What Are the Legal Rules for Mining Asteroids in Space?

Asteroid mining is not prohibited by a single global rule, but neither can a company simply choose an asteroid and begin mining. The 1967 Outer Space Treaty permits the exploration and use of celestial bodies while forbidding national sovereignty claims over them. Private missions must be authorized and continuously supervised by an appropriate state, and a few countries have laws addressing ownership of resources after extraction. Those national laws do not create a universal mining permit or settle the issue for every country.

What does the Outer Space Treaty say about asteroid mining?

The 1967 Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies—the Outer Space Treaty—applies to celestial bodies such as asteroids. The United Nations describes it as the basic framework of international space law.

Article I protects the freedom of all states to explore and use outer space on an equal basis and in accordance with international law. It also says space activities are to be carried out for the benefit and in the interests of all countries. This supports exploration and use, but it is not a detailed commercial mining code.

Article II bars national appropriation of outer space and celestial bodies: “Outer space, including the moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means.” A country therefore cannot claim an asteroid as its territory merely by reaching, occupying or using it.

Can a private company mine an asteroid?

Not without state oversight. Under Article VI, states bear international responsibility for their national space activities, including those of private companies. The treaty says that non-governmental activities in outer space “shall require authorization and continuing supervision by the appropriate State Party to the Treaty.” It assigns licensing and oversight to states; it does not give companies a direct international operating license.

Other treaty provisions matter to mission planning without forming a complete mining code. Article VII addresses a state’s international liability for damage caused by a space object in the circumstances it describes. Article IX requires due regard for other states’ interests and consultation if an activity may cause potentially harmful interference. The treaty does not specify a complete set of asteroid-mining permits, procedures or technical standards.

Can a company own minerals or water it extracts?

Ownership of recovered material is a different question from sovereignty over the asteroid. The Outer Space Treaty prohibits national appropriation of celestial bodies, but its text does not set out a detailed procedure for commercial title to extracted resources. Some national laws recognize ownership rights in material recovered under their scope and conditions. Their provisions express those countries’ legal positions; they do not bind every state or establish a worldwide title rule.

How do selected national laws approach space resources?

Jurisdiction and source Recovered-resource rule Authorization and scope
United States — Title 51, U.S. Code, chapter 513 A U.S. citizen engaged in commercial recovery is entitled, subject to applicable law and U.S. international obligations, to a resource obtained, including the right to possess, own, transport, use and sell it. The chapter defines space resources as abiotic resources in situ, including water and minerals, and an asteroid resource as one found on or within a single asteroid. The law directs the President, through federal agencies, to facilitate commercial exploration and recovery, consistent with U.S. international obligations. It also refers to authorization and continuing federal supervision, and promotes operation free from harmful interference subject to those qualifications.
Luxembourg — Law of 20 July 2017 and Space Activities Law of 15 December 2020 The 2017 law says space resources are capable of being owned. Luxembourg’s Space Agency says the law clarifies the country’s position on extracted resources and does not authorize national appropriation of celestial bodies. The resource law requires prior written authorization for exploration or use. It limits eligibility to specified entity forms under Luxembourg law or a European Company with a registered office in Luxembourg. Authorizations are mission-specific, conditional and subject to continuing ministerial supervision; they do not replace other required approvals. The broader Space Activities Law took effect on 1 January 2021. The agency’s legal-framework page was updated 25 September 2026.
Japan — 2021 Space Resources Act, as summarized in a 2023 UN COPUOS conference paper The UN paper describes the Act as allowing Japanese persons, including private entities, to acquire ownership of resources mined under a business activity plan tied to a license. The available description is a secondary summary, not the Japanese statutory text. It does not establish detailed applicant qualifications, procedures or current implementing requirements.
United Arab Emirates — space-sector law and UAE Space Agency materials The cited materials do not establish a resource-ownership entitlement identical to the U.S. or Luxembourg provisions. The UAE Space Agency identifies discovery of space resources as a regulated space activity and says permits are required for covered activities. It provides an online authorization process and requirements.

These approaches do not authorize mining everywhere. The U.S. provision addresses U.S. citizens; Luxembourg’s resource authorization is tied to specified legal entities and a mission; and the Japanese account available here is a high-level UN summary. The UAE materials establish permitting for covered activities, not the same express recovered-resource rule described in the U.S. and Luxembourg sources.

What permission would a mining mission need?

There is no single international authority that issues a universal asteroid-mining license. A company needs to identify the state responsible for or authorizing its activity and comply with that state’s authorization and supervision requirements. It must also determine what other approvals apply to its mission. Relevant issues can include launch, registration and liability rules; their precise requirements depend on the operator, mission and jurisdictions involved.

  1. Identify the relevant state or states. Determine which country has responsibility for the operator and mission and which authorities may regulate or authorize its activities.
  2. Check the resource rules separately from mission permits. A law recognizing rights in recovered material does not itself establish that a particular mission has been authorized.
  3. Confirm all required approvals. Luxembourg’s law expressly says resource authorization does not remove the need for other approvals. The treaty baseline also requires state authorization and continuing supervision for private activity.
  4. Plan for operational duties. Assess potential harmful interference and other states’ interests under Article IX, as well as applicable liability obligations. The Outer Space Treaty does not prescribe one complete set of mission-level procedures for these matters.

Are the Artemis Accords or proposed UN principles binding mining laws?

The Artemis Accords are cooperative political commitments, not a universal mining statute. The UAE Space Agency describes the signatories’ position that resource utilization should be consistent with the Outer Space Treaty, benefit humankind and be critical to sustainable operations. The agency’s cited signatory list is dated October 2024, so it should not be read as a current total.

Luxembourg and the Netherlands have also submitted proposed elements for recommended principles at the United Nations Committee on the Peaceful Uses of Outer Space (COPUOS). The proposals address peaceful use, sustainable technology, legal certainty, developing countries, science and state responsibility for authorization and continuing supervision. They are proposals for developing a framework, not rules adopted as binding law by all states.

What remains unsettled?

The treaty clearly prohibits sovereignty claims over asteroids and requires state authorization and continuing supervision of private space activity. Some national statutes recognize ownership of resources after extraction under specified conditions. But the treaty does not itself provide a detailed commercial title regime, and national statutes do not settle the question for all states. There is no universally binding, detailed asteroid-mining code in the cited legal materials.

For a real mission, the answer depends on its operator, responsible state, launch and registration arrangements, licenses and potential liability exposure. This overview describes the general legal framework; it does not determine whether a particular company or mission is authorized.
