Questions to Ask Before Buying an Employer Health Benefit Plan

By TheFinanceBase Team 13 min read

Do not choose an employer health plan from the premium quote or a national network count alone. Before signing, obtain the plan’s governing documents, test its costs against the same scenarios, verify that employees can reach the doctors and facilities they use, and assign every enrollment, claims, notice, and compliance responsibility in writing.

The questions below give an HR or benefits decision-maker a repeatable diligence process for comparing proposals and renewing coverage. Federal protections provide a baseline, but the final answer depends on the plan documents, employee locations, provider participation, state requirements, and the employer’s funding arrangement.

Start with a complete proposal packet

Ask the broker, insurer, or plan administrator to provide the current documents for every plan option before you compare prices. A quote or marketing summary is not enough to establish what the plan will pay.

  • Summary of Benefits and Coverage (SBC): This is the plain-language, standardized comparison document for a job-based plan. HealthCare.gov describes the right to an easy-to-understand summary of a health plan’s benefits and coverage.
  • Uniform Glossary: Use it to confirm the meaning of terms such as deductible, coinsurance, copayment, out-of-pocket limit, and allowed amount.
  • Certificate of coverage or full plan document: Read this for definitions, exclusions, authorization rules, claim procedures, continuation provisions, and limitations that cannot fit in the SBC.
  • Riders, amendments, schedules, and formularies: These can change benefits, drug coverage, eligibility, or administrative duties.
  • Provider directory and network materials: Request location-specific information rather than relying on a national network label.
  • Administrative and service agreements: Identify who performs enrollment, eligibility, claims, appeals, notices, customer support, and reporting.

Ask for the document version and effective date. A plan can change at renewal, and an old SBC or directory may not describe the coverage employees will actually receive.

Questions to put to the vendor

  • Can you provide the current SBC, Uniform Glossary, certificate or plan document, formulary, and every rider or amendment for each option?
  • Which document controls if the proposal, SBC, directory, and certificate appear to conflict?
  • When will employees receive the SBC and other required notices, and who is responsible for distribution?

What services are covered, limited, or excluded?

Use the SBC to make an initial comparison, then use the full plan terms to test the situations most likely to matter to your workforce. The SBC standardizes fields such as deductibles, copayments, coinsurance, exclusions, and other cost and coverage information. It also includes standardized coverage examples for diabetes care and childbirth. Those examples make proposals easier to compare, but they are not a promise of an employee’s actual bill.

Build a coverage inventory

For each option, record whether a service is covered, subject to a deductible, subject to a copayment or coinsurance, limited to a number of visits, subject to prior authorization, or excluded. Pay particular attention to:

  • Primary care, specialist care, urgent care, emergency care, hospital admission, outpatient procedures, and ambulance services.
  • Behavioral-health and substance-use-disorder treatment, including the provider types and facilities available in each employee location.
  • Prescription drugs, formulary tiers, specialty drugs, step therapy, quantity limits, prior authorization, and mail-order requirements.
  • Maternity, newborn, infertility, reproductive, and pediatric services where relevant to the workforce.
  • Physical, occupational, and speech therapy; durable medical equipment; home health; hospice; and skilled nursing.
  • Preventive services and the conditions under which they are available without cost-sharing.
  • Telehealth, virtual behavioral-health services, clinical programs, and any vendor carve-outs.

Ask about the rules behind the benefit

  • Which services require a referral or prior authorization, and who makes the decision?
  • What happens when an authorization is denied, delayed, or approved for fewer services than the treating clinician requested?
  • Are there annual, lifetime, episode, visit, or dollar limits? Are any limits different for in-network and out-of-network care?
  • How are experimental, investigational, reconstructive, fertility, bariatric, and genetic services defined?
  • Are benefits coordinated with another employer plan, Medicare, Medicaid, workers’ compensation, or automobile coverage?

How much will the employer and employees actually pay?

