Fix an outdated estate plan by reviewing every document and asset together, identifying what changed, and then making legally valid updates under the law that governs your will. A handwritten note, crossed-out clause, or beneficiary change on one account may be ineffective or create conflicts. Usually you should replace the will for substantial changes, use a formal amendment only for a narrow change where local law permits it, update beneficiary forms with each institution, and have a locally licensed estate-planning attorney review complex situations.
When should you review a will or estate plan?
Review the plan whenever a life, family, property, or legal change could alter who should inherit, who should act for you, or how an asset transfers. GOV.UK guidance recommends reviewing a will every five years and after major events. An American Bar Association article published in 2025 suggests considering a review every year or two. Those are practical recommendations, not statutory deadlines that apply everywhere.

- Marriage, remarriage, separation, or divorce.
- Birth, adoption, death, or incapacity of a child, beneficiary, executor, trustee, attorney-in-fact, or health-care agent.
- A move to another state or country, or acquisition of property in another jurisdiction.
- A major change in assets, debts, business interests, insurance, retirement savings, or tax circumstances.
- A change in your wishes, such as wanting to benefit a partner, charity, stepchild, or beneficiary who needs support.
- A newly complicated family situation, including a blended family, estrangement, vulnerable beneficiary, or potential dispute.
- Uncertainty about whether the document was signed correctly, whether witnesses are available, or where the original is stored.
A review is also appropriate when a document refers to people, trustees, property, or accounts that no longer exist. Do not wait for the next calendar interval if a divorce agreement, court order, or other legal instrument may restrict a change.
What makes an estate plan outdated?
An estate plan is more than a will. It can include a will and codicils, revocable or irrevocable trusts, financial powers of attorney, health-care directives, deeds, business documents, and beneficiary instructions held by banks, insurers, employers, and retirement plans. A plan becomes outdated when these pieces no longer express your wishes or no longer fit the law, your family, your assets, or one another.

Personal and family changes
Check whether the people named in the documents are still the right people and whether their legal relationships have changed. A former spouse may still appear as an executor or beneficiary. A new child may not be covered by the wording you used. An executor or agent may have died, become ill, moved away, or become unsuitable for the role. A trust created for a minor may need different trustees after the child becomes an adult.
Changes in property and finances
Compare the plan with what you own now. A home may have been sold or refinanced, a business may have been formed, or an investment account may have replaced the account described in an old schedule. Debts, guarantees, digital assets, partnership interests, and property in another jurisdiction can change the practical result even when the will’s wording has not changed.
Changes in legal authority
Confirm that your financial power of attorney and health-care directive still work where you live and name people you trust. A will operates at death; powers of attorney and health-care documents operate during incapacity and therefore require their own review. Divorce, relocation, or a change in an agent’s circumstances can make those documents just as urgent to update as the will.

First, identify which law governs the documents
Signing rules, revocation, witness requirements, treatment of former spouses, and the effect of a move can differ by jurisdiction. Relevant facts may include your domicile, where the document was signed, any choice-of-law language, and where property is located. Do not assume that a rule from the place you currently live automatically governs an older will or foreign property.

GOV.UK’s instructions are UK guidance and note different rules for Scotland and Northern Ireland. Florida’s 2025 statutes provide a concrete United States example of jurisdiction-specific revocation and republication rules; they are not a national rule for every state. A local attorney should determine the governing law when more than one state or country is involved.
Divorce is particularly fact-sensitive. State law may change the effect of a will, power of attorney, or beneficiary designation, but a divorce agreement or court order may impose additional restrictions. A former spouse’s rights, a support obligation, or a settlement provision can affect what you may change and when.
Gather the complete plan before changing anything
Start with documents and records, not with a new form. Create a dated file—digital or paper—and record the location of each original.

- Confirm the latest signed version. Note signing dates, witnesses, notaries, and where each original is held. A draft or photocopy is not necessarily the operative document.
- List the people involved. Record beneficiaries, substitute beneficiaries, executors, trustees, guardians, financial agents, and health-care agents, including contact details and alternates.
- Gather account evidence. Obtain current statements and beneficiary confirmations for retirement plans, life insurance, annuities, bank accounts, brokerage accounts, and payable-on-death or transfer-on-death registrations.
- List property and obligations. Include real estate, jointly owned assets, businesses, loans, guarantees, valuable personal property, digital assets, and property outside your home jurisdiction.
Keep the inventory factual. It is a coordination tool for you and your adviser, not a substitute for legal advice.

