“Construction guarantee cover” is not a single worldwide insurance product. The name, eligibility threshold, covered events and claim deadline depend on the project’s location, contract date and type of work. Before paying a deposit, identify the exact local scheme, obtain the project-specific policy and certificate, and verify them with the issuing authority or insurer.
This cover is usually a backstop when a builder cannot finish or rectify qualifying work; it is not a promise that every defect or dispute will be paid. The checks below help you distinguish insurance from statutory warranties, compare like-for-like protection and preserve your ability to claim.

1. Name the jurisdiction and the exact scheme
Start with the address of the work, not the salesperson’s description. Ask for the product’s legal name, the law that governs it, who must arrange it and whether the contract date changes the rules. Thresholds from one country or state cannot be applied to another.

| Victoria, Australia (Consumer Affairs Victoria, 2026) | Domestic building insurance | For the scheme described on that page, the builder arranges cover for domestic building work above $16,000. The stated protection is up to $300,000 for structural defects for six years and non-structural defects for two years, subject to the policy and Victorian rules. | These amounts, periods and the $16,000 threshold are Victorian figures for the cited scheme and date. |
| Victoria, Australia (Building and Plumbing Commission, 2026) | New Home Warranty | For eligible work from 1 July 2026, the guidance describes work valued above $20,000 on homes or residential buildings up to three storeys, subject to exclusions and transitional arrangements for older signed contracts. | The start date, storey limit and threshold apply to this Victorian scheme only. |
| New South Wales, Australia (NSW Government, 2026) | Home Building Compensation (HBC) cover | HBC is described as last-resort protection if a builder cannot complete work or fix defects. Consumer guidance says to check valid project cover for home building work above $20,000 before paying or starting. | NSW eligibility, claim triggers and limits are not interchangeable with Victorian cover. |
| British Columbia, Canada (BC Housing guidance) | Home warranty insurance | The policy controls the covered defect categories, exclusions, limits, expiry dates and the identities of the builder and warranty provider. | There is no basis for importing Australian thresholds or periods into a British Columbia policy. |
| France (Service-Public, 2026) | Dommage-ouvrage insurance | For specified major construction or renovation work, it is taken out before work begins and can fund certain damage within the ten-year guarantee without waiting for liability to be settled. It concerns damage affecting structural solidity or making the building unusable for its intended purpose. | This is a distinct French product with its own exclusions, procedures and notice rules. |

2. Confirm that your project qualifies
Check the work and value
Eligibility can depend on whether the job is a new home, extension, renovation, structural repair or another defined category. Confirm the contract value used by the scheme, how variations are treated and whether ancillary work is included. A threshold may be calculated from the contract rather than from the amount you have paid so far.
Check the contract date and transition rules
When a scheme changes, the signed-contract date can determine which certificate and limits apply. Victoria’s new Home Warranty description starts on 1 July 2026 and notes transitional treatment for earlier signed contracts. Ask the authority or insurer to state in writing which scheme governs your contract; do not assume that a project crossing the start date automatically moves to the new rules.
Check who is responsible for arranging cover
In many home-building schemes the licensed builder must obtain the project cover and give it to the client. In other products, the owner or developer may have to arrange insurance before construction. The certificate should identify the insured or beneficiary, and the contract should say who pays the premium. If the builder says a general business policy is enough, ask for the specific project certificate required by the local scheme.

Check the building type and exclusions
Confirm whether the scheme accepts the number of storeys, intended use, location, construction method and type of owner. Victoria’s 2026 description, for example, refers to homes or residential buildings up to three storeys and lists exclusions. A policy that covers a detached dwelling may not cover a commercial conversion, mixed-use building or owner-builder project.
3. Match the certificate to the actual project
Do not rely on a quotation, invoice or generic brochure. Before paying a deposit, compare the certificate and policy with the signed contract line by line. At minimum, check:
- the insured property address, lot or unit identifier;
- the builder’s legal name, licence or registration details and contact information;
- the owner or beneficiary named on the certificate;
- the project description and contract amount, including approved variations where relevant;
- the policy or certificate number and the insurer or warranty provider;
- the issue, commencement and expiry dates; and
- any stated excess, deductible, sublimit or special condition.
Consumer Affairs Victoria tells builders: “You must provide your client with a copy of the policy and a certificate of currency covering their property before you take a deposit or any other money.” That instruction is Victorian and should not be presented as a worldwide rule, but it illustrates the standard a buyer should expect: a document tied to the property, not a promise that cover exists somewhere.