Compare the full cost of coverage, not just the premium. For each coverage tier—employee only, employee plus spouse, employee plus child or children, and family—calculate the employer contribution, employee payroll deduction, deductible, copayments, coinsurance, and in-network and out-of-network out-of-pocket limits.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Separate fixed premiums from care-related exposure

The employer’s annual premium or expected claims cost is only one part of the decision. Employees may face substantially different costs when they use care. Capture at least these figures for every option:

  • Annual employer premium or projected claim funding cost at expected enrollment.
  • Employee payroll contribution for every coverage tier.
  • Individual and family deductibles, including whether a family deductible is embedded or aggregate.
  • Primary-care, specialist, urgent-care, emergency-room, hospital, and prescription copayments.
  • Coinsurance percentages and the allowed-amount basis used to calculate them.
  • Individual and family out-of-pocket maximums, and which expenses do not count toward them.
  • Out-of-network deductible, coinsurance, balance-billing exposure, and out-of-network maximums.

Use consistent scenarios, then model your workforce

Use the SBC’s diabetes-care and childbirth examples as common comparison points across proposals. Do not treat those examples as a forecast of your population’s spending. Build a separate model using your enrollment by tier, employee locations, age distribution where appropriate, expected utilization, chronic-condition programs, specialty-drug use, and prior claims information that can lawfully be used for plan analysis.

Show at least three scenarios: a low-use employee, a typical family using routine care, and a high-use household with hospitalization or specialty treatment. State the assumptions, such as number of visits, negotiated rate, drug tier, and whether the deductible has been met. If a vendor supplies a projection, ask who produced it, the data period, and whether it includes administrative fees, taxes, stop-loss premiums, or other charges.

Questions about affordability

  • What is the employer’s total annual cost at the enrollment level used in the quote?
  • What will an employee pay per pay period and per year for each coverage tier?
  • How do employee and employer costs change under low-use, typical-use, and high-use scenarios?
  • Which services or drugs have costs that an employee cannot estimate from the SBC?
  • Are there separate deductibles or out-of-pocket limits for medical, pharmacy, behavioral health, or out-of-network care?

Can employees reach the clinicians and facilities they use?

A broad network headline does not establish access for your workforce. Verify participation for the hospitals, primary-care doctors, specialists, behavioral-health clinicians, pharmacies, laboratories, and urgent-care facilities employees actually use. Perform the check for every employee location, including remote workers and locations where dependents live.

Verify participation directly

Ask the vendor for a dated directory and a method for confirming participation. Check the provider’s name, address, specialty, facility affiliation, and network tier. A negotiated rate organized by provider network can help an employer compare networks and benchmark costs, as described by the U.S. Department of Labor. A negotiated rate does not, by itself, prove that a particular provider is currently participating, so confirm both the rate information and participation status.

Test access beyond a directory count

  • How many in-network primary-care, specialty, behavioral-health, pediatric, and maternity providers are available within a reasonable distance of each employee concentration?
  • Are the hospitals used for planned procedures and emergency care in network?
  • Are major laboratories, imaging centers, pharmacies, and infusion facilities in network?
  • How often does the directory change, and how quickly are employees notified when a provider leaves?
  • What happens when an employee’s provider leaves the network during an active course of treatment?
  • Does the plan offer continuity-of-care or transition-of-care rights, and what documentation and deadlines apply?

Understand out-of-network and emergency treatment

Document the out-of-network deductible, coinsurance, reimbursement basis, balance-billing risk, and claim process. Ask how the plan handles an out-of-network clinician at an in-network facility. The Department of Labor summarizes federal protections that include emergency services at an out-of-network hospital emergency department without prior approval, subject to applicable requirements. Confirm the plan-specific process, member cost-sharing, and notice obligations in the governing documents rather than relying on a general description.

Can anyone estimate the cost before care?

Ask for a live demonstration of the plan’s personalized cost-estimate tool using common services such as an office visit, MRI, childbirth, outpatient surgery, emergency care, or a specialty drug. Department of Labor transparency guidance describes personalized cost-sharing estimates available online, on paper upon request, and by phone for plans and issuers subject to the requirements.

Questions for the demonstration

  1. Enter a real in-network provider and service, then show the negotiated or allowed amount.
  2. Show how the estimate changes when the provider is out of network, the deductible is unmet, or the service requires prior authorization.
  3. Display the member’s remaining deductible and out-of-pocket balance, and explain how the system obtained those figures.
  4. Request the same estimate online, on paper, and by phone to test whether the channels provide consistent answers.
  5. Ask what happens when the provider, code, facility, or drug is missing from the tool.

