Crypto businesses that fall within the EU’s definition of a crypto-asset service provider (CASP) must operate a documented, risk-based anti-money-laundering and counter-terrorist-financing (AML/CFT) programme. That means more than checking a customer at signup: the firm must establish who customers and beneficial owners are, understand why services are being used, monitor relationships and transactions, assess transfers involving self-hosted addresses, report suspicions (including attempted transactions), and apply enhanced controls to certain correspondent relationships.
The exact obligations depend on the services the business actually performs, the legal definitions that apply to those services and the Member State whose competent authority supervises it. The overview below explains the EU-wide baseline; it is not a jurisdiction-specific legal determination.

Start by deciding whether the business is a covered CASP
“Crypto business” is not itself a legal category. The AML rules use the crypto-asset service provider concepts established under the Markets in Crypto-Assets (MiCA) framework, with specified exceptions. A trading venue, custodian, exchange, broker, transfer service or another business may have different status depending on the precise activities it performs.
Map actual activities, not marketing labels
Create an inventory of every service, product and customer journey. Describe what the firm does in operational terms: for example, whether it holds customer assets or keys, executes or transmits orders, exchanges crypto-assets, operates a platform, or transfers assets for customers. Map each activity to the applicable MiCA definition and note any exception that could affect coverage. Do not assume that a company incorporated around crypto, or one using a blockchain, automatically has the same AML duties as every other crypto firm.

Identify the governing Member State
Once the activity map is complete, identify the Member State whose laws and competent authority govern the firm. That determination can depend on authorisation, establishment, services offered and other facts. Check that state’s current AML legislation, supervisory guidance and transitional provisions before setting a compliance deadline. EU-level rules provide a baseline, but the local implementation and supervisory route determine how a particular firm must apply it in practice.
Keep the EU AML package and its dates separate
The framework is a package rather than a single crypto-only statute. The instruments have different functions and application dates.
| Instrument | What it does for a crypto business | Application point |
|---|---|---|
| Regulation (EU) 2023/1113 (Transfer of Funds Regulation) | Imposes information and traceability requirements for covered transfers of crypto-assets. | Applies from 30 December 2024. |
| Regulation (EU) 2024/1624 (AML Regulation) | Sets harmonised AML/CFT duties for obliged entities, including covered CASPs. | Generally applies from 10 July 2027. |
| Directive (EU) 2024/1640 | Addresses Member-State mechanisms within the AML framework. | Check national implementation and transitional rules. |
| Regulation (EU) 2024/1620 | Establishes the EU’s Anti-Money Laundering Authority (AMLA) and the institutional framework. | Institutional provisions operate according to the Regulation and related arrangements. |
Do not treat 30 December 2024 as the start date for every AML duty, or 10 July 2027 as permission to ignore current requirements. Transfer-information rules and the AML Regulation are separate instruments. The AML Regulation states: “This Regulation shall be binding in its entirety and directly applicable in all Member States.” Direct applicability does not remove the need to identify the relevant national authority or check rules that apply before the general 2027 date.
Build a proportionate, risk-based AML/CFT programme
A compliant programme combines governance, written procedures, technology, trained people and evidence that controls operate in practice. The scale and sophistication should reflect the firm’s size, services, customer base, transaction patterns, geography and other risk factors. A small firm still needs a functioning programme; proportionality is not an exemption.
Document the business-wide risk assessment
Assess risks across customers, products and services, delivery channels, countries and territories, transactions and counterparties. For crypto operations, include the way assets enter and leave the platform, exposure to rapid or unusual transaction patterns, use of intermediaries and the risks created by transfers to or from addresses that are not linked to a regulated provider. Record the assumptions, evidence, risk rating and approval date. Revisit the assessment when services, technology, customer segments or relevant threats change.

