For many employment-based adjustment applicants, the American Competitiveness in the Twenty-First Century Act (AC21) portability rule permits a move after the Form I-485 has been pending for at least 180 days, if the underlying employment petition and the proposed job meet specific conditions. The new position generally must be in the same or a similar occupational classification, and the portability request is made with Form I-485 Supplement J.
The 180-day period is counted from the I-485 receipt date, not from the I-140 filing date or the day you started looking for another job. Because category, petition status, job duties and case history can change the result, use the steps below to verify your position before resigning or accepting a new offer.

What must be true before a job change can use portability?
USCIS describes portability for certain applicants with employment-based immigrant visa petitions in the first, second and third preference categories. The standard pathway has several conditions that must line up at the same time:

- Your employment-based Form I-485 has been pending for at least 180 days.
- You have a qualifying underlying I-140 petition, either already approved or pending in a posture that the regulation permits when you notify USCIS of the new offer.
- The proposed permanent job is in the same or a similar occupational classification as the job described in the underlying petition.
- You and the intended employer demonstrate an intention that the employment will begin, or continue, within a reasonable period after permanent residence is granted.
- You submit the portability request through Form I-485 Supplement J when the current USCIS instructions call for it.
These are eligibility requirements, not a guarantee that USCIS will approve a particular case. A case can require a different analysis if the applicant changes the employment-based category, relies on an excluded petition type, or has an I-140 withdrawal or revocation issue.

Start with the case facts, not the job title
Before giving notice, assemble the documents that establish what is actually pending. A job-change decision based only on a title such as “engineer,” “manager” or “analyst” can be misleading because portability compares the work and its essential occupational qualities.
Identify the employment-based category
Confirm whether the adjustment case is based on an employment-based first-preference, second-preference or third-preference petition, and identify the specific subcategory. USCIS policy describes AC21 portability for certain applicants in those preference categories, but it also identifies exceptions. In particular, petitions based on extraordinary ability and national-interest waivers of the job-offer and labor-certification requirements are not handled under the ordinary portability route described for a conventional employer-sponsored case.
National-interest-waiver physicians have separate employment and service rules. USCIS policy states that they are not eligible for AC21 portability; their ability to change employers or become self-employed depends on the physician-specific NIW requirements instead.

Find the I-140 receipt or approval notice and determine whether the petition is approved, still pending, withdrawn or revoked. Do not assume that a pending I-485 by itself creates portability rights. The regulation allows a qualifying I-140 to be pending when the beneficiary gives USCIS notice of the new offer after the I-485 has reached the 180-day threshold, but the petition must later be approved and the regulation’s other conditions must be satisfied. The Supplement J instructions likewise caution that USCIS must adjudicate and approve a pending I-140 before approving portability.
| I-140 posture | What it means for planning | What to verify |
|---|---|---|
| Approved | This is the clearest posture for a standard portability analysis, assuming the I-485 has been pending at least 180 days and the new job is same or similar. | Approval notice, preference category, and whether USCIS has issued any later notice affecting the petition. |
| Pending | The regulation can permit notice of a new offer after the 180-day I-485 threshold, but portability approval remains dependent on later I-140 approval and the applicable conditions. | Receipt notice, petition status, whether the petition remains approvable, and the current Supplement J instructions. |
| Withdrawn | Do not presume the ordinary portability route remains available. The effect depends on when and how the withdrawal occurred and on the petition’s history. | Withdrawal date, USCIS notices, and whether another qualifying basis exists. |
| Revoked or subject to revocation action | A revocation can materially change the foundation of the adjustment case and cannot be resolved by the 180-day count alone. | The revocation or notice-of-intent documentation and the current case posture. |
Calculate the 180-day I-485 period correctly
The threshold is tied to the pending I-485. Use the receipt date printed on the I-485 receipt notice and the case record, not the I-140 filing date, priority-date movement, employment start date or the date you began interviewing.
- Locate the I-485 receipt notice and record the receipt date exactly as printed.
- Determine the date on which at least 180 days will have elapsed from that receipt date.
- Check for any transfer, refiling or category-change event that could affect which I-485 is being counted.
- Do not file a portability Supplement J before the I-485 has been pending at least 180 days; the current USCIS instructions specifically caution against an early filing.
- Preserve the receipt notice and the case-status history so you can show how the date was calculated.
For a real case, treat the date as a document-based calculation. An online estimate, a payroll start date or an assumption that an I-140 filing started the clock is not a substitute for the I-485 receipt date.
Compare the two jobs by occupational substance
The legal test is not whether the employers are in the same industry or whether the titles look alike. The regulation at 8 CFR 245.25 defines a similar occupational classification as one that “shares essential qualities or has a marked resemblance or likeness” to the occupation for which the underlying petition was approved. “Same” is assessed by resemblance in every relevant respect.