Request information about the data used to create estimates and how quickly claims, deductible balances, provider changes, and negotiated rates are updated. The employer can also ask how negotiated-rate data is organized by network and how it can be used to compare network costs or discuss administrator performance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Who handles claims, appeals, and member support?

Identify the claims administrator and every party that touches a claim. Employees should know where to call, where to submit documents, how to check status, and how to escalate a problem.

Map the service model

  • Who processes medical and pharmacy claims?
  • Who handles eligibility, enrollment corrections, dependent verification, and coordination of benefits?
  • What are member-service hours, languages, accessibility channels, and response-time standards?
  • Is there a dedicated employer account team? Who is the escalation contact when a claim or access issue is unresolved?
  • What reports will the employer receive, at what frequency, and with what privacy safeguards?

Document claims and appeal deadlines

The Department of Labor lists internal claims and appeals and external review among Affordable Care Act protections. Ask the administrator to identify the plan-specific procedures, forms, submission methods, decision deadlines, and required notices. Confirm where those rules appear in the plan document and what happens if a deadline falls on a weekend, holiday, or period when records are unavailable.

  • What information must an employee submit for a claim, reconsideration, expedited review, or external review?
  • Who pays for an external review, and which cases are eligible?
  • How are urgent-care appeals handled while treatment is pending?
  • How does the employer track unresolved complaints, repeated denials, network-access problems, and turnaround times?

What administration and compliance work remains with the employer?

Obtain a written responsibility matrix. Do not assume that hiring a carrier or third-party administrator transfers every obligation.

Task Questions to assign in writing Evidence to retain
Enrollment and eligibility Who enrolls employees, updates eligibility, verifies dependents, handles life events, and corrects payroll deductions? Eligibility files, change records, confirmation notices, and reconciliation reports
Required notices Who prepares, distributes, translates, and tracks required notices, including the SBC and appeal decisions? Notice versions, distribution dates, delivery records, and returned-mail process
Claims and appeals Who receives claims, issues determinations, manages internal appeals, and coordinates external review? Procedures, deadlines, templates, service-level reports, and escalation logs
Renewal and amendments Who supplies renewal documents, revised SBCs, plan amendments, and employee communications? Final contracts, signed amendments, effective dates, and communication calendar
Data and reporting Who owns plan data, who may access it, how is it protected, and what reports are available to the employer? Data-use terms, security commitments, reports, and retention or deletion terms
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

Which federal and state rules apply?

Federal materials are a starting point, not a complete legal determination. The Department of Labor summarizes protections that include dependent coverage through age 26, protections against preexisting-condition exclusions, certain preventive services without cost-sharing, and emergency services at an out-of-network hospital emergency department without prior approval, subject to applicable requirements. Ask a qualified benefits adviser or counsel to confirm how those rules apply to your employer, plan type, workforce, and states of operation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Questions to resolve before approval

  • Which federal requirements apply to this employer and plan?
  • Which state insurance, continuation, mandated-benefit, telehealth, pharmacy, paid-leave, or notice rules apply where employees and dependents reside?
  • Does the employer’s size, funding method, governmental status, union arrangement, or plan design change the analysis?
  • What compliance calendar covers enrollment, notices, renewals, filings, audits, and employee communications?

Transparency implementation details are time-sensitive; the Department of Labor describes 2026 updates in its transparency guidance. Require the administrator to identify the current implementation requirements and the date on which each obligation will be met.

How is the plan funded, and who bears the risk?

Ask whether each proposal is fully insured, self-funded, or level-funded. Then identify who bears claims risk, how stop-loss protection works, who owns and can access plan data, and what termination, run-out, and outstanding-claim obligations apply. Do not assume that one funding model is inherently cheaper or safer; the contract determines the practical risk.

Funding questions

  • Who pays claims and administrative expenses?
  • What are the specific attachment points, exclusions, and renewal terms for stop-loss protection?
  • Can the employer receive claims, utilization, and negotiated-rate information needed to monitor the plan?
  • What happens to unpaid claims, reserves, refunds, credits, and overpayments if the contract ends?
  • Which fees are fixed, per employee, percentage-based, or dependent on claims performance?

Have a qualified benefits adviser review the actual funding, stop-loss, trust, and administrative contracts. A sales summary cannot establish the employer’s ultimate exposure.

