In February 2024, the Commerce Department placed Sandvine on its Entity List, requiring a license for covered exports, reexports and in-country transfers of items subject to U.S. export rules; the stated review policy was a presumption of denial. The department announced Sandvine’s removal from the list on October 21, 2024.
What happened, and when?
| Date | Event |
|---|---|
| February 26, 2024 | The Bureau of Industry and Security (BIS), part of the U.S. Department of Commerce, announced Sandvine’s addition to the Entity List. BIS said covered transactions involving items subject to the Export Administration Regulations (EAR) would require a license and that applications were likely to be denied. BIS announcement. |
| February 27, 2024 | The final rule appeared in the Federal Register and took effect. It specified a license requirement for all items subject to the EAR in covered transactions involving Sandvine, with a presumption of denial. The entry listed destination headings for Canada, India, Japan, Malaysia, Sweden and the United Arab Emirates; those headings do not mean the alleged misuse occurred in each country. Federal Register final rule. |
| October 21, 2024 | BIS and the State Department announced that Sandvine had been removed from the Entity List, citing changes to the company’s governance and business practices. They said they would monitor its implementation of commitments. BIS removal announcement. |
The announcement and effective dates refer to separate official actions: BIS announced the listing on February 26, while the rule was published and became effective on February 27.

What did the U.S. action actually restrict?
The Entity List is an export-control mechanism under the EAR. While Sandvine’s entry applied, it required a BIS license for exports, reexports and transfers in-country involving items subject to the EAR in covered transactions. The rule set a presumption of denial, making approval unlikely; it did not prohibit every possible trade, service, payment or other relationship with Sandvine. The exact reach of the EAR depends on the item and transaction. See the current EAR for the governing rules.
After removal, the additional licensing requirements imposed by Sandvine’s Entity List entry no longer applied. Removal did not waive other EAR controls: an item’s classification, destination or other applicable circumstances may still trigger a license requirement. BIS’s Entity List FAQ explains this distinction. A specific transaction may require a fact-specific legal assessment.

Why did BIS add Sandvine to the list?
In the Federal Register rule, BIS said the End-User Review Committee acted on information that Sandvine supplied deep packet inspection technology to Egypt’s government. BIS said the technology was used for mass web monitoring and censorship, including blocking news and targeting political actors and human rights activists. In its October 2024 announcement, BIS also described the products as having enabled misuse of commercial spyware and targeting of human rights activists and dissidents. These are the U.S. government’s stated assessments, not an independent technical finding presented here.
What changes did the government cite before removing Sandvine?
BIS said Sandvine overhauled its corporate structure, leadership and business model, and shifted its focus toward democracies committed to protecting human rights. The department reported that the company had exited 32 countries and had an additional 24 exits in process. Those counts and the following steps are BIS’s account of the company’s changes and commitments, not independent confirmation of long-term compliance.

What this means for the headline
“Bans trading” overstates the legal scope if read as a prohibition on every kind of business with Sandvine. The measure was a stringent export licensing restriction on transactions involving EAR-subject items, not a universal trade ban. It was also temporary: BIS announced Sandvine’s removal on October 21, 2024. The relevant distinction is between the extra Entity List controls, which ended with removal, and any other export-control requirements that may still apply to a particular item or transaction.