Build a side-by-side duty record
Write down the actual work described in the original petition and the proposed permanent position. Include the principal responsibilities, the type of work performed, the essential skills and the occupational level. Then identify where the positions overlap and where they differ. A title match alone does not establish eligibility, and the sources do not create a salary-match shortcut.
| Comparison area | Questions to answer | Evidence to retain |
|---|---|---|
| Actual duties | What work occupies the role, and which duties are essential rather than incidental? | Original petition description, new offer letter and detailed duty statements. |
| Occupational classification | Do both roles share the same essential occupational qualities or a marked resemblance? | Plain-language comparison prepared from both job descriptions and any classification information used by the employer. |
| Skills and responsibilities | Do the roles rely on materially related knowledge, tools, methods or professional responsibilities? | Required qualifications, project descriptions and responsibility summaries. |
| Permanent-job intent | Does the new employer intend to employ you in the offered role within a reasonable period after residence is granted? | Signed offer documentation and the employer’s confirmation through the current Supplement J process. |
Because the individual comparison cannot be resolved without both job descriptions, ask the original and prospective employers for complete, consistent descriptions rather than relying on a one-line title. Keep copies of the versions used for the filing; later changes in duties can create questions about what was actually offered.
Use Form I-485 Supplement J at the right time
Supplement J is the filing mechanism USCIS uses for an employment offer confirmation and for a portability request. The current form instructions identified for this topic are the edition dated 04/01/24. Follow the instructions in effect when you file for the required edition, signatures, evidence, filing location and any fee information.
When a portability Supplement J is appropriate
Do not send a portability Supplement J before the I-485 has been pending for 180 days. Once the threshold is met and the job appears to qualify, submit the form in the procedural posture specified by the current USCIS instructions. USCIS can also request Supplement J even when you have not initiated a job change, to confirm that an underlying offer remains bona fide and available.
What to prepare before filing
- I-485 receipt notice showing the receipt date.
- I-140 approval notice or receipt notice, as applicable.
- The original offered-position description from the petition record.
- A detailed description and offer letter for the proposed permanent position.
- A written comparison of duties and essential occupational qualities.
- Employer information and signatures required by the current Supplement J instructions.
- Copies of relevant USCIS notices, including any notice concerning the I-140 or transfer of the adjustment basis.
Use only the current USCIS form instructions for filing mechanics. Do not rely on an older address, an outdated edition or a checklist copied from a different case type.
Understand category changes and transfers of the underlying basis
One of the most important timing traps is transferring a pending I-485 to a different employment-based category based on a new I-140. USCIS policy explains that, in this situation, the portability period is measured from the transfer request. A transfer can therefore change the date that controls the 180-day analysis.

Before accepting a new category
- Identify the I-485 currently pending and the employment-based category supporting it.
- Determine whether the proposed new I-140 would replace the basis of that I-485 or merely supplement the existing record.
- Ask when USCIS would treat the transfer request as made.
- Recalculate the portability period from the applicable transfer date rather than assuming the original I-485 receipt date will always control.
- Confirm that the new category is not one of the exceptions to ordinary AC21 portability.
Do not present a category transfer as a routine employer change. It can alter both the legal basis and the timing of the case.
A practical sequence for changing employers
1. Freeze the key dates and notices
Create a case timeline with the I-485 receipt date, I-140 receipt and approval dates, any transfer request, any withdrawal or revocation notice, and every USCIS request for evidence or interview notice. Save the notices in a location you can access even if you leave the current employer.
2. Confirm that the 180-day threshold has elapsed
Use the I-485 receipt date and count elapsed time from that filing. If the threshold has not been reached, avoid treating the prospective job as portable under the standard rule. The fact that an employer is willing to sponsor you or that an I-140 has been pending for a long time does not replace the I-485 requirement.
3. Obtain complete descriptions of both positions
Request the original petition’s duty description and a detailed description of the new permanent role. Compare essential duties and occupational qualities, not just title, salary or employer name.
4. Screen for exceptions
Check the preference category, whether the petition is based on extraordinary ability or a national-interest waiver, whether the case involves an NIW physician, and whether the I-485 basis is being transferred. Any of these facts can move the case outside the ordinary 180-day portability analysis.
5. Coordinate the Supplement J filing
After the threshold is met, prepare and submit Supplement J according to the current instructions. Keep a complete copy of what was filed and proof of delivery. If USCIS sends a request for Supplement J or confirmation of the offer, respond by the deadline stated in the notice.