If an HSA or HRA is offered, check the account rules

Ask whether the proposal includes a Health Savings Account (HSA) or Health Reimbursement Arrangement (HRA), and obtain the account agreement separately from the medical plan document.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • For an HSA, confirm that the medical plan is HSA-compatible and that employees meet the applicable eligibility requirements. HSA contributions require high-deductible health plan coverage; do not rely on a payroll or sales illustration for tax eligibility.
  • For an HRA, ask who funds the account, which expenses are reimbursable, whether unused amounts roll over, and what happens when an employee changes coverage or leaves.
  • For either arrangement, document employer contribution timing, employee elections, account ownership, claims substantiation, debit-card rules, privacy, fees, and tax reporting.

Have the current-year eligibility and tax treatment reviewed before communicating contribution amounts. The requirements and thresholds can change, and an account feature does not automatically make a plan affordable or suitable.

Compare proposals with a documented decision matrix

Use the same evidence standard for every option. The six comparison axes below synthesize the standardized SBC fields, transparency materials, and federal protections; they are a practical employer worksheet, not an official ranking formula.

Axis What to compare Proof to request
Employer and employee cost Premium or projected funding cost, payroll contributions, fees, and scenario-based exposure Rate sheets, enrollment assumptions, SBC examples, and a written cost model
Cost-sharing exposure Deductibles, copayments, coinsurance, out-of-pocket limits, pharmacy terms, and exclusions SBC plus governing plan terms and formulary
Network and access Provider participation and geographic access for each employee location, including behavioral health and hospitals Dated directories, participation confirmation, access reports, and out-of-network rules
Coverage and drug terms Covered services, limits, authorization, preventive care, emergency treatment, and specialty-drug requirements Certificate, amendments, medical policies, and formulary
Claims and service quality Support channels, response times, denials, appeals, external review, and complaint escalation Service standards, sample reports, procedures, and escalation contacts
Employer administration Enrollment, notices, data access, reporting, compliance, renewal, and termination duties Responsibility matrix, administrative agreement, calendar, and data terms

Score only what the documents establish. If a vendor has not supplied a value, label it “not stated” in your internal worksheet and make the missing item a condition of final approval rather than filling the gap with an assumption.

A practical buying and renewal sequence

  1. Describe the workforce: List employee and dependent locations, coverage tiers, remote-work patterns, commonly used providers, expected access needs, and budget constraints.
  2. Issue a uniform question set: Send every broker, carrier, or administrator the same document, network, cost, service, funding, and compliance questions.
  3. Collect and version the evidence: Save the SBC, glossary, plan documents, directories, formularies, rate sheets, agreements, and effective dates for each option.
  4. Verify access: Check key clinicians, hospitals, pharmacies, behavioral-health providers, laboratories, and facilities in every relevant location.
  5. Model costs: Compare employer and employee fixed costs, then run low-use, typical-use, and high-use scenarios using consistent assumptions.
  6. Demonstrate estimation and service: Test the personalized cost tool, member phone support, claims submission, status checking, and escalation path.
  7. Review legal and funding terms: Confirm federal and state applicability, funding risk, stop-loss terms, data rights, account arrangements, and termination obligations.
  8. Resolve gaps in writing: Obtain corrected documents or signed answers for every unresolved exclusion, network question, fee, deadline, or responsibility.
  9. Approve and communicate: Record the decision, preserve the final documents, publish employee-facing costs and access instructions, and schedule a post-enrollment review.

Warning signs that require more diligence

  • A proposal supplies a premium but no current SBC, full plan document, formulary, or effective date.
  • A vendor cites a large national network without confirming providers near employee homes and workplaces.
  • A negotiated rate is presented as proof that a clinician participates in the network.
  • Out-of-network reimbursement, balance billing, emergency treatment, or continuity of care is not explained.
  • The cost-estimate tool cannot show deductible status, allowed amount, provider identity, or what happens when data is missing.
  • No individual or team is named for claims, appeals, enrollment corrections, notices, or escalation.
  • Funding, stop-loss, data ownership, run-out, or termination terms are described only verbally.
  • Employee contributions are compared across different coverage tiers or without showing deductible and out-of-pocket exposure.
  • The vendor cannot identify the current implementation date for time-sensitive transparency duties.
