer mechanics, or creditor claims.
  3. Review the whole plan. Compare the proposed recipients and shares with the will, trust, other beneficiary designations, and family circumstances. Update the form when intentions change.
  4. Ask how a beneficiary makes a claim. Obtain the institution’s current instructions, including what forms and documentation it requires. There is no single claim checklist or standard transfer time established for every custodian.
  5. Get individualized advice when needed. If the estate is complex, the designation could affect family arrangements, or tax consequences are uncertain, consult an estate-planning attorney or tax professional familiar with the relevant state.

TOD designation versus other estate-planning choices

A TOD designation is one way to address a particular eligible account. A will, revocable trust, or joint ownership arrangement may work differently and may cover different assets. Compare options based on which property can use them under local law and custodian rules, who controls the property during life, what happens at death, and how the arrangement fits the rest of the plan. Do not assume one option is universally cheaper, faster, or more suitable: reliable nationwide comparisons of cost and probate duration are not established here.