6. Keep the intended employment credible
The rule concerns a prospective permanent job offer. You and the employer must demonstrate an intention for employment under the continuing or new offer within a reasonable period after permanent residence is granted. Keep the offer active and notify the employer and your representative if the role, duties or availability changes.
7. Monitor the case after the move
Continue checking USCIS notices and preserve address and contact updates as required by the agency. A job change does not eliminate the need to answer requests for evidence, attend scheduled appointments or provide confirmation that the offer remains bona fide.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Financial planning while the case is unsettled
Immigration timing is not a reliable paycheck or approval deadline. A job change can create a period in which salary, benefits and relocation costs change while the I-485 remains pending. Treat portability planning as both a legal-document project and a cash-flow project.
Build a transition budget
- List the last expected paycheck, the first paycheck from the new employer and any unpaid gap.
- Price health-insurance changes, deductible exposure, relocation, commuting and required professional expenses.
- Keep an emergency reserve large enough to cover the transition without assuming that the green card will be approved by a particular date.
- Separate one-time moving costs from recurring expenses so you can test whether the new job remains affordable if adjudication takes longer than expected.
Protect the records that support the case
Store offer letters, duty descriptions, employment confirmations and USCIS notices outside the employer’s systems. Retain pay and benefits records that help establish what role you actually performed, but do not treat compensation alone as proof that two occupations are similar. The legal comparison concerns occupational substance and essential qualities.
Recommended Free Tools
Time irreversible decisions carefully
Before selling a home, moving a family or accepting a materially different role, confirm the case posture and the portability analysis. A financial decision can be difficult to reverse if USCIS later questions the category, the I-140 or the similarity of the positions.
Common failure points and how to correct them
| Problem | Why it matters | Safer response |
|---|---|---|
| Counting 180 days from the I-140 filing | The statutory and regulatory threshold applies to the pending I-485. | Recalculate from the I-485 receipt date shown on the notice. |
| Filing Supplement J early | USCIS instructions say not to file a portability Supplement J before the I-485 has been pending at least 180 days. | Wait until the threshold is met and use the current instructions. |
| Relying on matching titles | Titles do not establish the same or similar occupational classification. | Compare actual duties, essential qualities and occupational resemblance. |
| Ignoring an I-140 that is pending, withdrawn or revoked | The petition’s status is part of the portability analysis. | Review notices and confirm whether the petition remains approvable or approved. |
| Assuming every employment-based category qualifies | USCIS identifies exclusions and separate rules for certain categories, including extraordinary-ability, national-interest-waiver and NIW-physician situations. | Identify the exact category before relying on AC21 portability. |
| Overlooking a basis transfer | USCIS policy says the portability period can be measured from the transfer request when the I-485 basis changes. | Rebuild the timeline around the transfer event. |
| Allowing the offered role to disappear | The applicant and employer must intend employment within a reasonable period after residence is granted. | Keep the offer bona fide, document changes and answer USCIS confirmation requests. |
Examples of how the analysis changes
Approved I-140 and a related role after 180 days
An applicant has an approved qualifying I-140 and an I-485 that has been pending for more than 180 days. The new employer offers a permanent role whose essential duties and occupational qualities substantially resemble those in the petition. The applicant can evaluate the AC21 portability route, prepare the comparison and submit Supplement J under the current instructions.

Similar title, different work
An applicant moves from a technical role to a position with the same title but primarily supervises a different type of operation. The title match does not answer the question. The applicant must compare the actual duties and essential occupational qualities; without both detailed descriptions, eligibility cannot be determined.
Pending I-140 at the 180-day point
An applicant reaches 180 days on the I-485 while the I-140 remains pending. The regulation can allow notice of the new offer after the threshold, but USCIS must later approve the I-140 before approving portability. The applicant should not treat the pending petition as equivalent to an approval.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Transfer to a new employment-based category
An applicant asks USCIS to transfer the pending I-485 to a different employment-based category based on a new I-140. The applicant must determine which date controls the portability period because USCIS policy measures the period from the transfer request in this situation. The original receipt date may not be the operative date for the transferred basis.
When individualized advice is especially important
A general checklist cannot resolve a case involving a revoked or withdrawn I-140, a pending petition with unusual procedural history, a category transfer, an extraordinary-ability or national-interest-waiver basis, an NIW physician obligation, or substantially different job duties. Those facts can change whether AC21 portability is available and which date controls. A qualified U.S. immigration lawyer can review the notices, petition history and job descriptions; consulting one is a case-specific choice, not a universal requirement.
Source framework and currentness
The operative definition and conditions come from 8 CFR 245.25. USCIS Policy Manual, Chapter 8, explains transfer of the underlying basis, portability and category exceptions. USCIS Form I-485 Supplement J Instructions, edition 04/01/24, provide the form-specific filing guidance. The eCFR listing used for the regulation was displayed as current on October 8, 2026, with a last amendment date of October 1, 2026. Because form editions and filing procedures can change, verify the current USCIS instructions immediately before filing.
