The decision concerns Assessment Years 2010-11 and 2011-12 and an export undertaking, so it should be applied cautiously outside comparable facts.
What the Karnataka High Court decided
Taxscan reported on 15 October 2026 that the Karnataka High Court upheld the Income Tax Appellate Tribunal’s treatment of disputed employee recoveries and liability write-backs as income under the business-income head. The reported citation is 2026 TAXSCAN (HC) 1686.

The Revenue had challenged the tribunal’s conclusion, arguing that these receipts were not sufficiently connected with the assessee’s export turnover and were not incidental to the export business. The High Court rejected that challenge on the facts reported, leaving the business-income treatment in place for the relevant assessment years.

Section 28 of the Income-tax Act is the statutory starting point. The Income Tax Department’s official text provides that “The following income shall be chargeable to income-tax under the head ‘Profits and gains of business or profession’” and includes profits and gains of any business or profession carried on by the assessee during the previous year.
#1 Best Overall
That wording does not automatically convert every receipt recorded by a business into business income. The practical question is whether the receipt arose from, or was sufficiently connected with, the business carried on by the taxpayer. In Technotree Convergence, the reported answer was favourable to the assessee despite the Revenue’s objection that the receipts did not directly increase export turnover.
What types of receipts were involved?
Employee recoveries
The ruling concerns amounts recovered from employees in the course of the employer’s operations. The report does not establish that every payroll deduction, disciplinary recovery, loan recovery or employment-related receipt has the same tax treatment. The underlying employment terms, recovery agreement, reason for the debit and accounting entries remain important.

Liabilities written back
A liability write-back occurs when an amount previously recognized as payable is later reversed, for example because the obligation is settled for less, no longer enforceable or otherwise ceases to be payable. The reported holding indicates that such a write-back can form part of business income in the relevant circumstances. It does not decide the treatment of every reversal in every industry or accounting situation.
The export-business nexus dispute
The assessee operated an eligible export undertaking. The Revenue’s position was that employee recoveries and written-back liabilities lacked the required nexus with export turnover and therefore should not receive the business-income treatment relied on by the assessee.
Rank #3
The reported outcome shows that a receipt need not necessarily be an export sale proceeds item to be regarded as connected with the business. However, the decision is fact-specific: the court was considering incidental receipts recorded by an operating export business, not an abstract rule that all ancillary collections qualify. Taxpayers should therefore identify the operational link between the receipt and the undertaking rather than rely only on its ledger label.
How taxpayers should analyse a similar receipt
- Identify the legal source. Check the employment contract, employee undertaking, policy, settlement or vendor document that created the right to recover the amount.
- Trace the accounting history. Match the original expense, payable or provision with the later recovery or write-back and retain journal entries, invoices and approval records.
- Map the business connection. Explain how the amount arose from activities of the business or the eligible undertaking, including the personnel and functions involved.
- Separate categories. Analyse employee recoveries and liability reversals independently; they may have different contractual and accounting origins.
- Check the assessment year. The reported case concerns 2010-11 and 2011-12. Confirm the law, exemption or deduction regime and later judicial developments applicable to the year under review.
- Review linked taxes separately. The report does not resolve withholding-tax, GST, salary-income or employment-law questions. Those issues require their own analysis.
What the ruling does not establish
- It is not a blanket rule for every deduction from an employee’s pay.
- It does not mean every liability write-back automatically qualifies as business income or as income eligible for an export-linked deduction.
- It does not remove the need to prove the receipt’s connection with the relevant business activity.
- It does not settle the treatment under law applicable after the two assessment years before the court.

What businesses should document now
Companies taking a similar position should preserve contemporaneous evidence showing why the recovery or reversal arose. Useful records include the employee policy or agreement, correspondence approving the recovery, payroll or receivable ledgers, the original provision or payable, reversal calculations, and a note linking the item to the undertaking’s ordinary operations. Consistent presentation in the tax return, financial statements and audit working papers can also help demonstrate that the treatment was not created solely for a tax claim.

Can a liability write-back qualify for an export-linked tax benefit?
The report supports business-income treatment in the assessee’s circumstances, but it does not automatically establish eligibility for every export-linked deduction. The statutory conditions for the relevant year must be checked separately.
Which years were decided in Technotree Convergence?
The reported proceedings concerned Assessment Years 2010-11 and 2011-12. Later law and subsequent appellate decisions may affect current positions.
