A virtual assistant can generally handle factual intake, records requests, document preparation, and other clerical insurance work under clear instructions and appropriate supervision. Keep coverage explanations, recommendations, sales-related discussions, and decisions or actions that bind or otherwise effect coverage with personnel licensed for the relevant insurance line and jurisdiction. The boundary depends on what the person actually does—not the job title.
How to tell whether a task needs a license
The National Association of Insurance Commissioners (NAIC) describes an insurance producer as an individual who sells, solicits, or negotiates insurance. Its model guidance treats directly advising a prospective purchaser about substantive policy benefits, terms, or conditions as negotiation in the circumstances it describes. State regulators license producers and set the rules for their activities. See the NAIC Producer Licensing overview and the 2020 State Licensing Handbook.

For a proposed task, ask whether the assistant is only capturing facts or following a defined process, or whether the assistant would exercise insurance judgment, advise a customer, urge a purchase, or take an action that affects coverage. An assistant’s title, employment status, or remote location does not by itself settle the licensing question.

It is based on the Producer Licensing Model Act, Uniform Licensing Standards, and adopted guidance, and is intended to promote uniformity and provide suggested best practices. State law and rules can differ. The handbook identifies the relevant state by where the activity requiring a license takes place, so multi-state workflows need particular care. Check the applicable state’s law and insurance department guidance for the specific line and task. The NAIC handbook page identifies the 2020 edition: NAIC State Licensing Handbook.

Task map: what an assistant may handle and what to escalate
The following examples reflect the NAIC activity guidance. They are a practical starting point, not a blanket legal determination for every state, product, or workflow.
| Task | Assistant’s clerical role | Keep with licensed staff or escalate |
|---|---|---|
| Prospective customer requests coverage | Receive the request and pass it to a licensed producer, or route it through an automated system developed and maintained under an insurer’s or licensed producer’s supervision. | Discuss what policy or company the customer should choose, recommend coverage, or represent that coverage is or will be bound. |
| Application and underwriting information | Record factual information, prepare an application under a producer’s instructions for that producer’s review, and obtain underwriting information from sources such as credit agencies, motor-vehicle departments, or other insurance entities. | Interpret the customer’s answers, make a coverage recommendation, or take on a sales or negotiation conversation. The producer should review the prepared application. |
| Documents for a new or existing policy | Prepare a binder, certificate, endorsement, identification card, or policy for a producer’s review and signature under that producer’s instructions. | Issue a document in a way that effects insurance, make a commitment, or tell the customer that coverage is in force. Physical delivery alone is different from an act that effects the policy; the exact task and state rules matter. |
| Existing-policy change request | Receive and record a request to add or remove an item, prepare an associated endorsement, or process a requested change when the work is clerical and performed under the applicable instructions. | Advise whether the customer should make the change, interpret its effect, or recommend limits or coverage. NAIC guidance describes a narrow allowance for giving a rate quote on the requested change only; do not turn that into a general authorization to quote or advise on prospective coverage. |
| Question about coverage already shown in records | Report what the policy records indicate, without interpreting them. | Explain policy meaning, analyze exclusions or exposures, give a coverage opinion, or advise whether existing limits are adequate. |
| Routine office processing | Open mail, file records, mail billings, and perform other routine processing that does not become a sales, advice, negotiation, or coverage-effecting activity. | Move the conversation or action to licensed staff if it shifts into a recommendation, policy interpretation, or decision about whether insurance is in force. |
The NAIC’s Appendix B: Licensable and Non-Licensable Activities supplies examples on both sides of these distinctions. Its classifications are activity examples, not substitutes for checking current law where the work occurs.

Questions an assistant should hand off
Route the conversation to an appropriately licensed producer when a customer asks for judgment rather than a factual record or a defined clerical action. Examples include:
Outdated Drivers Are Slowing You Down

Repair common Windows errors and clear accumulated junk for a smoother, more stable PC - no reinstall needed.Free scan · no reinstall- “What does this exclusion mean for me?” or “Am I covered if this happens?”
- “How much coverage do I need?” or “Are my current limits enough?”
- “Which policy or company should I choose?”
- “Should I add or remove this coverage?”
- “Can you confirm that I’m covered now?”
These questions call for interpreting policy terms, evaluating a person’s circumstances, recommending a course of action, or confirming an effect on coverage. A useful handoff captures the customer’s question and relevant facts without trying to answer it.

Set up a supervised workflow before delegating
Build delegation around specific actions and sample customer language, not broad titles such as “assistant” or “account manager.” For each workflow, document the state and insurance line, the person supervising the work, where licensed review is required, and who owns escalations.
- Define the task. Write down what the assistant may receive, record, retrieve, prepare, or process—and what is outside that scope.
- Provide scripts and instructions. Give the assistant approved language for factual intake, records requests, document preparation, and handoffs. Scripts should not invite the assistant to interpret coverage or recommend a product.
- Set review and signature points. Require producer review where applicable before an application or insurance document is finalized, and keep with licensed staff any act that may bind or otherwise effect coverage.
- Make escalation easy. Name the licensed person or team for questions about policy meaning, coverage needs, company choice, or whether a proposed change is advisable. Specify how urgent questions are routed.
- Check the jurisdiction and line. Verify state statutes, regulations, and insurance department guidance for where the activity takes place and the line of authority involved. Recheck workflows that serve customers across state lines.
- Review the workflow when it changes. Reassess it if the assistant’s customer conversations, authority, document handling, compensation, or use of automation changes. Special rules may apply to health-marketplace enrollment assistance, adjuster work, or compensation arrangements.
These controls are practical ways to apply the NAIC distinctions; the NAIC materials do not prescribe this exact workflow. The NAIC Producer Licensing Task Force’s 2026 charges include discussion of state perspectives on marketplace enrollment assisters and producers helping consumers and businesses purchase health coverage. That discussion signals an area with additional context, but it does not itself establish an assistant’s authority. See the NAIC Producer Licensing Task Force.

What this means for an agency
Use virtual assistants for the repeatable, factual, and process-driven parts of service, with defined instructions and review. Do not let an administrative handoff quietly become a coverage opinion, sales conversation, recommendation, or assurance that insurance is bound. Before putting a workflow into production, confirm its treatment under the law and regulator guidance that apply to the actual state, insurance line, and activity.
