Severance is not automatic under federal wage law, unemployment is administered by states, and health-plan election windows can be short. Your last work location, employer size, plan documents, and stated separation dates determine which rules apply.

Build a one-page deadline calendar
Write down your last day of employment, the date active health coverage ends, the date each notice was sent and received, every response deadline, the first date you can file an unemployment claim, and the dates for weekly or biweekly certifications. Add the deadline for any spouse or family-member plan special enrollment. Keep the calendar next to the documents rather than relying on memory.
Identify the state that controls each issue
Unemployment normally follows the state where the work was performed, not automatically the state where you live. A person who worked across state lines or remotely should ask the relevant state unemployment agency where to file. Health insurance can involve the state where you live, the employer’s plan, and federal COBRA rules. State continuation laws, wage rules, and unemployment treatment of severance differ, so do not transfer an answer from one state to another.
Find out what your severance actually promises
The federal baseline is clear: “There is no requirement in the Fair Labor Standards Act (FLSA) for severance pay.” The U.S. Department of Labor says severance is generally a matter of agreement between the employer and worker or the worker’s representative. That does not end the analysis. A written employment contract, severance plan, union agreement, applicable state law, or another federal program can create rights that the FLSA itself does not create.
Read the separation packet in this order
- Confirm the separation date. Check the stated last day of employment and whether salary or benefits continue through a later date.
- Locate the payment terms. Record the severance amount, whether it is a lump sum or installments, the payment dates, and any condition attached to payment.
- Check health-benefit language. Look for the date active coverage ends, whether the employer will pay or subsidize continuation coverage, and which dependents are included.
- Mark every response deadline. A release or other agreement may have a signing deadline. Do not assume that declining to sign has the same effect as signing.
- List continuing obligations. Note return-of-property instructions and any written terms that affect when a payment is made or a benefit continues.
Compare the packet with your employment contract, union agreement, benefit-plan documents, and prior written promises. If the language conflicts, ask the employer or plan administrator to explain the conflict in writing. A qualified attorney or worker representative can assess legal rights that this general guide cannot determine.

Do not confuse WARN notice with severance
A notice under the federal Worker Adjustment and Retraining Notification (WARN) Act is not proof that severance is owed. The Department of Labor’s WARN guidance says WARN does not govern severance benefits, including vacation pay. Those obligations are generally controlled by a contract, state law, and sometimes the Employee Retirement Income Security Act (ERISA). Whether a particular mass layoff or closing meets WARN or a state notice law depends on the employer, number of affected workers, timing, and location. Treat the notice question and the severance question as separate checks.
Ask for missing terms instead of guessing
Send a written request for the final separation documents if you did not receive them. Ask who administers the severance or benefit plan, which document controls, when payment is expected, and how the employer will communicate any change. Keep the response with the original notice. Do not assume an employer is required to subsidize COBRA or to pay unused leave merely because another employer did so; those obligations depend on the governing agreement and law.
Apply for unemployment through the correct state agency
“There is no federal unemployment program.” USAGov explains that each state operates its own unemployment-insurance program and pays benefits. States set their own eligibility test, weekly amount, duration, certification schedule, work-search rules, and treatment of severance.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesFile promptly and answer the separation questions accurately
- Open the official state unemployment site. Start with the state agency for the place where you performed the work. If you worked in more than one state or worked remotely, contact the agency before filing if its instructions are unclear.
- Gather the identifying information. Have your employer’s legal name and address, dates of employment, last day worked, reason given for separation, wage information, and contact details ready.
- Report severance and other separation pay exactly as requested. Do not decide for yourself that severance is either income or irrelevant. The state agency determines how the payment affects eligibility or timing under its law.
- Save the confirmation. Record the claim number, login credentials, filing date, and any request for identity or wage verification.
- Complete every certification. Many states require regular certifications and a continuing search for work. Follow the agency’s schedule and report requested earnings or work activity.
The Department of Labor describes unemployment as intended for people unemployed through no fault of their own, subject to state-law requirements. A layoff often leads to a claim, but only the state agency can decide your individual eligibility. A denial, delay, or request for more information is not a reason to stop responding; use the appeal or fact-finding instructions supplied by the agency.

Understand why filing location matters
Your home address alone may not identify the proper state. A person who commuted across a border, worked temporarily in another state, or performed remote work for an out-of-state employer may have a different filing path. Ask the agency which state’s wage record and rules apply, and keep proof of the answer. Filing in the wrong place can create avoidable delays while agencies transfer or coordinate the claim.
Choose health coverage before an election window closes
Health coverage is the most time-sensitive benefits decision for many laid-off workers. Compare continuation of the existing plan with a spouse’s or family member’s employer plan, Marketplace coverage, and Medicaid or CHIP where relevant. Compare the actual premium, deductible, out-of-pocket limit, provider network, prescriptions, dependents covered, effective date, and the deadline for enrollment.
COBRA: continuing the existing group plan
Federal COBRA may let a worker, spouse, and dependent children temporarily continue the existing group health plan after a qualifying loss of coverage. The general federal rule covers private-sector employers with 20 or more employees and most state and local government plans. Federal government plans and certain church plans are outside that general rule. States may have mini-COBRA laws covering some smaller employers, so ask the state insurance department or plan administrator which rule applies.
The general COBRA election period is 60 days, measured from the later of the date the election notice is provided or the date coverage ends. The usual initial continuation period after job loss is 18 months, although longer periods can apply in some circumstances. Your notice and individual facts control the actual dates, so write the dates from the notice on your calendar rather than counting from the layoff announcement.

