Temu’s U.S. prices may face pressure because low-value imports no longer receive the broad duty-free treatment they once did—but that does not mean every Temu item now costs more by the same amount. The United States has suspended the de minimis exemption for covered shipments, so eligible imports may need customs entry and may owe applicable duties, taxes, and fees. Temu announced U.S. price adjustments in April 2025, but the company did not disclose their size, and available evidence does not establish a uniform current increase across its listings.
What changed for low-value imports?
For years, qualifying goods imported by one person on one day could enter the United States without duties under the de minimis exemption. The former general threshold was $800; Congress raised it from $200 to $800 in 2016, according to the U.S. Court of International Trade.
Suspending de minimis removes that broad exemption. It does not set one universal tariff rate, and it does not mean every order is charged the same amount. Covered shipments may have to be declared through customs and can be subject to whatever duties, taxes, and fees apply to the goods and their import circumstances.
How the change took effect
- May 2, 2025: The United States ended de minimis treatment for covered products from China and Hong Kong. Non-postal shipments valued at or below $800 had to use an appropriate customs entry type and pay applicable duties. The April 2025 order also established a separate interim process for postal shipments.
- August 29, 2025: A July 30 White House order extended the suspension globally, with implementation effective August 29.
- February 20, 2026: Executive Order 14388 continued the suspension. It says the exemption does not apply to covered shipments regardless of value, country of origin, transport mode, or method of entry, while setting separate rules for international postal shipments.
- June 2026: U.S. Customs and Border Protection (CBP) formalized an indefinite administrative suspension covering postal and non-postal shipments. The rules generally direct low-value non-postal shipments to entry type 11 and make them subject to applicable duties, taxes, and fees.
The CBP rules set October 22, 2026, as the compliance date for specified postal-process requirements. As of October 7, 2026, that date is still in the future. Postal and non-postal shipments therefore should not be assumed to follow identical customs procedures.

Will Temu prices go up because of tariffs?
Temu and Shein announced U.S. “price adjustments” beginning April 25, 2025. In notices reported by the Associated Press on April 16, the companies attributed the changes to “recent changes in global trade rules and tariffs.” Neither notice specified an amount. This establishes that Temu announced adjustments and gave that explanation; it does not show how much prices changed or how costs have been passed on since.
The policy change can add costs to importing goods, but the cost does not automatically translate into a matching increase on a shopper’s listing. A seller may absorb some costs, change product prices, alter sourcing or fulfillment, or arrange for import charges to be handled separately. The available figures do not establish how much Temu has passed through to U.S. shoppers today.

Why there is no single “Temu tariff”
The suspension concerns eligibility for duty-free entry, not a flat charge applied to everything sold on Temu. The amount due, if any, depends on the applicable customs treatment of a shipment and its goods. The rules also distinguish postal from non-postal handling. The fact that a product appears on Temu does not, by itself, establish where it ships from or which customs route applies; not every listing should be treated as a direct shipment from China.
For a particular purchase, compare the final checkout total, delivery terms, return policy, disclosed origin or shipping route, and whether import charges are included before payment or may be collected later. A listing price alone may not show the full cost of buying and receiving the item.

What the 2026 court ruling means—and what it does not
On August 13, 2026, a three-judge panel of the U.S. Court of International Trade ruled in Detroit Axle, Inc. v. Department of Commerce that the International Emergency Economic Powers Act (IEEPA) authorizes the President’s rescission of the de minimis exemption. The panel also held that the implementing agency actions were ministerial and not reviewable under the Administrative Procedure Act.
The opinion did not finally uphold every tariff imposed under IEEPA. The panel acknowledged the Supreme Court’s holding that IEEPA does not authorize the President to impose tariffs, denied the government’s motion on a separate tariff count, and deferred judgment on that issue. The decision supports saying that the de minimis exemption remains suspended; it should not be described as a final ruling validating all IEEPA tariffs.

What government figures say about the policy
The White House’s 2026 Economic Report of the President cited CBP figures as part of the administration’s case for ending de minimis treatment. Those figures give context for the policy rationale, but they do not measure Temu’s costs or what shoppers pay.
- For 2024, the report said that about 98% of narcotics seizures, 97% of counterfeit-goods seizures, and 77% of health-and-safety seizures by count were associated with de minimis shipments. These percentages describe the share of seizures linked to such shipments—not the share of all de minimis parcels that contained harmful goods.
- The report cited CBP’s estimate that more than $1 billion in duties had previously gone uncollected under the exemption. That is a figure about duties, not a measure of consumer price increases.
How to judge the price of a Temu order
Because the policy does not dictate one shelf-price increase, assess the specific order rather than assuming all Temu prices have moved together.

- Check whether import charges appear before payment or could be collected later.
- Compare the complete cost and terms with other sellers; the policy change alone does not establish which retailer is cheaper overall.
