The European Union’s AI Act is now in force, but its requirements do not all start on the same date. 2 August 2026 is the Act’s general application date and the start of enforcement for provisions that apply then. Some rules began earlier; new prohibitions and high-risk system requirements have later start dates or transition periods.
What the 2 August 2026 milestone means
Article 113 of the consolidated regulation says: “It shall apply from 2 August 2026.” That is the general date, not a switch that made every duty applicable at once. The Commission’s timeline sets out earlier and later application dates, while the law and its 2026 amendment govern the precise scope and exceptions. Read the consolidated Regulation (EU) 2024/1689 and the Commission’s implementation timeline.

From 2 August 2026, enforcement applies to provisions that are applicable, including general-purpose AI obligations and transparency rules. The previously applicable prohibited-practice rules are also enforceable. The European Commission described the date as the start of enforcement for applicable rules, rather than a single start date for the whole regime. Commission FAQ: When does enforcement start? Which requirements are relevant now?
Transparency for certain AI interactions and synthetic content
The Commission identifies disclosure when people interact with certain AI systems, labeling of deepfakes, and machine-readable marking of certain AI-generated or manipulated content among the transparency requirements. These are not universal labeling rules for every use of AI: the duty depends on the provision and the system or content involved. For certain systems already on the market before 2 August 2026, the Article 50(2) marking and detection obligation has a transition deadline of 2 December 2026. Commission overview of transparency requirements.
General-purpose AI obligations
Provider obligations for general-purpose AI models began applying in 2025, and applicable requirements are enforceable from the general application date. A transition to 2 August 2027 applies to some models placed on the market before 2 August 2025. The relevant duties and transition depend on the model and provider; the timeline alone cannot determine whether a particular model qualifies. Commission implementation timeline.

Why the high-risk dates matter
“High-risk” is a legal category, not a general description for any AI that could cause harm. The Act distinguishes, among other things, systems covered by Annex III from AI embedded in products covered by Annex I. The former category’s rules apply from 2 December 2027; the latter’s delayed date is 2 August 2028. Classification and applicable duties depend on the statutory scope and use case, so an organization should not assume that an AI system is or is not high-risk based on its product label alone. Who has responsibilities under the Act?
The Act identifies operators including providers and deployers, but their duties vary with their role, the system or model, and how it is used. It does not give every person who uses an AI tool the same compliance obligations. Enforcement is also divided: the AI Office has exclusive powers for specified general-purpose AI matters and certain systems related to designated very large online platforms or search engines; Member State authorities enforce relevant provisions as well. A practical first check for an organization
- Identify whether the organization acts as a provider, deployer, or another operator under the Act.
- Inventory the AI system or model and the way it is used, rather than relying only on a vendor’s marketing description.
- Map the system, role and use case to the applicable provision, application date and any transition in the consolidated regulation.
- Check the competent enforcement authority and any sector-specific obligations that apply to the organization.
