TikTok Sued the U.S. Government Over a Law That Could Ban the App: What Happened Next

Short answer: TikTok and ByteDance sued in May 2024 to block the Protecting Americans from Foreign Adversary Controlled Applications Act, a law requiring ByteDance to complete a qualifying divestiture or face restrictions that would effectively remove TikTok from U.S. app stores and hosting services. The lawsuit failed: the D.C. Circuit upheld the law on December 6, 2024, and the Supreme Court unanimously rejected the First Amendment challenge on January 17, 2025.

TikTok remained available through enforcement delays and a later restructuring. On January 23, 2026, TikTok announced that its U.S. operation had moved into a majority-American TikTok USDS Joint Venture, while ByteDance retained a reported 19.9% stake. That arrangement—not a court invalidating the law—is why TikTok has continued operating in the United States.

What did TikTok sue the government over?

TikTok, ByteDance and later creator plaintiffs challenged the Protecting Americans from Foreign Adversary Controlled Applications Act. Congress enacted the measure as Division H of Public Law 118-50 on April 24, 2024, and specifically named TikTok and ByteDance.

The law prohibited app stores and internet-hosting providers from distributing, maintaining or updating a covered foreign-adversary-controlled application in the United States unless it underwent a legally sufficient “qualified divestiture.” In practical terms, ByteDance had to give up the control and operational relationships the law targeted, or TikTok would lose the infrastructure needed to remain available.

TikTok filed its principal challenge in May 2024. The creators’ claims overlapped with TikTok’s arguments but focused especially on losing a major platform for expression, community and income.

Was this a TikTok ban?

Not in the simple sense of a law making it a crime for ordinary users to possess TikTok or post videos. It was a conditional ban, or sale-or-ban mechanism:

  • ByteDance could complete a qualifying divestiture and preserve a U.S. service.
  • Without one, app stores could not legally distribute or update TikTok.
  • Hosting providers could not support the app’s continued operation in the United States.

Those restrictions would eventually make the service unavailable or unusable, even though the statute did not primarily punish individual users. The Congressional Research Service describes the mechanism as a conditional ban rather than a conventional criminal prohibition.

What was the deadline?

For the applications directly named in the law, the restrictions were scheduled to take effect 270 days after enactment: January 19, 2025. The president could grant a one-time 90-day extension if statutory conditions were met, including progress toward a qualified divestiture.

January 19 was therefore not automatically a permanent shutdown date. The practical outcome depended on whether a qualifying transaction occurred, whether an extension was granted, and whether app stores and service providers received sufficient assurance that enforcement would not expose them to liability.

TikTok warned on January 18, 2025, that it might have to go dark because its service providers lacked that assurance. The resulting interruption and availability crisis should not be confused with a final permanent ban.

Why did TikTok challenge the law?

TikTok and ByteDance’s principal legal arguments included:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • First Amendment: TikTok argued that operating and curating the platform involved protected editorial activity and that the law burdened the speech of TikTok users and creators.
  • Feasibility: The companies argued that a genuine separation of the U.S. operation, data systems and recommendation technology was not realistically achievable on the statutory timetable.
  • Targeting: The challengers objected to Congress specifically naming TikTok and ByteDance, raising concerns about unequal treatment and the law’s structure.
  • Creator and user harm: Creator plaintiffs said the law would remove a major forum for expression, community-building and commerce.

The Supreme Court identified the central question as whether the Act, as applied to the petitioners, violated the First Amendment. TikTok’s arguments were claims in litigation, not findings that the law was unconstitutional.

Why did the government defend the law?

The government said ByteDance’s relationship with China created national-security risks that ordinary corporate safeguards could not adequately address. Its concerns centered on two broad possibilities:

  • Chinese authorities could obtain sensitive information about U.S. users.
  • ByteDance’s control of TikTok’s recommendation system could create opportunities for covert influence or manipulation.

TikTok denied that Beijing could use the platform to spy on or manipulate Americans. Those allegations were central government concerns and statutory justifications; they should not be misstated as a judicial finding that TikTok had carried out espionage or content manipulation.

The government also argued that the law addressed ownership and control, not viewpoints. In its theory, a new owner could continue distributing the same videos and preserve user expression while removing the risks associated with foreign-adversary control.

What did the lower courts decide?

On December 6, 2024, the U.S. Court of Appeals for the D.C. Circuit upheld the law. The court treated the measure as addressing foreign control and national security rather than suppressing speech because of its content.

The court also reasoned that a new owner could theoretically distribute the same content. That did not mean the court proved that China had manipulated TikTok’s content. It meant the court evaluated whether Congress could impose a divestiture condition to address the national-security risks identified by the government.