A document can be expired, cancelled, altered or issued for a different job. Use a contact route you obtain independently, rather than only a telephone number supplied in an email from the builder.
- Call or email the insurer or warranty provider using its official contact details and quote the certificate number.
- Ask the provider to confirm the property, builder, contract and effective dates, and whether the policy is active.
- Where the jurisdiction offers a register, search the project. NSW guidance points consumers to the HBC Check service as well as contacting the insurer named on the certificate.
- Record the date, channel, person or reference number and the result. Save a dated PDF or screenshot of any online result.
- Escalate discrepancies to the licensing or consumer authority before signing a variation or paying more money.
Independent verification does not guarantee that a future claim will succeed; it confirms that the project appears to have valid cover on the date checked.
5. Identify the event that actually triggers protection
Read the trigger clause before judging the policy’s value. A guarantee product may respond only after a defined builder failure, not whenever workmanship disappoints you.
| Possible event | Questions to ask | Common mistake |
|---|---|---|
| Builder insolvency or death | Is the event defined, and what evidence is required? | Assuming financial difficulty that does not meet the policy definition is enough. |
| Builder disappears or cannot be located | How long must you try to contact the builder, and what proof is needed? | Stopping communication without documenting attempts. |
| Failure to complete work | Which incomplete items qualify, and is there a separate cap? | Treating every delay or disputed variation as an insured loss. |
| Defective work | Which structural and non-structural defects are listed, and must the builder first have an opportunity to rectify? | Assuming any cosmetic dissatisfaction is covered. |
| Failure to comply with a final tribunal or court order | Does the policy include this extension and does it apply to the issue date of your policy? | Believing a pending complaint or interim decision is enough. |
Victorian guidance gives examples of death, insolvency and disappearance before completion, and its April 2026 checklist says some policies issued on or after 1 July 2015 may also cover failure to comply with a final VCAT or court order. Those are policy and jurisdiction details, not a general definition of construction insurance. BC Housing likewise advises owners to rely on the defect categories written in their own policy. NSW describes HBC as last-resort protection when the builder cannot complete work or fix defects.

Separate the builder’s contractual duty from the insurer’s trigger. A builder may still owe repairs under the contract or statutory warranties even when no insurance event has occurred.

6. Compare limits, sublimits and coverage periods
Ask for a schedule showing the maximum payable for each loss category. A single headline limit can conceal a much smaller cap for unfinished work, temporary accommodation, investigation or removal and replacement.
| Item to compare | What to record |
|---|---|
| Structural defects | Maximum amount, definition and period measured from completion, handover or another stated date. |
| Non-structural defects | Separate limit, defect definition and expiry date. |
| Incomplete work | Cap, valuation method and whether the limit is a percentage of the contract price. |
| Temporary accommodation or related costs | Daily or total cap, waiting period and proof required. |
| Excess or deductible | Amount per claim, defect or event, and who pays it. |
| Investigation and professional fees | Whether inspections, reports, engineering advice or legal costs are included or require prior approval. |
| Transfer to a later owner | Whether rights pass on sale, and what notice or registration is required. |
As one Victorian example, Consumer Affairs Victoria states up to $300,000 for structural defects for six years and non-structural defects for two years. Its checklist also describes a possible cap of 20% of the contract price for unfinished-work claims. These figures are not directly comparable with NSW, British Columbia or France, and they should not be applied to a Victorian policy without checking the issue date and wording.
Confirm when the clock starts. A six-year period from practical completion is different from six years from the certificate date. Ask how extensions, discovered defects and remedial work affect the period, and put the answer in your file.

Turn to the exclusions, conditions and claims section rather than stopping at the marketing summary. Look for:
- normal wear, poor maintenance, abnormal use or owner-supplied materials;
- intentional acts, unauthorised alterations and damage caused by another contractor;
- flood, storm, ground movement or other external causes that may belong under a different policy;
- defects that were visible or known before the policy began;
- requirements to follow maintenance instructions or permit inspections;
- the builder’s opportunity to inspect and rectify before another contractor is hired;
- prior approval for emergency work, demolition or repairs; and
- notice, evidence and cooperation requirements.
Service-Public’s description of French dommage-ouvrage cover excludes, among other matters, intentional acts, normal wear or poor maintenance, abnormal use and external causes. Those exclusions illustrate why you must read the actual policy: they do not automatically apply to an Australian or Canadian product.
Do not authorise permanent repairs before asking whether the provider requires an inspection. Take reasonable emergency steps to prevent further damage, photograph the condition and keep invoices, while following the policy’s notification instructions.

