The European Union did not ultimately issue the more-than-$1 billion fine described in an April 2025 report. On December 5, 2025, the European Commission fined X, formerly Twitter, €120 million for three specific transparency violations. Separate Digital Services Act proceedings involving Grok and X’s recommender systems remain ongoing.
What the original report said
An April 4, 2025 report said EU regulators were considering a penalty of more than $1 billion against X and might use the case to deter other large platforms. The report, citing four people familiar with the plans, described an expected future decision—not a final fine.

Regulators were also reportedly considering corrective product changes and the possibility of a settlement if X agreed to measures addressing the alleged breaches. The phrase “make an example” referred to deterrence, not to a formal legal standard under EU law. Ars Technica’s April 2025 report attributed the political-censorship and free-speech criticism to X rather than establishing it as a legal finding.

Why a billion-dollar penalty was possible
Under the Digital Services Act (DSA), the Commission can fine a very large online platform up to 6% of its total worldwide annual turnover for certain breaches. That is a statutory ceiling, not an automatic penalty or an indication that regulators had already calculated a $1 billion fine.

The amount must be proportionate and can depend on factors such as the infringement’s nature, seriousness, duration and recurrence. The April reporting also said regulators were considering how the relevant turnover should be calculated, including whether companies linked to Elon Musk could matter. That was a reported issue under consideration—not a confirmed rule that all revenue from Musk’s companies could simply be added to X’s turnover.
The DSA can also support corrective orders and, in applicable circumstances, periodic penalty payments of up to 5% of average daily worldwide turnover for non-compliance. An exceptional restriction of access is possible only through a specific procedure after serious harm persists and other enforcement powers have been exhausted; it is not an ordinary or immediate “ban X” mechanism. The Commission’s DSA enforcement overview explains these powers.

What X was actually fined for
The Commission’s December 2025 decision focused on transparency obligations, not a blanket finding that X violated every concern discussed in the earlier reporting.
| Finding | Fine |
|---|---|
| Deceptive blue-checkmark design | €45 million |
| Advertising-repository transparency | €35 million |
| Failure to provide qualifying researchers required access to public data | €40 million |
| Total | €120 million |
According to the Commission, X’s paid blue-checkmark system could mislead users because payment did not provide meaningful identity verification. The Commission also found problems with the platform’s advertising repository and researcher access. The official announcement and decision material provide the breakdown.

Why the final fine was much smaller
Three different ideas were easy to conflate:
- The legal maximum: up to 6% of worldwide annual turnover.
- The reported possibility: a penalty that might exceed $1 billion.
- The imposed penalty: €120 million for proven violations identified in the final decision.
The available evidence does not establish the Commission’s internal calculation or explain every reason the final amount differed from the figure discussed in April. The safe conclusion is that the billion-dollar figure was a reported possibility, while €120 million was the actual announced penalty. Currency values should not be treated as direct equivalents without specifying an exchange rate and date.
Timeline of the X enforcement case
- 2023: The Commission opens formal DSA proceedings involving X.
- 2024: Preliminary findings raise concerns including the blue-checkmark design, advertising transparency and researcher access, alongside broader risk and content-related issues.
- April 4, 2025: Reporting says a fine could exceed $1 billion.
- December 5, 2025: The Commission announces the €120 million fine.
- 2026: Separate proceedings address Grok and risks associated with X’s recommender systems.
- July 16, 2026: The Commission accepts an X action plan intended to address advertising-repository and researcher-access problems.
What remains under investigation
The broader DSA scrutiny has included risk management, content moderation, dark patterns, illegal content, hate speech, disinformation and possible effects on democratic processes. Those subjects should not be presented as the basis of the completed €120 million decision unless specifically tied to a separate proceeding.

- FLEXIBLE - Three (3) 1 GbE switched (WAN/LAN/OPT) ports allow you to configure three separate 1 GbE switched ports for upto a gigabit of bi-directional traffic.
The Commission has also launched proceedings concerning Grok’s functionalities and X’s recommender systems. Its concerns include the dissemination of illegal material, including manipulated sexually explicit images and possible child sexual abuse material, and whether X properly assessed and mitigated systemic risks. These are investigations, not proof that X has been found liable. If the Commission ultimately concludes that X breached the DSA in this area, a fine of up to 6% of worldwide annual turnover and corrective measures could be available. The Commission’s investigation notice and a European Parliament answer describe the potential sanctions.

What happened after the €120 million fine?
On July 16, 2026, the Commission accepted X’s action plan. It calls for improved advertising-repository search, faster responses, more advertising information, API-based access, improved screening of researcher applications, free access for eligible researchers and terms that do not contractually prohibit eligible researchers from scraping public data.

X has six months to implement the measures and submit an audit. The action plan is a compliance step, not a blanket clearance from other DSA concerns. Commission decisions can also be challenged before EU courts, so an announced fine is not necessarily immune from judicial review.
DSA or Digital Markets Act?
This was a Digital Services Act matter, not a confirmed Digital Markets Act penalty. The DSA addresses platform safety, systemic risks, advertising transparency, researcher access and accountability. The Digital Markets Act focuses on competition rules for designated gatekeepers and their core platform services. The Commission previously concluded that the Musk Group should not be designated as a gatekeeper for X under a DMA market investigation. See the relevant EU decision.
Where the story stands now
As of August 18, 2026, the accurate headline is: EU regulators considered a potentially billion-dollar penalty for X in 2025, but the Commission ultimately announced a €120 million fine for three transparency breaches. X’s compliance obligations continue, and separate proceedings involving Grok and recommender-system risks could lead to further action—but no additional fine has been set in those matters.