Map each asset to its transfer method
The will may control only the assets that pass through the probate estate. Before rewriting gifts, identify the legal mechanism that controls each asset.
| Transfer method | Typical examples | What to check |
|---|---|---|
| Will or probate | Property titled solely in the deceased person’s name and not otherwise designated | Gift wording, residuary clause, executor, and alternate beneficiaries |
| Trust | Assets titled in a trust or governed by trust instructions | Current trust terms, trustee succession, amendment powers, and assets actually transferred to the trust |
| Joint title or survivorship | Jointly owned real estate or financial accounts | Ownership form, survivorship language, and whether the title matches your intention |
| Beneficiary designation | Retirement accounts, life insurance, annuities, and payable-on-death accounts | Primary and contingent beneficiaries, percentages, legal names, and institution confirmation |
Retirement accounts, life insurance, and payable-on-death accounts commonly pass outside the will. Joint ownership can also direct property outside probate. Rewriting the will without correcting these arrangements can leave an ex-spouse, a deceased beneficiary, or an unintended co-owner in control of an important asset.
Choose a codicil or a replacement will
GOV.UK states that, under UK guidance, an update requires an official alteration called a codicil or a new will, and recommends a new will for major changes. The distinction is useful, but the exact effect and execution rules depend on the governing jurisdiction.
| Approach | When it may fit | Risks and checks |
|---|---|---|
| Limited codicil or formal amendment | A narrow change that leaves the rest of the document clear and compatible with local law | It must be executed with the required formalities and stored with the will. Multiple amendments can create conflicting instructions. |
| Replacement will | Several provisions, beneficiaries, executors, guardians, or asset arrangements have changed | The new document must properly revoke or replace the old one, preserve intended gifts, and satisfy local signing and witnessing rules. |
| Broader estate-plan revision | Trusts, powers of attorney, business interests, tax planning, blended families, or cross-border property are involved | All related documents and asset registrations must be coordinated; changing only the will is incomplete. |
Do not edit a signed will by writing in the margins, attaching an informal note, or crossing out language. Do not assume that destroying an old will revokes it or that an online form is valid in your jurisdiction. The legal effect of those acts depends on local law and the surrounding documents. GOV.UK’s instructions about destruction are UK-specific and should not be treated as universal.

Execute the new document under the governing jurisdiction’s rules
Once the wording is settled, follow the formalities required where the will is governed. Those requirements can include a particular number of adult witnesses, witness presence at the same time, signatures in a prescribed order, notarization, self-proving affidavits, or special rules for electronic or remote execution. The cited guidance does not provide a complete checklist for every jurisdiction, so obtain local instructions rather than copying another jurisdiction’s process.
- Use the final version only. Remove draft pages from the signing packet and verify names, addresses, dates, property descriptions, and beneficiary percentages.
- Confirm capacity and voluntariness. Sign when you understand the document and its consequences. If capacity, undue influence, or family pressure could later be questioned, obtain professional advice and document the safeguards permitted by local law.
- Arrange the required witnesses or notary. Use people who satisfy local eligibility rules and who are not disqualified or likely to create a conflict. Follow the jurisdiction’s instructions exactly.
- Complete every execution page. Check initials, signatures, witness statements, affidavits, dates, and notarization before anyone leaves.
- Store the signed original securely. Tell the executor where it is and how to access it. Give trusted people copies only when appropriate, and identify which copy is informational.
- Record what was revoked or replaced. Keep a clear dated history so the executor and adviser can identify the operative document without guessing.
Do not destroy an earlier original merely because you signed a new document unless local advice confirms the correct handling. A revocation clause, a physical act, or republication may have different legal consequences depending on the jurisdiction.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Update retirement and other beneficiary designations separately
Contact each plan administrator, insurer, bank, or brokerage firm and use its official form or online process. The Internal Revenue Service advises retirement-plan participants to review beneficiaries after marriage and when they have children. A plan may require spousal consent before a beneficiary change, especially where federal retirement rules apply.
- Ask the institution for the current beneficiary record and the procedure for changing it.
- Enter each primary and contingent beneficiary by full legal name, relationship, date of birth, and percentage where requested.
- Check whether a spouse must sign a consent or waiver and whether it must be witnessed or notarized.
- Submit the change through the institution’s approved channel, not merely by mentioning it in the will.
- Save the confirmation, effective date, and a copy of the submitted form with your estate-plan inventory.
- Repeat the check for every account; one institution’s update does not update another institution’s records.
Coordinate beneficiary forms with the will or trust. A form naming a trust must identify the correct trust and date, and the trust must actually contain instructions that work for that asset. If a beneficiary is a minor or needs public-benefit support, obtain legal advice before selecting a direct distribution.

Reconcile ownership, trusts, and beneficiary instructions
After signing documents and submitting forms, compare them line by line. Verify that the owner, beneficiary, executor, trustee, and agent names are consistent and that alternates exist where needed. Confirm that deeds and account titles match the intended plan. A trust named on a beneficiary form should be the same trust described in the estate documents, with no ambiguity about amendments or successor trustees.
Check for conflicts created by a divorce decree, separation agreement, prenuptial or postnuptial agreement, loan covenant, business agreement, or court order. A document may be legally valid yet still fail to accomplish the intended result if another binding instrument controls an asset or limits a change.
When professional legal review is the safer choice
A locally licensed estate-planning attorney is especially important when the revision is substantial or the consequences of an error are high. Seek advice for:

A practical maintenance system after the update
Set a recurring calendar reminder for a periodic review—every five years follows GOV.UK’s general UK guidance, while an annual or biennial check is a more frequent option suggested by the American Bar Association article. Review immediately after a major life event rather than waiting for the reminder.
- Keep a current asset and account inventory without recording passwords in the will.
- Record where originals, trust documents, deeds, and beneficiary confirmations are stored.
- Tell the executor and other key decision-makers how to locate the documents.
- Recheck primary and contingent beneficiaries after marriage, divorce, a birth, or a death.
- Review powers of attorney and health-care directives as well as the will.
- Revisit the plan after moving, buying property, selling a business, or acquiring foreign assets.
- Ask an attorney whether changes in local law require a formal restatement or new execution.
The goal is a consistent set of documents and registrations that can be located and understood when needed—not merely a recently signed will.