COBRA commonly costs up to 102 percent of the plan cost: the employee and employer portions together, plus an administrative fee of up to 2 percent. Ask for the exact monthly amount for each tier of coverage and whether the employer is paying a subsidy as part of severance. An employer may subsidize COBRA, but federal law does not generally require that subsidy.
Use the COBRA notice as a decision document
Check which family members may elect coverage separately, the election deadline, the effective date, the premium for each period, payment instructions, and the circumstances that end continuation. Ask the plan administrator about doctors, prescriptions, deductibles already met, and how a subsidy changes the amount you owe. If a subsidy ends, do not assume that event creates a new special-enrollment period in another plan; verify the deadline immediately.
Join a spouse’s or family member’s employer plan
Loss of eligibility for your former employer’s coverage may trigger special enrollment in a spouse’s or family member’s employer plan. Department of Labor guidance generally gives the worker 30 days to request enrollment. Confirm the exact deadline, documents required, premium, network, and effective date with that plan’s administrator. Do not wait for a COBRA decision if the 30-day period is running.

Compare Marketplace, Medicaid, and CHIP coverage
Marketplace coverage can be a different-cost option after job-based coverage ends. For your location and household, compare the premium, deductible, out-of-pocket limit, provider network, and prescription coverage, and check whether current household income affects financial assistance. Medicaid or CHIP may be relevant for eligible adults or children. Use HealthCare.gov or your state Marketplace and the relevant state agency for current enrollment windows and eligibility; a general article cannot quote your premium or determine your household qualification.

Protect retirement accounts and other earned benefits
Ask the retirement-plan administrator for the Summary Plan Description and an individual benefit statement. Those documents show the plan’s rules, but ask targeted questions as well:
- What is the account balance as of the separation date?
- Which portion is vested, and which portion, if any, is subject to forfeiture?
- When may you take a distribution, and what distribution choices does the plan offer?
- Are there deadlines, forms, or minimum balances that affect the choice?
- How does separation affect employer contributions, equity, bonuses, paid leave, or other benefits?
Do not assume that a balance, a contribution, or an award is fully yours merely because it appears on a statement. Vesting, distribution, and payment rules differ by plan and agreement. Request the answer in writing and keep it with the plan documents.
Use the right specialist for the question
The Department of Labor’s Employee Benefits Security Administration can assist with questions about ERISA-covered retirement and health plans. The state unemployment agency decides filing and eligibility questions. The plan administrator controls COBRA notices, premiums, election dates, and plan terms. Directing each question to the responsible office is faster than treating every problem as a severance dispute.

A practical first-week sequence
- Day one: Save the layoff notice, separation packet, pay records, benefits statements, and all electronic messages. Write down the last day worked and the date coverage ends.
- Day two: Contact the state unemployment agency or follow its official filing instructions. Ask where to file if your work crossed state lines or was remote.
- Day two or three: Request the COBRA notice or confirm when it will arrive. Price COBRA, check the 60-day general election window, and identify any employer subsidy.
- Day three or four: Ask a spouse’s or family member’s plan administrator about the generally 30-day special-enrollment window and effective date. Investigate Marketplace, Medicaid, or CHIP eligibility at the same time.
- During the first week: Request the retirement Summary Plan Description and individual benefit statement. Ask about vesting, distribution, equity, bonus, paid-leave, and other plan terms.
- Every week afterward: Complete unemployment certifications, meet work-search requirements where applicable, pay elected health premiums on time, and file every agency or plan response by its written deadline.
Common mistakes and how to avoid them
- Assuming a layoff guarantees severance: Check the agreement, plan, union contract, and applicable law because the FLSA does not require severance.
- Treating WARN notice as a severance promise: Analyze notice rights and payment rights separately.
- Waiting for a severance negotiation before filing unemployment: File promptly and report separation pay as the state requests; the agency decides its effect.
- Using your home state without checking: Ask the agency where work was performed, especially for interstate or remote work.
- Missing health-plan dates: Record the COBRA election date and the other-plan special-enrollment date from the notices. A later subsidy change may not restart either clock.
- Choosing coverage by premium alone: Include deductibles, out-of-pocket limits, networks, prescriptions, dependents, and effective dates.
- Assuming retirement money is fully vested: Obtain the plan statement and ask the administrator which balance is vested and what distribution rules apply.
- Relying on a phone conversation: Ask for the controlling document or a written confirmation and save it.
When to seek individualized help
Get qualified advice when a release is unclear, the employer disputes a written promise, a mass-layoff notice may apply, a retirement or health plan refuses documents, or the value of a disputed benefit is significant. For unemployment, use the state agency’s fact-finding and appeal process. For ERISA-covered benefits, contact the Department of Labor’s Employee Benefits Security Administration. For coverage costs and election dates, contact the plan administrator. These channels address different questions; one cannot substitute for another.
