Lyft to Pay $2.1 Million to Settle Allegations It Misled Drivers About Earnings

Lyft agreed to pay a $2.1 million civil penalty under a federal settlement resolving allegations that it misled prospective drivers about how much they could earn. Regulators said some recruitment ads used hourly figures based on the top 20% of drivers, included tips without making that clear, and presented “earnings guarantees” in ways that could make them look like extra bonuses.

The money is payable to the U.S. government—not a compensation fund for Lyft drivers. The case concerned advertising practices primarily from 2021 and 2022, so it does not establish what a typical Lyft driver earns today.

What Lyft advertised

The Federal Trade Commission said Lyft advertised “up to” hourly earnings in particular markets, including:

  • Atlanta: up to $33 per hour
  • Portland: up to $41 per hour
  • Los Angeles: up to $43 per hour

According to the FTC’s complaint, the figures were based on the earnings of Lyft’s top one-fifth of drivers, rather than typical driver results. The FTC said the presentation could overstate the earnings achieved by most drivers by as much as 30%.

That allegation does not mean no driver earned those amounts. It means regulators challenged the way the figures were selected and presented. An “up to” figure may describe an upper-percentile result, but it is not the same as a median, typical, or expected result.

The FTC also alleged that some hourly claims included passenger tips. A driver could reasonably understand an advertised hourly amount as money paid by Lyft, with tips coming on top, even if tips were already included in the number.

The FTC described the advertising allegations and examples in its October 2024 announcement.

Why Lyft’s earnings guarantees drew scrutiny

The complaint also challenged the way some incentive offers were described. One example promised drivers could make $975 for completing 45 rides over a weekend.

Regulators alleged that this operated as a guarantee of total qualifying earnings—not necessarily a $975 bonus paid on top of ordinary ride earnings. For example:

Item Amount
Advertised guarantee $975
Driver’s qualifying earnings $775
Additional amount needed to reach the guarantee $200

Under the mechanism described in the complaint, the driver would receive the $200 difference, not $975 plus the original $775. This is an illustration of the structure regulators described, not a claim about every Lyft promotion.

For any guarantee, drivers need to check the fine print for the required number of rides, dates, eligible locations, qualifying earnings, treatment of tips, and whether ordinary earnings reduce the additional payment.

What the settlement requires

The U.S. Department of Justice announced that a federal court entered the stipulated order on November 1, 2024. The order requires Lyft to:

  • Pay a $2.1 million civil penalty.
  • Avoid unsupported or misleading claims about driver earnings.
  • Have meaningful evidence for earnings claims.
  • Base claims on typical earnings rather than unusually high-performing drivers.
  • Clearly disclose material conditions attached to earnings guarantees.
  • Provide appropriate disclosure when hourly earnings claims include tips.
  • Send a specified notice to drivers through the Lyft app.
  • Meet monitoring, reporting, and other compliance requirements.

The order required the driver notice to be published in the app within 30 days of entry and kept available for 60 days from its initial publication. The stipulated order contains the payment and compliance requirements.

Do Lyft drivers receive part of the $2.1 million?

No direct driver payout is identified in the settlement documents. The $2.1 million is described as a civil penalty payable to the United States Treasury. It is not described as restitution, redress, or a fund that individual drivers can claim.

A civil penalty is paid to the government to punish or deter unlawful conduct. Restitution or consumer redress is designed to compensate people who suffered a loss. This resolution is documented as a civil-penalty settlement, so drivers should not assume they can file a claim for part of the money.

The DOJ’s settlement announcement and the order identify the payment as a civil penalty.

Was Lyft found guilty or forced to admit it lied?

This was a civil enforcement resolution, not a criminal fine or criminal conviction. Lyft agreed to settle the government’s allegations. That wording is more precise than saying Lyft admitted every allegation or that the government proved every advertised rate was impossible.

The DOJ filed the federal action after the FTC’s involvement and described the resolution as a stipulated order. The order provides that facts in the complaint would be treated as true in later proceedings to enforce the payment or judgment, but that is not the same as a broad admission of intentional fraud for every purpose.

What the case says—and does not say—about Lyft pay

The proceeding addressed recruitment advertising and incentive disclosures during a historical period. It does not establish a current nationwide Lyft hourly rate, and it does not show that every driver earned 30% less than an advertised figure.

Driver income can vary substantially by city, demand, time of day, season, ride volume, cancellations, and promotional eligibility. A driver’s actual financial result also depends on:

  • Fuel or charging costs
  • Maintenance, repairs, and depreciation
  • Insurance and vehicle financing
  • Taxes and licensing costs
  • Unpaid time waiting for or traveling between rides
  • Whether the calculation uses engaged time or all time online

Advertised earnings are generally not the same as wages, take-home pay, or net profit. A meaningful comparison should identify whether a figure includes fares, tips, bonuses, or only selected driving time—and whether vehicle expenses have been deducted.

Timeline

  • At least January 2021: The complaint alleged Lyft began disseminating certain challenged earnings advertisements.
  • 2021–2022: The FTC identified this as the principal period for the advertising claims at issue.
  • October 25, 2024: The FTC announced its action and the proposed resolution.
  • November 1, 2024: The DOJ said the federal court entered the stipulated order.
  • 2026: The historical claims should not be treated as current Lyft pay rates without separate, current evidence.

The FTC case page has displayed a “Pending” label associated with its October 25, 2024 update, while the DOJ says the court entered the stipulated order on November 1. Those different page statuses do not change the payment and requirements described in the federal resolution.

How to evaluate a rideshare earnings claim

Before treating a recruitment offer as a realistic income estimate, ask:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Is the number typical? Look for median or representative earnings, not only “up to” results.
  2. Which drivers are included? A top-percentile sample can be achievable but unrepresentative.
  3. Are tips included? Determine whether tips are additional or already built into the headline number.
  4. Is the figure gross or net? Subtract fuel, charging, maintenance, depreciation, insurance, taxes, and unpaid time.
  5. What time is counted? “Engaged time” may exclude waiting between rides.
  6. What does a guarantee actually guarantee? Check whether it is a floor that covers only the shortfall or a separate bonus.
  7. What conditions apply? Confirm the ride count, time window, location, eligible trips, and deadline.

Lyft’s settlement is a reminder that the most important number in a gig-work advertisement is not always the largest number displayed. The methodology and conditions determine whether an advertised amount is a realistic expectation or merely an upper-end possibility.

Lyft characterized the matter as involving certain advertisements from 2021 and 2022 in its company response.