Assign accountable people and resources
Give a named person responsibility for AML compliance and define who can approve higher-risk relationships, stop or delay activity, make internal escalations and submit reports to the competent Financial Intelligence Unit (FIU). Senior management should receive meaningful information about risk, staffing, system performance, backlogs and significant issues. Policies are ineffective if the responsible staff member lacks authority, time, access to transaction data or a route to senior decision-makers.
Turn policy into operating controls
Write procedures for onboarding, verification, risk scoring, transaction monitoring, alert investigation, escalation, reporting, record keeping, confidentiality and staff training. Set service-level targets for reviewing alerts and documenting decisions. Maintain version control so the firm can show which rule applied at the time of a decision. Test controls periodically and correct weaknesses rather than treating a policy document as proof of compliance.

Customer due diligence (CDD) is the core control used to understand who is using the service and what activity should be expected.
Identify and verify the customer
Establish the customer’s identity and verify it using appropriate information and documents before providing services when the applicable rules require that sequence. For a legal person or arrangement, identify the people who ultimately own or control it and verify beneficial-owner information as required. Keep a record of what was collected, how it was verified, when it was checked and who approved any exception or escalation.
Understand purpose and intended nature
Record why the customer wants the relationship or occasional transaction, the expected products and volumes, relevant source or destination information and the countries involved. The profile should be specific enough to support monitoring. “Crypto trading” alone may not explain an expected pattern for a market maker, a remittance business, a treasury operation or an individual customer.

Keep information current and apply the right intensity
CDD is ongoing. Refresh information when it becomes outdated, when ownership or control changes, when activity departs from the profile or when new risk appears. Lower-risk situations may justify simplified measures, but simplified due diligence is still due diligence; it is not a blanket exemption from identification, understanding the relationship or monitoring.

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteHandle an inability to complete CDD
If the firm cannot complete required CDD, follow the applicable rules on refusing, stopping or ending the relationship and assess whether the circumstances create a suspicion that must be reported. Do not allow a commercial deadline or an automated workflow to override the escalation process.
Monitor relationships and transactions continuously
Onboarding checks cannot identify every risk. Ongoing monitoring should compare actual activity with the customer profile and detect unusual or suspicious behaviour. Use a combination of automated rules, investigative review and staff judgement. Controls should cover activity on the platform and, where the service and available information make it relevant, the flow of assets to or from external addresses and counterparties.
Design alerts that investigators can explain
Document why a rule exists, what data it uses, the threshold or pattern that triggers it and how an investigator decides whether an alert is false positive, requires more information or warrants escalation. Preserve the underlying data and the investigator’s reasoning. Excessive alerts that cannot be reviewed promptly are a control failure, while overly narrow rules can miss unusual activity.
Provide a clear escalation path
Front-line staff and automated systems should be able to send concerns to the person responsible for AML compliance. Define who can request documents, restrict activity, seek senior approval and communicate with the FIU. Keep an audit trail from the first alert through the final decision, including the rationale for closing an alert without a report.

Assess transfers involving self-hosted addresses
A self-hosted address is an address not linked to a CASP or similar provider. Transfers to or from such an address require a risk-based control process; the cited provisions do not impose a blanket ban on self-hosted addresses.
Minimum control sequence
- Identify the transfer. Distinguish an address that is linked to a provider from one that is not, using the information and technical controls available to the firm.
- Assess money-laundering and terrorist-financing risk. Consider the customer profile, asset flow, counterparties, geography, transaction history, amount and frequency, and any other relevant indicators.
- Apply proportionate mitigation. Depending on the identified risk, measures may include risk-based identification and verification of an originator or beneficiary, collecting further information about the origin or destination of assets, setting restrictions or approvals, and applying enhanced ongoing monitoring.
- Record the decision. Store the facts considered, the risk rating, the mitigation selected and the person or system that approved it. Feed material findings back into the customer profile and broader risk assessment.
The control should be calibrated to the risk actually identified. Treating every self-hosted address as inherently prohibited can block legitimate activity and does not reflect the risk-based structure of the obligation.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Report suspicious transactions, including attempts
Under the AML Regulation, suspicious transactions and attempted transactions must be reported to the competent FIU regardless of the transaction amount. A suspicion can also arise because the firm cannot conduct required CDD. The reporting duty is not limited to completed transfers or to a monetary threshold.
Separate suspicion from proof
A report communicates a concern for the FIU to assess; it is not an accusation or a finding of guilt. The AML Regulation states that a suspicious transaction is not an indication of criminal activity. Staff should therefore escalate on the legal suspicion standard and avoid demanding certainty that only an investigator or court could establish.
Protect confidentiality and avoid tipping off
Limit knowledge of a report and related analysis to people who need it for their duties. Follow the applicable confidentiality and disclosure restrictions, and ensure customer communications do not reveal a prohibited report or investigation. Keep evidence of when the decision was made, what information supported it and how the report was transmitted through the required channel.