8. Map the claim procedure and every deadline
Save the claims telephone number, online portal and postal address before a dispute arises. Then write a short procedure for your household or site manager:
- Notify the builder in the form and timeframe required by the contract or policy, describing the defect or incomplete work precisely.
- Notify the insurer or warranty provider through its specified channel and retain proof of delivery.
- Provide the certificate, contract, plans, payment records, photographs, inspection reports and a chronology of events.
- Allow access for inspection unless an emergency makes that unsafe; document every appointment and missed visit.
- Obtain written approval before engaging replacement builders or incurring costs that you expect to claim.
- Record the decision, reasons, review or dispute route and the deadline for escalating it.
BC Housing advises prompt action and written notice to the builder and warranty provider under the applicable process. French official guidance describes a minimum reporting window and a two-year outer notice rule for its scheme; the exact trigger and calculation must be read in the French policy and current official instructions. A deadline missed by a few days can be more damaging than a disagreement about the defect itself.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.9. Keep a complete project file
Store originals in a secure folder and a backed-up digital location. Include:
- the signed building contract and every variation;
- the policy, certificate, schedule and endorsements;
- plans, specifications, engineering documents and approvals;
- deposit and progress-payment records;
- independent inspection, stage and final reports;
- dated photographs or video of work before concealment and of each defect;
- emails, letters, texts, meeting notes and delivery receipts;
- notices to rectify, responses and access records; and
- final inspection, occupancy or handover documents.
Consumer Affairs Victoria recommends retaining project documents and certificates. A well-indexed file helps establish dates, prove notice and distinguish an original defect from later damage.
10. Check other insurance and the building contract
Ask your home and contents insurer whether renovation, vacancy, scaffolding, unoccupied rooms or temporary relocation changes your cover. The Victorian checklist specifically recommends asking that insurer before work begins. A builder’s public-liability policy is separate: it may protect against injury or third-party property damage, but it does not prove that you hold the home-building guarantee cover described here.

Review the contract for scope, completion date, payment stages, variation approval, inspection rights, dispute process and statutory warranties. NSW contract guidance recommends verifying the insurance certificate and contract requirements. Victoria distinguishes statutory or implied warranties from the insurance backstop; its guidance says those warranties can support action for up to ten years from completion. That legal warranty period is not the same as an insurance limit or notification deadline.

If the contract promises broader protection than the certificate, ask the builder to reconcile the documents in writing. For a high-value, unusual or multi-unit project, obtain advice from a qualified professional in the project’s jurisdiction before signing.
11. Compare offers on a like-for-like worksheet
Do not compare a low premium with a broad promise against a higher premium with documented sublimits. Enter the answers for each offer in the same worksheet:
| Comparison field | Information to enter |
|---|---|
| Eligibility and scope | Project type, value, storeys, location, contract date and exclusions. |
| Insured party and beneficiary | Owner, purchaser, lender, builder or later owner; transfer procedure. |
| Trigger | Insolvency, death, disappearance, non-completion, listed defects, final order or another defined event. |
| Defect categories | Structural, non-structural, water ingress, services and any expressly excluded category. |
| Limits | Total maximum, category sublimits, incomplete-work percentage cap and related-cost caps. |
| Duration | Start event, end date, discovery rules and any extension. |
| Excess and costs | Deductible, inspection fees, professional fees and emergency-work treatment. |
| Claim mechanics | Who must notify first, channel, evidence, inspection rights, repair approval and escalation path. |
| Provider status | Legal provider name, licence or scheme registration and independent validity check. |
Only compare products designed for the same jurisdiction and project. A French dommage-ouvrage policy, a NSW HBC certificate and a British Columbia home-warranty policy answer different legal questions even if a salesperson calls each “guarantee cover.”
12. Know when to pause the purchase
Stop and obtain clarification before paying if:
- the builder will not provide a project-specific certificate;
- the address, contract price, builder name or dates do not match;
- the provider cannot confirm validity independently;
- the document names a different scheme or a general business policy;
- the salesperson cannot explain the trigger, sublimits, expiry or excess;
- you are urged to start work before cover is effective; or
- the contract and policy allocate responsibility inconsistently.
Keep written questions and answers. If the provider or regulator says the project is ineligible, treat that as a decision point rather than assuming a private label will create equivalent statutory protection.
Examples of how the checks change the outcome
Victorian contract signed around the 2026 change
A homeowner sees a certificate referring to the new Victorian Home Warranty but signed the contract before 1 July 2026. The owner should ask the Building and Plumbing Commission or issuing provider which transitional rule applies, then verify the threshold, storey limit and policy wording. Quoting the new $20,000 threshold without resolving the contract date could lead to a false assumption of cover.
NSW builder stops attending site
The owner should verify that the HBC certificate is valid for the address, document missed appointments and notices, and follow the policy’s last-resort process. A delay alone does not establish a claim; the owner must show the defined inability to complete or rectify and meet notice requirements.
French renovation damage discovered later
The owner should check that the specified work required dommage-ouvrage cover, that the policy was taken out before work began, and that the damage affects structural solidity or intended use rather than maintenance or ordinary wear. Notice must follow the French policy’s reporting window, including the described two-year outer rule.
Make the decision before money changes hands
You are ready to proceed only when the local scheme is identified, eligibility is confirmed, the certificate matches the property and contract, the provider has independently verified it, and you understand triggers, exclusions, limits, dates and claim steps. Save the complete file and check your ordinary home insurance at the same time. If any of those answers is missing, delay payment until the builder, insurer or relevant authority supplies a written answer that fits your project.