What did the Supreme Court decide?

On January 17, 2025, the Supreme Court unanimously rejected TikTok’s constitutional challenge. In TikTok Inc. v. Garland, the Court held that the challenged provisions did not violate the petitioners’ First Amendment rights.

The Court emphasized the government’s interest in preventing China from collecting sensitive data from tens of millions of U.S. users. It concluded that the law did not burden substantially more speech than necessary to advance that interest.

The ruling did not say that TikTok users have no First Amendment rights. It upheld a law directed at the platform’s foreign control and the consequences for distribution, hosting and updates. The Supreme Court’s decision resolved the principal constitutional challenge; the May 2024 lawsuit is not still awaiting a trial on that issue.

What happened around January 19, 2025?

Several separate events are often compressed into the phrase “TikTok ban,” but they were legally distinct:

  1. The statutory restrictions became effective on January 19, 2025.
  2. TikTok warned that service could stop, and the app experienced a temporary availability crisis.
  3. On January 20, the incoming Trump administration directed the Justice Department not to enforce the Act for an initial 75-day period. The executive order delayed enforcement; it did not repeal the statute.
  4. Later executive actions extended the enforcement delay while a divestiture structure was negotiated.
  5. On September 25, 2025, the White House determined that a proposed structure could qualify as a divestiture under the Act.

Presidential non-enforcement decisions changed the immediate practical risk for TikTok and its service providers, but they did not erase Congress’s law.

What changed in 2026?

On January 23, 2026, TikTok announced the creation of the TikTok USDS Joint Venture LLC. According to the venture’s announcement, it is majority-American-owned, with Silver Lake, Oracle and MGX each holding 15%. ByteDance retains 19.9%.

The joint venture says it has a seven-member board described as majority-American and is responsible for:

  • U.S. user-data protection;
  • algorithm security;
  • software assurance;
  • trust and safety; and
  • content-moderation decisions.

Oracle provides the U.S. cloud environment for protected U.S. user data and algorithm-related operations. The arrangement also covers CapCut, Lemon8 and other listed applications and websites.

These details come from the joint venture’s announcement and executive-branch descriptions. They should not be read as independent proof that every safeguard is permanently effective.

Does ByteDance still own part of TikTok?

Yes, according to the joint venture announcement, ByteDance retains a 19.9% economic stake. “TikTok was sold to Americans” is therefore an oversimplification.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The important legal question is whether ByteDance or another foreign adversary still controls the U.S. operation or maintains prohibited operational relationships. Ownership percentage alone does not answer that question. Governance, voting rights, algorithm authority, data access and operational separation also matter.

What does this mean for creators and businesses?

For creators, brands and small businesses that rely on TikTok for reach, advertising or commerce, the lawsuit did not produce a court order guaranteeing the platform’s continued operation. The Supreme Court upheld the law, and TikTok’s continued availability depended on enforcement decisions and a restructuring designed to satisfy the statute.

The financial risk was therefore operational rather than simply legal: users faced the possibility of losing access, updates, audience reach and accumulated business activity if the app became unavailable. The 2026 joint venture reduced that immediate risk, but continued compliance remains important because the law itself was not repealed.

What remains uncertain?

The new structure leaves practical oversight questions that the original lawsuit did not decide:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • How independently is the recommendation algorithm controlled in day-to-day practice?
  • How are data flows and access permissions audited?
  • What authority, if any, can ByteDance exercise through its minority stake or global operations?
  • What happens if the government later concludes that the arrangement no longer satisfies the Act?
  • How does the new structure interact with separate restrictions on TikTok use on government devices?

The last question involves a different law. The No TikTok on Government Devices Act is separate from the sale-or-ban statute. In a July 16, 2026 opinion, the Justice Department’s Office of Legal Counsel said the TikTok USDS Joint Venture version does not fall under that separate federal-government-device prohibition because the venture functions independently of ByteDance, is majority-owned by American investors, and has revised its recommendation algorithm and cybersecurity program. That is an executive-branch legal opinion, not the Supreme Court’s ruling in the original case. See the OLC opinion.

The bottom line

TikTok’s 2024 lawsuit was a constitutional challenge to a conditional sale-or-ban law, not a successful case that stopped the government from acting. The D.C. Circuit upheld the law, and the Supreme Court rejected TikTok’s First Amendment challenge on January 17, 2025.

TikTok’s U.S. operation continued through enforcement delays and a later majority-American joint venture announced in January 2026. ByteDance retained a reported 19.9% stake, so the most accurate description is a U.S. restructuring designed to meet the law’s divestiture requirements—not a simple, total sale and not a court-ordered repeal of the statute.