Apply enhanced controls to cross-border correspondent relationships
Before establishing a cross-border correspondent relationship with a non-EU respondent that provides similar crypto-asset services, complete enhanced due diligence and obtain senior-management approval.
Checks before approval
- Confirm whether the respondent is licensed or registered where required.
- Understand its business, reputation and the quality of supervision it receives.
- Assess its AML/CFT controls, including how it performs CDD and monitors activity.
- Define and document each party’s responsibilities, information access and escalation routes.
- Obtain approval from senior management before the relationship starts.
Payable-through crypto-asset accounts
For a payable-through arrangement, confirm that the respondent has verified and continues to conduct due diligence on customers with direct access to the account and can provide the relevant CDD information on request. Update the diligence regularly and whenever new risks emerge. If the relationship must be ended for AML/CFT reasons, document the decision, its basis and the steps taken to manage the exit.
A practical implementation plan
Use the following sequence to turn the legal duties into an operating programme.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors- Define scope. Map services to MiCA and AML definitions, list entities and jurisdictions, and identify the competent Member-State authority.
- Build the risk assessment. Rate customer, product, channel, geographic, transaction and self-hosted-address risks; obtain management approval.
- Set governance. Appoint the AML lead, allocate staff and technology, establish independence and define escalation and FIU-reporting authority.
- Configure CDD. Implement identity and beneficial-owner verification, purpose-and-nature questions, risk classification, refresh triggers and an inability-to-complete process.
- Connect monitoring to profiles. Load expected activity, create explainable rules, staff an investigation queue and preserve alert decisions.
- Add transfer controls. Capture required transfer information under Regulation (EU) 2023/1113 and create a documented self-hosted-address risk workflow.
- Test reporting. Run scenarios for suspicious and attempted transactions, confirm FIU routes and test confidentiality controls.
- Review continuously. Track alert quality, overdue reviews, CDD refreshes, reporting decisions, training and control changes; update the programme when risks or services change.
Common failure points and corrections
| Failure | Why it is a problem | Correction |
|---|---|---|
| Assuming every crypto-related company has identical obligations | Coverage depends on actual services, definitions and exceptions. | Perform a documented activity-to-definition mapping and obtain local advice where status is uncertain. |
| Treating KYC as a one-time signup task | CDD, monitoring and reporting are ongoing duties. | Set refresh triggers, monitor activity and record investigations. |
| Blocking every self-hosted address automatically | The obligation is risk assessment and proportionate mitigation, not a universal ban. | Use a graduated control set tied to the identified risk. |
| Reporting only completed or high-value transactions | Suspicious attempts and suspicions arising from failed CDD can be reportable regardless of amount. | Train staff and configure workflows around suspicion, not a value threshold. |
| Waiting for 2027 to prepare | The transfer regulation already applies from 30 December 2024, and national rules may apply before the AML Regulation’s general date. | Check current national requirements and implement transfer controls now. |
| Buying software and treating it as compliance | Tools can support workflows, but the CASP retains the legal obligation and accountability. | Evaluate data coverage, explainability, audit trails, human review and escalation, then govern the tool as one part of the programme. |
What to verify before relying on this overview
Before launch or expansion, obtain advice on the firm’s exact MiCA status, establishment and cross-border model, the competent authority, national provisions and transitional arrangements. Confirm that policies reflect both Regulation (EU) 2023/1113’s transfer-information requirements and the AML Regulation’s application timetable. Keep evidence of decisions, approvals, CDD, monitoring, reports, training and reviews so the firm can demonstrate how its controls operated, not merely that a policy existed.
